McKinney, Evon Gardens SUBJECT: Statement pertaining to Public Hearing on Ocean Bluff I have been before you many times trying to explain how the actions taken by this Commission would totally ruin my property, business, and my financial position. You have continually said, when the developer next to you develops, you will be condemned and rightfully compensated for all your losses. But the time that will happen is always a question. Let me list just a small number of damaging consequences I have already come to realize due to your actions. 1. Plants require different lengths of time to full maturity. I cannot determine what crop to plant, a one year, a two year, or a five year, as I have no idea when Ocean Bluff will start moving dirt. I may spend time and money to put in a crop only to lose it prior to full harvest, for one of numerous reasons, all associated with this development. 2. I have already lost a very large corporate account because of a verbal agreement. I cannot offer a written contract as I have no idea if I'll have my greenhouses and crops or if they will be condemmed or lost to other construction causes. Ilith only a verbal agreement it was cancelled in one phone call. I have no recourse short of a full lawsuit. 3. I have been turned down on numerous other corporate accounts as they refuse a verbal agreement. They want a contract so they can plan their budgets. If I sign a contract and can't fulfill it, I stand in a position of a lawsuit against me. 4. I lost thousands of dollars worth of baby carnation plants because of losing that corporate account, necessiting cutting back on personnel and therefore not enough personnel to replant. 5. I've been told, "Oh, we're by-passing your property so it won't hurt you any." That is not so! Many insects live in the soil as part of their life cycle. Thrip is a good example. As soon as the soil is disturbed in mass quanities as in construction, the insects are carried on the dust and I have a massive insect problem. If I'm lucky and don't get the insects, I have a dust problem. Mho ever heard of gray carnations and roses? The dust also smothers the'plants leaves so they cannot get oxygen, thus killing the plant, lie also have the problem of dust settling on the surface of the plastic of the green- houses, cutting down the solar rays necessary for plant growth, another killing phenomena. 6. I have investigated the possibility of selling the property. By law I must disclose the Specific Plan and the Alignment of the road through my property. No one is interested because it is five acres but less than three acres when the road is considered. They will NOT pay for property that is taken by the road, then have to construct the road. And, I have been told, also, there's not enough property left after the roads, Pointsettia and Black Rail Court, are constructed to allow for housing development with set-backs etc. The only possibility for development would be commercial, which we are NOT Zoned for, and then it's very questionable. In other words, your decisions have even ruined my property for development, or sale if I so desired. TO REITERATE: 1. At the present time I have difficulty farming because of uncertainty of time frame. 2. I cannot sell my products on contracts so cannot plan an operating budget. 3. Income has been impaired because of lack of contract resulting in lack of labor. 4. Development of Ocean Bluff means the possibility of insects and or dust problems resulting in killing my plants. 5. I can't sell the property due to the alignment of roads, but no construction, leaving my property useless for development. I'M STUCK IIITH A PIECE OF PROPERTY I CAN"T DO ANYTHING UlTH BECAUSE OF PREVICOU DECISIONS MADE BY THIS COMMISSION AND THE COUNCIL. It is time to conclude these decisions with the order for Ocean Bluff to complete his share of Pointsettia Lane by "PUNCHING IT THROUGH" and compensating us for our land, business, and damages. It will finalize your problem by completing Pointsettia Lane from west to east, and finalize my problem of having very valuable property with which I can do nothing. UNLESS OCEAN BLUFF IS REQUIRED TO PUT POINTSETTIA LANE CLEAR THROUGH TO BLACKRAIL COURT, THE ROAD MILL NEVER BE COMPLETED ALL THE MAY FROM llEST TO EAST.
