RE: CT 94-01, PROPOSED DESILTATION BASIN FOR POINSETTIA SHORES;
BATIQUITOS LAGOON ENHANCEMENT PROJECT
Dear Mr. O'Day:
Thank you for your letter of February 14, 1994 regarding the siting of the proposed
desilting basin (s) for the Poinsettia Shores project and its relationship with the upcoming
construction of the "W-1" least tern nesting island for the Batiquitos Lagoon Enhancement
Project.
Community Development Department staff have reviewed the information and exhibits you
provided as well as researched the existing recorded mapping and various other
documents for the Master Plan, prior subdivision maps, previous property dedications,
and approved Resource Agency permits and conditions. Our review has indicated an
error in the W-1 boundary as currently displayed on the construction drawings for our
Batiquitos project.
Carlsbad CT 82-18, map number 11290, required the dedication of an open space
easement to the City of Carlsbad of "Lot 3" which included the area the City intends to
utilize for the W-1 site. This map was recorded on July 16, 1985 as document number
85-253280. Further, an irrevocable offer to dedicate the subject property as wetlands to
the State of California was recorded as document number 86-399391 on September 11,
1986. This dedication was subsequently accepted by the State of California on March
25,1987 as document number 87-155828. Our review of this information, as well as that
which you provided us accompanying your February 14, 1994 letter, indicates our
proposed W-1 boundary does encroach approximately 6,768 square feet onto adjacent
"Lot 2" extending northwest from the Lot 3 parcel. The attached exhibit depicts this
encroachment. We have, therefore, directed our design engineers at Moffatt and Nichol
to modify the boundary for W-1 to correspond with the attached exhibit.

Pleased be advised that any proposed desilting basin(s) and spillway structure(s),
including placement of rip rap material, maintenance access, etc., for the Poinsettia
Shores project are to be sited outside the boundaries of the W-1 least tern nesting site
on Lot 3 as shown in the attached exhibit. Please direct any questions regarding this
issue to Mr. Eric Munoz at 438-1161, extension 4441.
