BY APPLICANT Agent, Owner, Partner STATEMENT OF AGREEMENT TENTATIVE SUBDIVISION MAP CITY OF CARLSBAD The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time restriction on Planning Commission processing of Tentative Maps and a thirty (30) day time limit for City Council action. These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applications for other approvals which are prerequisites to the map; i.e.. Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits and the thirty (30) day time limits are often exceeded. If you wish to have your application processed concurrently, this agreement must be signed by the applicant or his agent. If you choose not to sign the statement, the City will not accept your application for the Tentative Map until all prior necessary entitlements have been processed and approved. The undersigned understands that the processing time required by the City may exceed the time limits, therefore the undersigned agrees to extend the time limits for Planning Commission and City Council action and fully concurs with any extensions of time up to one year from the date the application was accepted as complete to properly review all of the applications. RECOMMENDATION That the Planning Commission APPROVE the Negative Declaration issued by the Planning Director and ADOPT Resolution No. 2543 APPROVING CT 85-36, based on the findings and conditions contained therein. II. PROJECT DESCRIPTION The applicant is requesting approval of a 24-lot subdivision on 6.7 acres (3.6 du/ac) located as described above. It is an infill project in the northwest quadrant of the City. Presently, the site supports greenhouses and a single family home. This project would construct the final portion of Donna Drive, allowing a through connection from Elm Avenue to Chestnut Avenue. Donna Drive will be paved 36 feet curb-to-curb with a 60-foot right-of-way to match the existing roadway to the north and south. As proposed, a cul-de-sac will extend off of Donna Drive toward Monroe Street. Lots 1 through 6 average 8000 square feet, while Lots 17 through 24 average 10,400 square feet. There is a 45-foot elevational difference going from west to east on the 6.7 acre property, giving future units on the east side potential oceanviews. The site is bordered on the north, east and south by single family residential. Monroe Street is adjacent to the west with the high school across the street. A retaining wall will be constructed along the northern property line for drainage purposes - - it will be a maximum of 4 feet high. A 2-4 foot high retaining wall also will be placed along Monroe Street, with heavy landscaping in front of it to prohibit possible grafitti. III. Although this project is at the high end of the density range, it is consistent with the underlying zoning of R-1-7500 and actually exceeds that minimum square footage in all of the proposed lots. The Land Use Element allows the RLM classification to yield higher densities if the underlying zone is met, which staff feels is appropriate in this case. The General Plan for all surrounding property is also RLM with the exception of the high school site across Monroe Street which is designated for school use. R-1 Zone In terms of meeting the standards of the R-1 zone, the project exceeds minimum lot size requirements as mentioned previously. Lot widths are 60 feet or greater. Although a site plan was not required as part of this application, front, rear, and sideyard setbacks can be easily met due to the large lot areas. Engineering standards also have been met with Donna Drive and the cul-de-sac improvements. Compatibility The property is located in an area of R-1-7500 and R-1-10000 zoning. Existing single family tract developments lie to the north, east and south. The proposed lots are compatible in size with the surrounding residential developments. The lots on the eastern side of the site will be separated from the adjoining lots by an elevational difference of 10-15 feet and subsequently by a slope in the backyards of those lots. This difference in elevation will help to ensure compatibility. The church parking lot abuts Lots 14 and 15 and fencing can be used for privacy on these and the rest of the lots. The two lots fronting onto Monroe Street will have a retaining wall of 2-4 feet in height and a fence along the sideyards. Heavy landscaping will be required on the Monroe side of the wall to prevent graffiti. To further ensure compability a condition has been added (No. 22) requiring the submittal of elevations prior to issuance of building permits. This will mean that proposed homes will be similar to those existing in the Donna Drive area. -2- In summary, staff feels that the subdivision as proposed is consistent with the RLM designation of the General Plan, the R-1 zone and is similar to, and compatible with surrounding development. In addition, the project is proposed as a standard single family development with large lots and is, therefore, being proposed without a PUD. This is exactly the type of development that currently exists in this area of Carlsbad. For these reasons staff is recommending approval. IV. ENVIRONMENTAL REVIEW The Planning Director has determined that this project will not have a significant effect on the environment and, therefore, has issued a Negative Declaration on February 8, 1986.
