HomeMy WebLinkAboutCT 93-10; Seapointe Resort; Tentative Map (CT) (24)CONTINENTAL COMMERCIAL CORPORATI&WT 5050 AVENIDA ENCINAS, SUITE 200 CARLSBAD, CA 92008 PHONE: (619)431-8500 FAX: (619)431-4580 April 5, 1995 Jim Elliott Financial Managing Director City of Carlsbad 1200 Carlsbad Village Drive Carlsbad, CA 92009 RE: LEASE OF CITY-OWNED PROPERTY BETWEEN ANACAPA ROAD AND CARLSBAD BOULEVARD Dear Jim: This letter is a follow-up to a meeting you had with David Hauser, Mike Howes and myself several weeks ago to discuss the lease of the City-owned property between Anacapa Road and Carlsbad Boulevard (see the attached map). At that time I mentioned that Continental Commercial Corporation would like to lease this property to use in conjunction with the approved Seapointe Carlsbad timeshare project. You requested that I prepare a letter explaining the proposed uses and the tune frame for each use. Continental Commercial Corporation would like to lease the above mentioned property in four phases, with a different use hi each of the phases. During all phases Continental Commercial Corporation would have sufficient liability insurance to protect the City from any legal claims. PHASE I The first phase would consist of locating a construction trailer, construction materials and the parking of grading equipment during the initial development of the site. At our meeting David Hauser mentioned that in the past the City has allowed construction trailers in City Right-of- Way, and all that would be required is a Right-of-Way Permit. The grading of the Seapointe project is scheduled to start on May 15, 1995. We would like to be able to start parking the equipment on the City-owned property on the west side of Anacapa Road at that time. A temporary construction trailer and construction materials would be located on the site shortly thereafter. Continental Commercial Corporation would be willing to post a sufficient bond to ensure the removal of the trailer and materials. Exhibit B shows the approximate location of the construction trailer, equipment parking area and materials storage area. PHASE 2 The next phase would consist of cleaning up the existing site by removing the asphalt, concrete and other debris that has been dumped on this site over the years. This would result in Letter to Jim Elliott * ^"" Page 2 Re: Lease of City-Owned Property April 5, 1995 eliminating the mound of ice plant that has grown up over the debris during the past few decades. After the site was cleaned and planted with grass, a temporary sales trailer would be placed there. Again, a sufficient bond would be provided to ensure that the sales trailer would be removed and the site restored to the satisfaction of the City. We would like to locate the sales trailer on the site in November of this year. The sales trailer would be on the site for approximately one year unless the project was sold out in a shorter time period. Exhibit B also shows the approximate location of the sales trailer. PHASES Phase 3 would occur after the sales pavilion was removed. This phase would consist of Continental Commercial Corporation leasing, maintaining and accepting liability for the land to use it as a front yard for the Seapointe Carlsbad project. This would enable guests staying at Seapointe Carlsbad to use this area for passive recreational uses, such as throwing a frisbee. Benches and picnic tables might be placed on the site, but no permanent structures would be constructed. PHASE 4 Phase 4 would consist of a long-term lease or purchase of the property for the construction of additional timeshare units. The implementation of this phase would depend on a number of factors, such as the success of the Seapointe project and the cost of a long-term lease or purchase. We recognize that prior to entering into a long-term lease or sale, a careful appraisal of the property by the City to determine its value, as well as the approval of all discretionary permits to allow for the additional units, would be necessary. This would be the appropriate time to remove the abandoned off ramp and bridge to increase the buildable portion of the property. The first three phases could be implemented without the need for any discretionary permits or an appraisal of the value of the property. None of the uses proposed in Phases 1, 2, or 3 would put any constraints on the City's ability to appraise, lease or sell the land. Nor would they adversely impact the value of the property. Continental Commercial Corporation would be willing to enter into a lease that gave the City the ability to cancel the lease at any time during Phases 1, 2 & 3 upon a 30-day written notice to the applicant. Allowing Continental Commercial Corporation to lease this property would benefit the City in several ways: 1. It would generate revenue from a City-owned property that currently does not generate any revenue for the City. 2. The removal of the debris and planting of the site with grass would improve the appearance of the site, which would have a positive impact on its value. 3. While being leased by Continental Commercial Corporation, the City would not have to be concerned with the liability or maintenance of this property. The lease of this property to Continental Commercial Corporation would contribute to the success of a timeshare developed and operated by one of the largest companies based in Carlsbad. I would like to meet with you as soon as possible to discuss the lease of this property. As you can see, time is of the essence since the construction of this project is due to start in about 6 weeks. Mike Howes of Hofrnan Planning Associates will be calling this week to set up a meeting with you and David Hauser to discuss this issue.
