Include any details necessary to adequately explain the scope and/or operation of the proposed project. Description/Explanation. The proposed project is comprised of a six (6) lot residential subdivision with a minimum lot size of 4,931 sq. ft., utilizing the standard front and rear yard setbacks with a modification of the side yard setbacks to a 3'/7'. The single family homes will be two story in height, wood construction, with a stucco exterior and tile roofs. There are two unit types proposed, as follows: Plan 1 - 1,800 sq. ft. Plan 2 - 2,150 sq. ft. It is felt by the applicant that single family units would be a more appropriate use for the property than duplexes. The single family units would be more compatible with the existing single family residences in the neighborhood. The project has an existing ten foot sewer easement which was dedicated in the 1960's. The project will be dedicating an additional 4.5 feet to the Carlsbad Municipal Water District to help provide better access to the existing sewer line. This also allows the Water District to only require an additional 5.5 feet from the adjoining property. INC /•-*•- STATEMENT OF AGREEMENT TENTATIVE SUBDIVISION MAP CITY OF CARLSBAD The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time restriction on Planning Commission processing of Tentative Maps and a thirty (30) day time limit for City Council action. These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applications for other approvals which are prerequisites to the map; i.e.. Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits and the thirty (30) day time limits are often exceeded. WHEREAS, Licensee desires to acquire the right to enter upon and perform work, as specified in paragraph 1 below and in Exhibit "A" attached hereto and by this reference made a part hereof, on a portion of Licensor's property, said portion being hereinafter refereed to as "Premises", and being specified in paragraph 2 below, and outlined in yellow in Exhibit "B" attached hereto and by this reference made a part hereof. NOW, THEREFORE, intending to be legally bound, the parties agree as follows: 1. Licensor hereby grants to Licensee a rent-free, non-exclusive, irrevocable License to enter upon and use the Premises between the hours of 7:00 am and 5:00 p.m., Monday through Friday, subject to the terms and conditions herein, for the sole purpose of removing the existing fence and constructing a footing, retaining wall and fence more particularly described in Exhibit "A" attached for a period of 45 days commencing upon the substantial completion of grading operations (to "blue top") on licensees adjacent property. It is acknowledged that no lease of the Premises is intended, and that the relationship of the parties with respect to Licensee's occupancy of the Premises is that of Licensor and Licensee. If Licensor permits Licensee to occupy the Premises before the commencement time, such occupancy shall be subject to all of the other provisions of this Agreement. 2. It is understood that time is of the essence and Licensee will do everything possible to complete this work in a timely manner. In any case this license agreement shall expire not later than May 31, 1996. 6. Licensee shall not unreasonably interfere with the normal operations and activities of Licensor, its tenants and guests, and Licensee shall use such procedures in its activities on the Premises as shall result in the least practical damage to the Premises and inconvenience to Licensor, its tenants and guests. 7. Licensee shall immediately cease use of the Premises at the expiration of this License. Licensee shall, prior to the expiration of this License, repair and restore any of the Licensor's property that may be damaged in connection with the exercise of the rights under this License to at least the original conditions existing prior to Licensee's entry. 8. If Licensee shall fail to cure any breach of its obligations under this Agreement within ten (10) working days of receipt of written notice from Licensor specifying the nature of such cure, Licensor shall have the right to immediately terminate this License by serving Licensee with written notice of termination. 9. This License supersedes any and all prior oral understandings and agreements between the parties with respect to the Premises. No alteration or variation of this license shall be valid unless made in writing and signed by Licensor and Licensee. 10. Licensee, as a material part of the consideration to Licensor, hereby assumes all risk of damage to property or injury to person, in, upon or about the Premises from any cause other that the Licensor's negligence, and Licensee hereby waives all claims in respect thereof against Licensor. 12. Licensee shall at its own cost and expense procure and maintain or cause to be procured and maintained during the entire term of this License, comprehensive public liability insurance covering the Premises and surrounding areas, with limits of not less that $1,000,000 for injury to any one person, $1,000,000 for injury to two or more persons arising out of the same incident, and $1,000,000 for property damage, Such insurance shall (1) by procured from an insurer authorized to do business in California and either approved by Licensor or rated "triple A" or better in Best's Insurance Report; (2) provide primary and not excess coverage; (3) name Licensor as an additional insured with a loss payable clause satisfactory to Licensor; (4) waive subrogation rights, if any, which the insurer may have against Licensor by reason of any claim, liability, loss, or expense covered by insurance; and (5) require that Licensor by given at least thirty (30) days written notice before any such insurance can be canceled or changed with respect to parties, coverage or limits of liability. Licensee shall deliver to Licensor evidence of the existence of such insurance, if Licensor shall so request. 13. If Licensee shall elect to self-insure as to any or all of the risks against which it is required to insure, it shall demonstrate, if requested by Licensor to the reasonable satisfaction of Licensor, its capacity to meet its outstanding obligation, including its self-insurance obligations. 14. Licensee shall not cause or permit any liens to be placed against the Premises or against Licensor's other property as a result of Licensee's exercise of right under this License. In the event of the filing of any such liens, Licensee shall promptly (but in no event more that 30 days) cause such liens to be removed or bonded off the Premises. 15. In the event of any action or proceeding brought by either party against the other under this Agreement the prevailing party shall be entitled to recover all costs and expenses including the fees of its attorneys in such action or proceeding in such amount as the court may adjudge reasonable. 16. In the event of termination, Licensor shall be entitled to immediate possession of the Premises, without the necessity of written notice or demand. 17. This Agreement shall be construed under California law. 18. Time is of the essence of this License.
