HomeMy WebLinkAboutCT 93-09; Ocean Bluff; Tentative Map (CT) (31)City of Carlsbad Planning Department October 3, 1994 Jack Henthorn & Associates 5431 Avenida Encinas Carlsbad, CA 92008 SUBJECT: OCEANBLUFF (CT 93-09) SECONDARY ACCESS PROPOSAL Dear Jack: At your request, staff has reconsidered your proposal for an emergency secondary access to accommodate the Oceanbluff project. As a result of further review by the Community Development Director, City Engineer, and Assistant City Engineer, consensus was reached that any secondary access for this project should be open to the public and not subject to restrictions, and that the following modified improvement condition shall be imposed: Prior to final map approval, the subdivider shall construct or enter into a secured agreement for the construction of two publicly dedicated access roads to City Standards from existing publicly improved streets to the project site as follows: A. Half street plus 12 feet of Blackrail Road from Alga Road to the project site to include curb and gutter, sidewalk and street lights along one side with a minimum 42 foot wide publicly dedicated easement. B. Two 18 foot paved lanes separated by a raised unlandscaped median along Poinsettia Lane from Alga Road to Blackrail Road within a minimum 60 foot wide publicly dedicated easement. A minimum 28 foot wide paved street within a thirty foot wide publicly dedicated easement shall be constructed to connect the southwestern portion of project site to Poinsettia Lane approximately 1,200 feet west of the Blackrail Road intersection. The City Engineer and Planning Director may administratively approve alternate access road alignments and/or cross sections provided that any such alternative must comply with all City standards, codes, and policies. You will note that there are two important differences from the previously discussed offsite improvements. The first difference is the requirement to construct offsite Poinsettia Lane in lieu of the proposed secondary access. Without the secured right-of-way for a public road dedication, 2O75 Las Palmas Drive • Carlsbad, California 92OO9-1576 - (619) 438-1161 is, Jack Henthorn & Associates October 3, 1994 Page 2 the City would need to condemn such right-of-way or drop the secondary access requirement. Staffs position is that it is preferable to condemn property for an arterial road that provides benefit to the general public rather than a temporary local street that serves the needs of one developer. Should the developer be able to acquire the necessary right-of-way from the adjacent land owners for the temporary access road, then the City has the ability to accept such access in lieu of the Poinsettia connection. The second difference is the requirement to provide half plus 12 feet of road including curb, gutter, and sidewalk within 42 feet of the right-of-way along Blackrail Road. The previous condition requiring 28 foot of pavement within a 30 foot public ROW did not provide for pedestrian access to the project. The sidewalk is essential to ensure safe pedestrian access to nearby schools and commercial centers. The Zone 20 Environmental Impact Report requires that prior to approval of a tentative map for any phase of development proposed within Environmental Review Area I, a biological field survey update shall be conducted, and a letter report shall be submitted to the Planning Department for review and approval. In accordance with the above condition, Poinsettia Lane between Blackrail and Alga Road is part of the proposed tentative map; therefore, please submit this report for both Poinsettia Lane from Alga Road to Blackrail and for the proposed secondary access road alternative along with plans for the design and alignment of these road segments. Relying on the baseline data provided in the EIR, this letter report shall include, at a minimum, a map of the specific biological resources occurring on the subject property, a description of sensitive species and habitats, an evaluation of potential impacts to these resources based on the proposed development plan, and recommended mitigation measures, if necessary.
