LA COSTA BOULEVARD
Thank you for coming to our offices to meet with me and clarify the concerns expressed in your
January 17, 1994 letter to the Mayor and Council.
As we discussed, your concerns are about securing the continued use of La Costa Boulevard
to El Camino Real. As I had stated, the City will be working with Aviara and any other developers
in the area to make sure that, during development of the projects, access will be maintained in
some fashion.
You had noted during our discussion, that the City has indicated it has no legal jurisdiction over
La Costa Boulevard and you are worried that its access will be blocked by actions not related
to development.
The City has researched the status of La Costa Boulevard with the County Public Works
Department, who originally surveyed and plotted it. Their letter to us states that the dirt road,
called La Costa Boulevard, was shown on their County inventory maps as an ungated dirt road,
and does not indicate any legal right-of-way. Therefore, no legal right-of-way was passed on to
the City with the annexation of that property. Review of title reports covering land over which La
Costa Boulevard passes also shows no mention of public road rights-of-way.
The City has made efforts with developers in the area to make sure that access from El Camino
Real via La Costa Boulevard will be provided in some fashion until the ultimate improvements in
the area are constructed. However, the City does not have the legal authority to order private
property owner? to rn?.'nt?!n La Cost5* Boulevard.
I understand that you and some other property owners in the area may have differing views from
the City's on this matter. I can only reiterate that the City will do what it can, through the
development process, to provide adequate access for the property owners in that area.
