and has made the following determinations regarding the above described project.
1. The project will not have a significant effect on the environment.
2. This project was reviewed previously under an EIR and a Negative Declaration was prepared
for this project pursuant to the provisions of CEQA.
3. Mitigation measures were not made a condition of the approval of the project.
4. Findings were not made pursuant to the provisions of CEQA.

PROJECT ADDRESS/LOCATION: South of Alga Road between Kestrel Drive and 1-5.
PROJECT DESCRIPTION: A Tentative Tract Map to create 34 single family lots and 2
open space lots.
The City of Carlsbad has conducted an environmental review of the above described project
pursuant to the Guidelines for Implementation ofthe Califomia Envirormiental QuaUty Act
and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said
review, a Negative Declaration (declaration that the project will not have a significant
impact on the environment) is hereby issued for the subject project. Justification for this
action is on file in the Plarming Department.
A copy of the Negative Declaration with supportive documents is on file in the Plaiming
Department, 2075 Las Palmas Drive, Carlsbad, Califomia 92009. Comments from the
public are invited. Please submit coimnents in writing to the Planning Department within

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, section 15063 requires that the City conduct an
Environmental Impact Assessment to determine if a project may have a significant effect on the environment.
The Environmental Impact Assessment appears in the following pages in the form of a checklist. This checklist
8 identifies any physical, biological and human factors that might be impacted by the proposed project and
provides the City with information to use as the basis for deciding whether to prepare an Environmental
Impact Report or Negative Declaration.
* A Negative Declaration may be prepared if the City perceives no substantial evidence that the project or
any of its aspects may cause a significant effect on the environment. On the checklist, "NO" will be checked
to indicate this determination.
* An EIR must be prepared if the City detennines that there is substantial evidence that any aspect of the
project may cause a significant effect on the environment. The project may qualify for a Negative
Declaration however, if adverse impacts are mitigated so that environmental effects can be deemed

DISCUSSION OF ENVIRONMENTAL EVALUATION
Proiect Description
The proposed project involves finish grading and infrastmcture constmction for Planning Area 25 of the
Aviara Master Plan. This tentative tract map provides 34 single family lots and 2 open space lots on a 28.4
acre site. The project site has been mass graded as part of the Aviara Master Plan CT 89-37. The proposed
project is consistent v^ath Master Tentative Tract Map (CT 89-37) for the Master Plan, and mitigation
measures as required by the Master Plan Environmental Impact Report (EIR 83-2(A)) have been implemented.
1. The proposed project will not result in unstable earth conditions or exposure to geologic hazards. The
mass grading for the site has been done in compliance with CT 89-37 (the approved tentative map
for the Master Plan). The proposed finish grading and infrastmcture constmction v^U involve 2,200
cubic yards of cut and 73,000 cubic yards of fill. Import totals 70,900 cubic yards. Pad elevations
for some lots on the northem portion of the site are somewhat higher (10 feet) than originally
approved, however the plan is substantially in corformance with the approved Master Tentative Map.
2. Any major topographic changes were evaluated in the EIR prepared for the Master Plan. Only minor
changes will result from the finish grading and infrastmcture constmction of the current project. No
development is proposed at this time. As indicated in #1 above some elevations have been changed,
but the plan is substantially in conformance with original approvals.
3/4. The proposed project will not result in or be affected by erosion of soils, nor result in changes to
beach sands or channels. Drainage and erosion control facilities will be required of the project in
conformance vnth. City standards. A permanent desiltation basin has been constmcted in Planning
Area 28 (to the south) to mitigate potential impacts from soil erosion. The drainage and erosion
control mitigation required will adequately mitigate any potential impacts to Batiquitos Lagoon.
5. The proposed subdivision will not result in substantial adverse effects on ambient air quality. The
ultimate development of the site (into single family residences) vydll contribute incrementally to an
increase in local and regional air pollution. This project (when ultimately developed) will generate
only a ininor amount of traffic (340 average daily trips). No development is proposed at this time.
6. The project will not result in substantial changes in air movement, odor, moisture, or temperature.
Air quality impacts (dust) from grading activities v^dll be controlled by watering. No stmctures are
proposed at this time.
7. The project will not change the course or flow of waters. No water bodies are located vithin or
immediately adjacent to this planning area.
8. The project v^l not affect the quantity or quality of surface water, groimd water, or public water
supply. The project is conditioned to provide adequate facilities to handle any increased runoff
resulting from the development of the site.
9/10. The project will not substantially increase usage or depletion of any natural resource, nor will it use
substantial amounts of fuel or energy. The project involves only finish grading and infrastmcture
constmction at this time.

11. All mitigation for archaeological, paleontological, and historic sites required by the Master Plan EIR
has been done.
12. The EIR prepared for the Master Plan identified areas of Coastal Sage Scmb and required mitigation
in the form of Coastal deed restricted open space areas. The proposed subdivision does not encroach
into these deed restricted areas.
13 The proposed project v^dll not encroach into the coastal deed restricted areas, thus will not result in
a barrier to replenishment. Any landscaping proposed vnth this project must be compatible with the
deed restricted area vegetation.
14. The approved Master Plan for this project required mitigation for conversion of agricultural land in
the form of agricultural conversion fees. The applicant has paid all such fees required for this project.
15/16. The site contains areas of Coastal Sage Scmb (gnatcatcher habitat). However, these areas are Coastal
deed restricted open space areas. This project does not encroach into the deed restricted areas.
Therefore, no significant impacts to species or habitat is expected.
17. The proposed ultimate development (single family residences) for the site is consistent wdth the
General Plan and with the Master Plan (MP 177) goveming development of the site.
18. The proposed project will not substantially affect public utilities or public services. The project will
be conditioned to comply with all requirements of the local facilities management plan, thus meeting
the demands of the future development proposed for the site.
19. No development is proposed with this current project. However, the upgrading of the Batiquitos
Pump Station will be required prior to constmction of the residential units, and any development
proposal will be so conditioned.
20. The proposed project will not result in an increase to existing noise levels. Short-term intermittent
increases to noise levels which may occur during grading and constmction will be ininor and
insignificant.
21. Because the proposed project is for finish grading and public infrastmcture constmction, it will not
result in an increase in light or glare. Any necessary street lights will be of the low sodium variety,
minimizing glare.
22. The proposed project would not be expected to involve a significant risk of explosion or the release
of hazardous substances.
23. Because no development of units is proposed at this time, the project will have no effects on density.
24. The proposed project will ultimately contribute additional housing units to meet current demand. No
development is proposed at this time.
25. The proposed project will ultimately generate 340 daily trips. This ininor increase in trips is not
significant. The existing and proposed new portions of the circulation system will accommodate this
traffic. Circulation and traffic for the project was evaluated in the EIR prepared for the Master Plan.
No constmction of units is proposed currently.
26. Any demand for parking created by the ultimate development of this project will be satisfied on site.
27. The proposed project will not impact existing transportation systeins or alter present pattems of
circulation. No new trips will be generated by this project, which is limited to finish grading and
infrastmcture constmction.
i28. The proposed project will not alter waterbome, rail, or air traffic. There are no water bodies or rail
lines on or adjacent to the site. The project is not within the Airport Influence Area for McClellan
Palomar Airport.
29. The project v\dll not increase traffic hazards to motor vehicles, bicyclists, or pedestrians. The project
is designed to provide adequate separation between vehicular and pedestrian traffic.
30. The project is designed such that it will not interfere with emergency response or evacuation plans.
31. Revegetation of slopes after grading was required. This project, involving finish grading and
infrastmcture constmction would not be expected to result in aesthetic impacts or offensive public
views.
32. The proposed project will not affect the quality or quantity of existing recreation opportunities. The
ultimate development of the site into single family homes will include the provision of private yards
and a commumty trail. No development is proposed at this time.

ANALYSIS OF VL\BLE ALTERNATIVES TO THE PROPOSED PROJECT SUCH AS:

a) The scale of the proposed project (subdivision into 34 single family and 2 open space lots) is
appropriate as a single phase project.
b) The site design is consistent with the approved Master Plan (MP 177). The design includes
preservation of open space coastal deed restricted areas. No additional environmental benefits would
be derived by an altemate site design. '
c) The proposed scale of development (34 dwelling units) is less than the density approved for the site
in the Master Plan (37 dwelling units.)
d) The proposed use is consistent with the General Plan and with the approved Master Plan. No
additional environmental benefits would result from an altemate use.
e) The actual development of the site will occur at a future time. The current project proposal is for
lot subdivision and infrastmcture constmction only.
f) The project site is appropriate for the proposed use. The project does not preclude similar uses on
other sites.
g) The no-project altemative would not prevent the ultimate development of the site. The proposed
project is consistent with the General Plan and the approved Master Plan and provides mitigation
of environmental impacts as required by the EIR for the Master Plan.
DETERMINATION (To Be Completed By The Planning Department)
On the basis of this initial evaluation:
X I find the proposed project COULD NOT have a significant effect on the environment, and
a NEGATIVE DECLARATION will be prepared.
I find that the proposed project COULD NOT have a significant effect on the environment,
because the environmental effects of the proposed project have already been considered in
conjunction with previously certified environmental documents and no additional
environmental review is required. Therefore, a Notice of Detennination has been prepared.
I find that although the proposed project could have a significant effect on the environment,
there will not be a significant effect in this case because the mitigation measures described
on an attached
sheet have been added to the project. A Conditional Negative
Declaration will be proposed.
I find the proposed project MAY have a significant effect on the environment, and an
ENVIRONMENTAL IMPACT REPORT is required.

Gentlemen:
Initial plans for the northern end of P.A. 25 showed a pad elevation of 220 to 225 feet
above mean sea level. At this lower pad elevation a buttress was needed to adequately
stabilize the resulting cut slope in to the landslide. This slope area was previously
designated as Slope II on the remedial grading plans. In final design, other non-
geotechnical considerations such as views were assessed. An alternative mitigation method
ultimately decided upon was to raise the pad elevation by a minimum of 10 feet above the
previous grade. This elevation change raised the factor of safety in this area to above 1.5
thereby eliminating the need for a buttress. Since the resulting cut slope is to be made into
landslide debris we recommend that a stability fill be placed along the cut slope, with the
same dimensions as Slope III.
Discussions with P&D technologies indicate that a small retaining wall will be placed at the
toe of the slope in this area. It is our opinion that this retaining wall should not have an
adverse effect on the stability of the slope above it.

The purpose of this letter is to demonstrate compliance of Aviara Planning Area 25 with the noise
related Gonditions of Approval placed on the project by the City of Carlsbad. This noise
assessment is based on plans made available to Mestre Greve Associates on September 20,1991. A
summary of the noise assessment for Area 25 is presented below and remains the same as the
previous study.
The project specifies the development of detached single-family residential units in the City of
Carlsbad. The nearest significant arterial is Alga Road with an average daily traffic volume of
18,600 vehicles per day and a grade of about 3.5 percent. Alga Road is separated from the project
by 420 feet. The space between Planning area 25 and Alga Road is occupied by trees that are to be
preserved. The worst case home in Aviara Planning Area 25 is located on Lot 11. Alga Road is
located 420 feet to the north. Lot 11 will experience a maximum worst case noise level of 54.3
CNEL due to traffic noise associated with Alga Road. This is below the 60 CNEL noise standard
placed on the project by the City of Carlsbad and therefore mitigation measures will not be required
for Aviara Planning Area 25.

STANDARD CONDITIONS:
1. Notice of Receipt and Acknowledgement. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
pennittee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commission
office.
2. Expiration. If development has not commenced, the permit will expire two
years from the date on which the Commission voted on the application.
Development shall be pursued in a diligent manner and completed in a
reasonable period of time. Application for extension of the permit must
be made prior to the expiration date.
3. Compliance. All development must occur In strict compliance with the
proposal as set forth below. Any deviation from the approved plans must
be reviewed and approved by the staff and may require Commission approval.
4. Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Commission.
5. Inspections. The Commission staff shall be allowed to inspect the site
and the development during construction, subject to 24-hour advance notice.
6. Assignment. The permit may be assigned to any qualified person, provided
assignee files with the Commission an affidavit accepting all terms and
conditions of the permit.
7. Terms and Conditions Run with the Land. These terms and conditions shall
be perpetual, and it is the intention of the Commission and the permittee
to bind all future owners and possessors of the subject property to the
terms and conditions.
SPECIAL CONDITIONS:
The permit Is subject to the following conditions:
1. Grading/Erosion Control. Prior to the issuance of the pennit, the
applicant shall submit to the Executive Director for rev-iew and written
approval, final site and grading plans approved by the City of Carlsbad which
incorporate the following requirements:
A. All grading activity shall be prohibited between October 1st and
April 1st of any year.
8. All permanent runoff and erosion control devices shall be
developed and installed prior to October 1.

C. All areas disturbed, but not completed, during the construction
season, including graded pads, shall be stabilized prior to October 1.
Any proposed temporary erosion control measures, such as Interceptor
ditches, sandbagging, debris basins, temporary desilting basins and silt
traps shall be used in conjunction with plantings to minimize soils loss
from the construction site.
D. Maintenance of temporary erosion control measures 1s the
responsibility of the applicant, Including replacement of any devices
altered or dislodged by storms.
2. Landscape/Fire Suppression Plan. Prior to the Issuance of the coastal
development permit, the applicant shall submit a revised detailed revegetation
plan Indicating the type, size, extent and location of all plant materials,
any proposed irrigation system and other landscape features to revegetate all
manufactured slopes. Selective clearing and removal of vegetation in Zones 2
and 3 shall be Identified, and shall not exceed the limits of the fire
suppression program contained in CDP #6-91-46-A. Drought tolerant native
vegetation only shall be allowed in Fire Suppression Zone 2 and Zone 3 areas.
No removal or replacement of landscape materials shall occur beyond the limits
of Zone 3 areas. Drought tolerant native plants shall be utilized to the
maximum extent feasible to re-establish the area consistent with its present
character and that of the surrounding vegetation in all other areas. Said
plan shall be submitted to, reviewed and approved in writing by the Executive
Director.
3. Future Development. This permit is for subdivision and site
improvements of Planning Area 25 only. All other development proposals for
the site, including the construction of single family residences, shall
require review and approval by the Coastal Commission, or its successor in
Interest, under a separate coastal development permit or an amendment to this
pennit.

I. RECOMMENDATION

Planning Commission Resolution No. 3339 APPROVING CT 90-37, based on the findings
and subject to the conditions contained therein.
II. PROJEGT DESCRIPTION AND BACKGROUND
This project is a Tentative Tract Map for 34 single family residential lots (minimum 7,500
square feet) and 2 open space lots in Plaiming Area 25 of the Aviara Master Plan.
Planning Area 25 is located south of Alga Road between Kestrel Drive and 1-5 and contains
27.2 acres. The site has a combination General Plan Designation of RLM/RM/OS/RC/N
and is zoned PC. The Aviara Master Plan allows a maximum of 37 dwelling units on this
planning area (1.30 du/ac). The proposal includes 34 lots (1.25 du/ac). The property is
located within the Coastal Zone (Mello I) and will require a Coastal Development Permit.
The project also includes a portion of a community trail which will run along the
meandering sidewalk on the south side of Alga Road. The project also incorporates deed
restricted coastal resource open space as required by the Master Plan, including tree
preservation and tree introduction areas. A drainage area will be located near the
intersection of Alga Road and Kestrel Drive. The gate for access to this drainage area will
be of wrought iron with stucco pilasters.
The project includes two retaining walls. The first, along the rear of lots 16 through 19,
will be a maximum of six feet in height. The second will be along a portion of Kestrel
Drive behind Lots 2 through 5. This wall will incorporate popouts and recesses. The
popout areas will have a maximum height of 4 feet. The recessed areas will have a
maximum height of 6 1/2 feet. This wall will be landscaped.

III. ANALYSIS

DISCUSSION
The proposed Tentative Map does comply with all requirements of the Subdivision
Ordinance, Zoning Ordinance and the Aviara Master Plan. Each Lot contains a minimum
of 7,500 square feet. Minimum lot width is 60 feet, except where reduction is allowed for
cul-de-sac lots. Each lot also has a minimum depth of 90 feet, and a depth to width ratio
no greater than 3:1.
The project is consistent with the approved Aviara Phase II Master Tentative Map. The
grading proposed for this project involves 2,200 CY of cut and 2,200 CY of fill.
The proposed map is in compliance with all policies of the Mello I Local Coastal Programs
through mitigation required by the Aviara Master Plan. A portion of the planning area was
placed into deed restricted open space as mitigation. The proposed tract map does not
encroach into that open space.
The proposed map is consistent with the Zone 19 Local Facilities Management Plan. All
facilities and services necessary will be available to serve the project.
IV. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not have a significant impact
on the environment and therefore, has issued a Negative Declaration on December 12,
1991. The environmental analysis concludes that, because: (1) the project site has already
been reviewed with the Aviara Master Plan EIR (EIR 83-2(A)) and the Mitigated Negative
Declaration for the Aviara Phase 11 Tentative Map (CT 89-37); (2) as designed, the project
implements all recommended mitigation measures of these two environmental documents;
and (3) the project preserves in open space all previously deed restricted coastal resource
areas, no environmental impacts are anticipated.

DISCUSSION OF ENVIRONMENTAL EVALUATION
Proiect Description
The proposed project involves finish grading and infrastmcture constmction for Planning Area 25 of the
Aviara Master Plan. This tentative tract map provides 34 single family lots and 2 open space lots on a 28.4
acre site. The project site has been mass graded as part of the Aviara Master Plan CT 89-37. The proposed
project is consistent with Master Tentative Tract Map (CT 89-37) for the Master Plan, and mitigation
measures as required by the Master Plan Environmental Impact Report (EIR 83-2(A)) have been implemented.
1. The proposed project will not result in unstable earth conditions or exposure to geologic hazards. The
mass grading for the site has been done in compliance with CT 89-37 (the approved tentative map
for the Master Plan). The proposed finish grading and infrastmcture constmction will involve 2,200
cubic yards of cut and 73,000 cubic yards of fill. Import totals 70,900 cubic yards. Pad elevations
for some lots on the northem portion of the site are somewhat higher (10 feet) than originally
approved, however the plan is substantially in corformance with the approved Master Tentative Map.
2. Any major topographic changes were evaluated in the EIR prepared for the Master Plan. Only minor
changes will result from the finish grading and infrastmcture constmction of the current project. No
development is proposed at this time. As indicated in #1 above some elevations have been changed,
but the plan is substantially in conformance with original approvals.
3/4. The proposed project v^dll not result in or be affected by erosion of soils, nor result in changes to
beach sands or channels. Drainage and erosion control facilities will be reqtiired of the project in
conformance with City standards. A permanent desiltation basin has been constmcted in Planning
Area 28 (to the south) to mitigate potential impacts from soil erosion. The drainage and erosion
control mitigation required will adequately mitigate any potential impacts to Batiquitos Lagoon.
5. The proposed subdivision will not result in substantial adverse effects on ambient air quality. The
ultimate development of the site (into single family residences) will contribute incrementally to an
increase in local and regional air pollution. This project (when ultimately developed) will generate
only a ininor amount of traffic (340 average daily trips). No development is proposed at this time.
6. The project will not result in substantial changes in air movement, odor, moisture, or temperature.
Air quality impacts (dust) from grading activities will be controlled by watering. No stmctures are
proposed at this time.
7. The project will not change the course or flow of waters. No water bodies are located within or
immediately adjacent to this planning area.
8. The project will not affect the quantity or quality of surface water, ground water, or public water
supply. The project is conditioned to provide adequate facilities to handle any increased runoff
resulting from the development of the site.
9/10. The project will not substantially increase usage or depletion of any natural resource, nor will it use
substantial amounts of fuel or energy. The project involves only finish grading and infrastmcture
constmction at this time.
11. All mitigation for archaeological, paleontological, and historic sites required by the Master Plan EIR
has been done.
12. The EIR prepared for the Master Plan identified areas of Coastal Sage Scmb and required mitigation
in the form of Coastal deed restricted open space areas. The proposed subdivision does not encroach
into these deed restricted areas.
13 The proposed project will not encroach into the coastal deed restricted areas, thus will not result in
a barrier to replenishment. Any landscaping proposed with this project must be compatible with the
deed restricted area vegetation.
14. The approved Master Plan for this project required mitigation for conversion of agricultural land in
the form of agricultural conversion fees. The applicant has paid all such fees required for this project.
15/16. The site contains areas of Coastal Sage Scmb (gnatcatcher habitat). However, these areas are Coastal
deed restricted open space areas. This project does not encroach into the deed restricted areas.
Therefore, no significant impacts to species or habitat is expected.
17. The proposed ultimate development (single family residences) for the site is consistent with the
General Plan and with the Master Plan (MP 177) goveming development of the site.
18. The proposed project will not substantially affect public utilities or public services. The project v^ll
be conditioned to comply with all requirements of the local facilities management plan, thus meeting
the demands of the future development proposed for the site.
19. No development is proposed with this current project. However, the upgrading of the Batiquitos
Pump Station will be required prior to constmction of the residential units, and any development
proposal will be so conditioned.
20. The proposed project v^U not result in an increase to existing noise levels. Short-term intermittent
increases to noise levels which may occur during grading and constmction will be ininor and
insignificant.
21. Because the proposed project is for finish grading and public infrastmcture constmction, it will not
result in an increase in light or glare. Any necessary street lights will be of the low sodium variety,
minimizing glare.
22. The proposed project would not be expected to involve a significant risk of explosion or the release
of hazardous substances.
23. Because no development of units is proposed at this time, the project will have no effects on density.
24. The proposed project will ultimately contribute additional housing tinits to meet current demand. No
development is proposed at this time.
25. The proposed project will ultimately generate 340 daily trips. This minor increase in trips is not
significant. The existing and proposed new portions of the circulation system will accommodate this
traffic. Circulation and traffic for the project was evaluated in the EIR prepared for the Master Plan.
No constmction of units is proposed currently.
26. Any demand for parking created by the ultimate development of this project will be satisfied on site.
27. The proposed project will not impact existing transportation systeins or alter present pattems of
circulation. No new trips will be generated by this project, which is limited to finish grading and
infrastmcture constmction.
28. The proposed project will not alter waterbome, rail, or air traffic. There are no water bodies or rail
lines on or adjacent to the site. The project is not within the Airport Influence Area for McClellan
Palomar Airport,
29. The project will not increase traffic hazards to motor vehicles, bicyclists, or pedestrians. The project
is designed to provide adequate separation between vehicular and pedestrian traffic.
30. The project is designed such that it will not interfere vdth emergency response or evacuation plans.
31. Revegetation of slopes after grading was required. This project, involving finish grading and
infrastmcture constmction would not be expected to result in aesthetic impacts or offensive public
views.
32. The proposed project will not affect the quality or quantity of existing recreation opportunities. The
ultimate development of the site into single family homes will include the provision of private yards
and a community trail. No development is proposed at this time.

preservation of open space coastal deed restricted areas. No additional environmental benefits would
be derived by an altemate site design.
c) The proposed scale of development (34 dwelling units) is less than the density approved for the site
in the Master Plan (37 dwelling units.)
d) The proposed use is consistent with the General Plan and with the approved Master Plan. No
additional environmental benefits would result from an altemate use.
e) The actual development of the site will occur at a future time. The current project proposal is for
lot subdivision and infrastmcture constmction only.
f) The project site is appropriate for the proposed use. The project does not preclude similar uses on
other sites.
g) The no-project altemative would not prevent the ultimate development of the site. The proposed
project is consistent with the General Plan and the approved Master Plan and provides mitigation
of environmental impacts as required by the EIR for the Master Plan.

On the basis of this initial evaluation:
