HomeMy WebLinkAboutCT 93-09; Ocean Bluff; Tentative Map (CT) (74)^OCEAN BLUFF PARTNERSHIP^) 4180 La Jolla Village Drive, Suite 300 La Jolla, CA 92037 (619)452-1511 June 21, 1996 Mr. Michael Holzmiller, Planning Director City of Carlsbad 2075 Las Palmas Dr. Carlsbad, California 92009 Subject: Coastal Development Permit Application, Ocean Bluff Dear Michael, The Ocean Bluff project's Coastal Development Permit will be considered during the July, 1996, (9 thru 12) hearing in Huntington Beach As you are aware, there are two main issues that have been raised by the Commission staff that are beyond the purview of the owner to resolve. The first issue involves the method of calculating density in the requested Local Coastal Program Amendment and a proposed condition that would require the City to apply the "Q" overlay zone in a manner not consistent with its intent. The City has provided the Coastal staff with information on the methods used to calculate density as well as the intent of the "Q" overlay zone. In a telephone conversation with Coastal staff member Bill Ponder, it was revealed that Coastal staff has reviewed the information submitted by the City and determined that the staff recommendation will not be revised. The second issue relates to the Coastal Development Permit application. Coastal staff has taken the position that the City's approved alignment for Poinsettia Lane can not be supported because they feel that there was inadequate environmental analysis of alternative alignments The Coastal staff has been provided with environmental documentation, letters from Fish and Game and U.S. Fish and Wildlife and other information relating to the constraints forcing the road into the currently proposed alignment. In addition, evidence of the clients purchase of required mitigation bank credits has been provided. The City engineering staff has provided additional information to Coastal staff relating to the technical and health and safety components of the existing alignment. In my conversation with Mr. Ponder it was indicated that the staff will be recommending denial of the project based on the Poinsettia Lane alignment issue. As indicated earlier, the applicant is being placed in a dilemma where long standing City of Carlsbad policies and decisions are being challenged by the Coastal staff. Therefore, it is requested that City staff be in attendance at the July meeting of the California Coastal Commission to address the density and Poinsettia Lane alignment issues.
