X DISCUSSION OF ENVIRONMENTAL EVALUATION PHYSICAL ENVIRONMENT The project proposes approximately 870 cubic yards of fill. Grading quantities based on a net pad area of .882 acres will be 767 cubic yards per acre. Grading will eliminate a split pad situation and create a single developable pad. Because the site has been previously graded, the change in the topography will not be considered significant. Manufactured slopes along the northem edge of the site v\rill be planted for aesthetics and erosion control. The project is not adjacent to any significant bodies of water. The La Costa Golf Course is contiguous to the north which is in a one hundred year flood plain. That flood plain will not be affected by the proposed development. Although CEQA does allow for a certain percentage of particulates to be released in the air, the cumulative effect of development will contribute to the further degradation of the San Diego air quality basin. As a residential project there are not many opportunities to adequately address the issue of air quality. No special ride share programs can be required for the operation of the project nor can there be restrictions on the use of fireplaces, bar-b-ques, etc. It is not anticipated that the proposal will have an effect on air movement, odor, moisture, or temperature. The buildings proposed are two stories over a garage adjacent to other existing projects of the same stature. No uses have been identified specific to the residential nature ofthe project which would have offensive odors, create moisture or change the general temperature of the area. The project is located adjacent to a one hundred year flood plain which is the La Costa Golf Course. There will be no project encroachment into the golf course. As with all construction, the rate at which water percolates to the water table will be altered. Alteration however does not mean adverse impacts because the area in question is relatively small. The project will also include a drainage system which will filter urban pollutants further protecting the ground water. No significant natural resources have been identified as being used for construction or operation of the site. It is not anticipated that substantial amounts of fuel or energy will be necessary to operate the proposed residences. The use of water on-site can be regulated through the installation of low flow fixtures and drought tolerant landscaping with automatic irrigation. The project site has been previously disturbed by grading. There is no evidence of archeological, paleontological or historical resources present on the site. BIOLOGICAL ENVIRONMENT Field observation revealed the presence of a single mature tree on-site. The assessed value of the tree is not significant and can be replaced by a new tree located more strategic to the finished product. It is suspected that the lack of overall growth on the site is a result of previous grading. Once the project is built, there will be formal landscaping. The site has not been used as an agricultural site nor is it a viable location for crop production. There is not enough acreage for agriculture and its proximity to adjacent residences may have negative effects due to noise, particulates, smell and crop chemicals if there was farming. It is assumed that because there is an absence of vegetation on the site that there are no species of animals which are dependent on the site. No wildlife was observed during field inspections. HUMAN ENVIRONMENT The site is designated as a residential site on the General Plan and Zoning maps. The proposed use is consistent with those designations. There is no pending or anticipated future applications for a change to the designated Zoning or General Plan. It is not anticipated that there will be a significant increase in demand for services provided from public utilities, schools, police or fire. Sewer needs can be accommodated by the existing system so there is no need to expand or create a new system. Noise and light will be generated firom the project, however not in significant quantities. Lighting on the site will be designed to provide enough light for safety purposes on-site and will be directed away from adjacent residences. Noise wdll be produced from everyday occurrences typical to a residential development. Noise levels will not exceed existing levels of adjacent uses. By nature of a residential development, the population will change because there will be additional housing. Providing housing will have a beneficial effect on the housing demand. Traffic will be generated at an assumed rate of eight average daily trips (ADTs) per day per unit. This equates to 96 ADTs. Gibraltar is at full width and has been designed to accommodate local residential traffic. All parking will be provided on- site. With these circumstances there will not be a significant adverse effect on the environment. The project win not impact existing transportation systems; alter waterbome, rail or air traffic; increase traffic hazards; or interfere with emergency response plans. The proposal will neither add nor remove existing recreational opportunities. -7- ANALYSIS OF VIABLE ALTERNATIVES TO THE PROPOSED PROJECT SUCH AS: a) Phased development of the project, b) altemate site designs, c) altemate scale of development, d) altemate uses for the site, e) development at some future time rather than now, f) altemate sites for the proposed, and g) no project altemative. If the development was phased the ultimate impacts of the project would be delayed until all phases were complete. However, the ultimate impacts are not considered significant so there would not be an overriding environmental benefit by phasing. The project could be redesigned, the scale of development could be reduced or the uses could be different. Any combination of the above altematives may have an effect on the overall impacts. Because of the relatively small size of the site any changes made would not have a significant beneficial environmental effect. Development at a future date will postpone impacts until that time. Services are available now and there are no significant biological impacts that have been identified. No altemate sites have been reviewed. Onsite Parking It 1s our understanding that the design of the proposed onsite parking spaces consisting of 6 car spaces and one RV space provides adequate ingress and egress and it is acceptable by the Engineering and Planning Departments. 6. Sanitarv Sewer It 1s our understanding that the sanitary sewer for the development will be provided via a private sewer system to be maintained by the Homeowners' Association and will be located within the 30-foot wide driveway ingress and egress areas. In addition, each individual unit will be served with a lateral off of this private system. Maintenance of this system again shall be maintained by the Homeowners' Association. 7. Potable Water Service It is our understanding that the water service to the development is to come off of the existing water main in Gibraltar Street. Furthermore, 1t is our understanding that the City 1s requiring us to install indi- vidual meter connections for the 12 units in question. It Is the wish of the subdivider to eliminate the Installation of individual water meters and that one water meter be provided for the development. The assessment of said water service will be spread-out through the individ- ual units based on a prorata basis as to be detennined in the CC&R's. Onsite Firp Hydrant Requirement It is our understanding that based upon the design review of the tenta- tive map when revised and submitted that said tentative map will be pro- cessed through the local fire agency. Onsite Drainage Around Buildings It is our understanding that a minimum of a 1-percent slope shall be maintained around the dwelling units and provide positive drainage away from the units to the various collector points throughout the sub- division. 10. Drivewav Entrance It is our understanding that the design of the driveway entrance for the proposed development will be a standard driveway/curb cut detail as specified by the City Standards of the City of Carlsbad. 11. Owner Subdivider In reference to Item 13 of the above-mentioned City of Carlsbad letter dated January 18, 1991, it is hereby clarified that Gibraltar Greens, Ltd. 1s the legal owner of the property and that Gene-Jac, Inc. is a General Partner thereto, and under the By-Laws of said Corporation are authorized to process said tentative map. 12. QrAlsmv Design It is the intent of this office to design the interior access driveways as having an inverted crown. Said design will aUow for the conveyance of drainage waters safely away from the proposed dwelling units and shall convey them in an easterly direction to a drainage inlet designed to connect into the storm drain which traverses the property along the east property line. Said design will also accommodate for adequate pedestrian travel throughout the site in the event of inclement weather. The site is overburdened for this specific product. Suggestions to reduce the impact would include: reducing the number of units, reducing and/or reconfiguring the units, changing the product type. 2. Pedestrian circulation on-site must function without the use of the driveways and private streets. A suggestion might be to redesign the floor plan concept for entry access from the side opposite the garage. 3. The buildings should be designed and sited to create variety and interest along Gibraltar Street. Skewing the buildings as on units 4 and 5, and 10, 11 and 12 begins to accomplish this. 4. The three story buildings proposed have a massive presence. Stepping the building from the first to the second story as it is done from the second to the third may be a consideration. 5. There have been recent cut backs in the availability of water. You should contact the Carlsbad Municipal Water District regarding the proposal of a svdmming pool and fountain. 6. There is a concem with the design of the guest parking and RV storage area. It is encouraged that a more land efficient design be created. 7. Property line retaining walls must not adversely effect existing off-site trees. 8. Planter areas adjacent to buildings and property lines must be a minimum of 5 feet from the inside of sidewalk or curb. 9. The second story overhang over the garage must be set back a minimum of 5 feet from the edge of the driveway. 10. Parcel 1 and Parcel 2 should be consolidated for a single legal project site. 11. Staff is reviewing the appropriateness of providing the svidmming pool v^dthin the portion of the site designated as General Plan Open Space. CT 90-29 & CP 90-12 ENGINEERING: The following issues were communicated in the January 18, 1991 letter. They remain to be addressed. 1. Drainage inlets are not permitted in driveways. We suggest relocating the inlet or the driveway. 2. Show a method of collecting drainage prior to exiting down the driveway. Drainage is not allowed to cross the sidewalk. 3. Individual water meters must be provided and shown for each unit. 4. Individual sewer connections must be provided and shown for each unit. 5. The landscape plan must show a standard depressed curb type driveway approach. 6. The tentative map must reflect the proper owner: Gen-Jac. 7. A copy of the recorded Certificate of Compliance, referred to in item 14 of the title report, must be provided. 8. Stamped concrete is not permitted within the public right-of-way. (The Planning Department prefers the use of washed concrete or pavers on-site.) 9. The center swale drainage as proposed is discouraged. Provide a cross section of the private street serving the units and of the driveway. Also, the private street should be shown as general access and general utility access. 10. Prior to approval of the tentative map, provide letters of permission: A) From the Leucadia Water District giving permission to use the 10 foot pipeline easement. The site is overburdened. This is evident by the minimxim setbacks and contrived parking/recreational vehicle storage area. An altemate unit type and/or design should be considered which may aUow for a better site design. 2. Individual patio areas are not encouraged to be within the lot front yard setback. In addition, waU heights can be no higher than 42" within the front yard setback. 3. The entry gate should be removed. There is not adequate room for the proper design of a tum aroimd area in front of the gates. 4. The building design and siting should create variety and interest along Gibraltar Street. As proposed, the Gibraltar streetscape wiU be overwhelming because of the building's mass and linearity. 5. The guest parking area needs redesign for better circulation. ENGINEERING: 1. You propose relocating an existing drainage inlet. You may need to relocate the driveway instead. This is because drainage inlets are not permitted in drivewajrs and must be located at least 10 feet away from driveways. The site plan shows that entrance gates are proposed. Entrance gates require on-site mm aroimd which is not provided. 3. Intercept site drainage near the driveway and conduct the drainage to the street via sidewalk underdrain or stormdrain. 4. Show sidewalks connecting aU of the units with guest parking and the street. 5. Show the project ADT on the tentative map or site plan. 6. A five foot wide backup clearance is required for parking spaces adjacent to a curb as with the northernmost staU on the site plan. 7. Show sewer connections from the units and ultimately to the street. Leucadia Covmty Water District will, most likely, require sewering by way of a private main Une maintained by the homeowner's association. 8. Show water connections and individual water meters for each unit. You may need to provide a water line easement, see also below. 9. There is a possibiUty that an on-site fire hydrant wiU be required. The Fire Marshal will make that detennination. If required, you wiU need to show the water Unes and easements. 10. Show how drainage aroimd the structiu-e is to be handled. Provide a minimum of 1% slopes. 11. Use a depressed ciub type of driveway approach,not the curb retum type shown on the tentative map. 12. Item 4-b under General Notes on the tentative map is inconect. Water service to this project is provided by the Carlsbad Water District. 13. The tentative map shows the owner/subdivider to be Gibraltar Greens Ltd. The titie report shows Gene-Jac as the owner. Please clarify or rectify. 14. The City discoxurages the use of ribbon gutters. 15. Item 14 of the titie report refers to a certificate of compUance. Supply either a recorded copy of the document, 84-325375, or the City Engineer's adjustment plat number. 16. It has raised interesting conversation in our office regarding the Chapter of the Municipal Code that you cited. It has been your contention that the tentative parcel map could be processed for the twelve unit condominium project proposed. The section of the Municipal Code you are citing 20.12.010(b), reads In part "....the City Engineer shall not approved such map unless prior to a tentative map of the subdivision shown thereon shall have been filed and reported on by the Planning Commission and approved by the City Council." In our Municipal Code we differentiate In definition between a tentative map and a tentative parcel map. Therefore, our reading of this chapter clearly states that a tentative tract map must first be approved by the Planning Commission before a final parcel map can be approved by the City Engineer. I recognize the State Subdivision Map Act does allow parcels maps to be processed in lieu of tract maps and also that the Map Act does not differentiate between tentative maps and tentative parcel maps. However, it is clearly stated in our Municipal Ordinance that there Is a difference and this project will be processed as a tentative tract map. Once that tentative tract map has been approved by the Planning Commission the Developer will have option to final the map as either a parcel map or a tract map. That Is allowed under both the State Map Act and also the City's Municipal Code. The tentative map is currently under review by our staff and you should be receiving comments from the Planning Department within 30 days of the date of submittal of the map. II. PROJECT DESCRIPTION AND BACKGROUND The site is vacant and graded. The surrounding residentially zoned properties on the east and west are developed v^th two and three story condominivmis and the La Costa Golf Course is adjacent to the property on the north side. The proposed three story tovmhome units are approximately 1800 square feet with attached two car garages. Each unit has three bedrooms, three baths, ground floor patio and deck off of the master bedroom. A common recreation area with swimming pool and restroom facility is also proposed. The project site has Split Zoning and General Plan Designation. .71 acres is RD-M/RH and the remaining .172 acres is PC/OS. The density is based on a net area of .71 acres and calculates to 16.9 units per acre. The General Plan range is 15-23 units per acre and the growth management control point is 19 units per acre. The pool area is located in the PC^OS Designations which is permitted as an improved recreational use. Zoning and General Plan The property is zoned Residential Density-Multiple (RD-M) and Planned Community (PC). The RD-M zone was created to provide a means of development utilizing the higher densities delineated in the General Plan. The Planned Community zone was created to establish areas where large scale development could be controlled through master plans. The proposed project is consistent with the RD-M and PC zones in that it is a multiple family project being designed under the Planned Development Ordinance and complies with those development standards. The property's General Plan designations are Residential High (RH) and Open Space (OS). The intent of the RH designation is to allow for the development of high density housing and the Open Space designation is for natural and improved open space for both passive and active recreational opportunities. Both of these stated goals are accomplished in the proposal.
