The Engineering Department is recommending that the project be approved subject to the following conditions: 37. Unless a standards variance has been issued, no variance from City Standards is authorized by virtue of approval of this 38. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. 39. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Bell Telephone, and Cable TV authorities. 42. The applicant shall provide an acceptable means for maintaining the private easements within the subdivision and all the private: streets, sidewalks, street lights, storm drain facilities and sewer facilities located therein and to distribute the costs of such maintenance in an equitable manner among the owners of the properties within the subdivision. Adequate provision for such maintenance shall be included with the CC&R's subject to the approval of the City Engineer prior to final map approval. 46. Approval of this tentative tract map shall expire twenty-four (24) months from the date of^lMM!l|4hHWiBlHbapproval unless a final map is recorded. An extension may be requested by the applicant. Said extension shall be approved or denied at the discretion of the Rk«HH§£HpMlMi0^. In approving an extension, the PJ^piap QflMMMtftonay impose new conditions and may revise existing conditions pursuant to Section 20.12.110(a)(2) Carlsbad Municipal Code. 47. The applicant shall defend, indemnify and hold harmless the City and its agents, officers, and employees from any claim, action or proceeding against the City or its agents, officers, or employees to attack, set aside, void or null an approval of the City, the Planning Commission or City Engineer which has been brought against the City within the time period provided for by Section 66499.37 of the Subdivision Map Act. Prior to approval of the final map, the owner shall enter into an agreement with the City to pay any drainage area fees established as a result of the Master Drainage Plan Update. 61. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to and receive approval from the City Engineer for the proposed haul route. The applicant shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 64. Rain gutters must be provided to convey roof drainage to an approved drainage course or street to the satisfaction of the City Engineer. 65. Additional drainage easements may be required. Drainage structures shall be provided or installed prior to the issuance of grading or building permit as may be required by the City Engineer. 75. The applicant shall comply with the requirements of the National Pollutant Discharge Elimination System (NPDES) permit. The applicant shall provide best management practices to reduce surface pollutants to an acceptable level prior to discharge to sensitive areas. Plans for such improvements shall be approved by the City Engineer prior to approval of the^firt^gijij^issuance of grading or building permit, whichever occurs first. 76. Plans, specifications, and supporting documents for all public improvements shall be prepared to the satisfaction of the City Engineer. Prior to $fups&uefa$4te&miLta&p in accordance with City Standards, the applicant shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the • and the following improvements: A. Standard curb, gutter, sidewalk and sufficient paving to join the existing to the satisfaction of the £ity Engineer. The City Engineer may require the extending of improvements off-site and beyond the street center-line in order to match grades and make the drainage work. B. All undergrounding and relocation of public utilities needed to complete the improvements. Elaine Blackburn CT 92-07; CP 91-04, La Vercia Condominiums July 29, 1992 Page: 3 A note to this effect shall be placed on an additional map sheet on the final map per the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements listed above shall be constructed within 18 months of approval of the secured improvement agreement or such other time as provided in said agreement. Note;jme above condition may be met by the completion of the City's Capital Improvement Project No. 3203 per Drawing No. 321-6 The following Engineering informational report is offered for use in the Staff Report to the Planning Commission: Traffic and Public Improvements Projected ADT is 40. The existing circulation system is adequate to handle the projected traffic. The proposed onsite 30 foot wide driveway/ private street and access to garages and guest parking spaces is adequate. The City has a Capital Improvement Project out to bid that will construct all the needed public improvements including undergrounding of utilities. The developer has granted right- of-way for these improvements with the understanding that he has no financial obligation if the improvements are constructed by the City. This project is being conditioned to provide these improvements in the event that the CIP is not completed. The existing system has sufficient capacity to handle the increase and no upgrades or improvements will be required. "' ? Grading and Erosion Control Minimal grading is proposed on the project. 250 cubic yards balanced on-site is projected. Standard erosion procedures will be adequate during grading operations. No unusual soil or geological conditions exist at the site and no special geotechnical mitigations are required. >f Elaine Blackburn CT 92-07; CP 91-04, La Vercia Condominiums July 29, 1992 Page: 4 Drainage The site at the present time drains to the easterly adjacent property with most of the run-off being absorbed on site. Standard drainage to the street is proposed to be accomplished by some grading and the use of area drains. Some change in the natural slope away from the street is possible because the grade of the street at this location is planned to be lowered approximately 2 feet. Raising the grade significantly at the rear of the site is not practical because^the already high retaining wall on the easterly parcel. The street grade lowering is part of the City Capital Improvement Project No. 3203. Water An estimated 8800 GPD additional water consumption is projected for the project. The existing system is adequate to supply this projected consumption. Land Title There are no easement or site boundary conflicts. JIM DAVIS Associate Engineer
