HomeMy WebLinkAboutCT 93-09; Ocean Bluff; Tentative Map (CT) (46)City of Carlsbad Planning Department February 20, 1996 Mr. George Bolton 6519 El Camino Real Carlsbad CA 92009 SUBJECT: BLACK RAIL COURT - POINSETTIA LANE FEE DISTRICT Dear Mr. Bolton: Thank you for your follow-up letter, dated February 7, 1996, requesting additional information regarding future Black Rail Court. I spoke with Anne Hysong and David Mauser about the proposed Poinsettia Lane fee district and its effect on the future improvement of Black Rail Court and did some looking into the Aviara conditional use permit CUP 90-07. The Poinsettia Lane fee district is purely a financing mechanism for the future arterial roadway. The district, in and of itself, will not construct the road. Therefore, the possibility for the developers of the Cobblestone or Ocean Bluff projects to construct Black Rail Court from Poinsettia Lane southward to Aviara is a matter of timing. If Poinsettia Lane has been financed and constructed to form a complete circulation link to public roads in either the east or west prior to the construction of Cobblestone or Ocean Bluff, then the developers of those projects may be able to use Poinsettia Lane to satisfy their circulation link requirements. If Poinsettia Lane is not constructed to form a circulation link at the time of residential construction, then another secondary access must be provided, such as Black Rail Court southward to Alga Road. As you correctly stated, the conditional use permit (CUP) for the Aviara Information Center was due to expire in November, 1995. As allowed by the CUP and at the request of the applicant, the conditional use permit was extended for another five years by the Planning Commission at a public hearing on November 1,1995. This public hearing was duly noticed in the newspaper and a notice was mailed to all property owners within 600 feet of the site. The new expiration date of the Aviara CUP is November 5, 2000. The Aviara Phase III tentative map revision to modify their secondary access requirements should be considered by the Planning Commission in April, 1996.
