Approval. The Commission hereby grants a permit for the proposed development on the grounds that the development will be in conformity with the adopted Local Coastal Program, and will not have any significant adverse impacts on the environment within the meaning of the California Environmental Quality Act. II. Standard Conditions. See attached page. IV. Findings and Declarations. The Commission finds and declares as follows: o 6-95-26 Page 2 1. Detailed Project Description. The applicant proposes to subdivide and develop six single family lots (minimum 4,131 sq.ft. to 4,952 sq.ft.) and one open space lot on a relatively level, rectangular .72 acre parcel located in anpfill area north of Olive Avenue, south of Date Street, east of Garfield west of the AT&SF railroad right-of-way in Carlsbad. The homes be w^, stories, have attached two car garages, and would range from 5 ].828 sq. ft\to 2,155 sq.ft. The applicant also proposes half-street A? ,;.imp>aye)nents ,p\lus 12 feet of additional paving for those portions of Date and '£ Oliye,$^enues along the project frontage for curb, gutter, sidewalk and street *3> lighting as well as street improvements to the eastern terminus of Olive V,-: Avenue to complete the existing cul-de-sac. Water and sewer will be provided V^ by existing lines in both Olive and Date Avenues. As conditioned by the City, v >J:he sewer main will be relocated to the east side of the site to maintain vjSecessary building setbacks from the sewer main line. Grading quantities for tfte:project include 20 cubic yards of cut and 1,500 cubic yards of fill. Because the site is relatively flat, the minor amount of grading proposed is to provide for adequate drainage for the project. The site has been disturbed by discing activities and contains no sensitive coastal resources currently or prior to vegetation removal. Surrounding development consists primarily of single and multiple-family development. The site is planned for residential uses (Residential Medium High (RMH), 8-15 du/ac and zoned two-family Residential Zone (R-2) in the City of Carlsbad's certified Local Coastal Program (LCP). 2. Sensitive Habitat Areas. The policies of the certified Mello II segment of the City's LCP contain language which prohibits grading on steep slopes (25% grade or greater) if certain species of native habitat exist on the slopes (coastal sage and/or chaparral communities). The site slopes gently but contains neither slopes in excess of 25% grade nor vegetated areas that contain the type of native vegetation which would subject them to the preservation policies of the certified LCP. Therefore, there is no need to define future developable area through delineation of an open space area within this permit. Thus, the project is consistent with the certified LCP's steep slope policies. 3. Local Coastal Planning. Sections 30170(f) and 30171 of the Coastal Act were special legislative amendments which required the Commission to adopt and implement a Local Coastal Program for portions of the City of Carlsbad and County islands prior to specific statutory dates. In reviewing development proposals, the Commission must essentially act like local government and assess whether a project is consistent with the implementing zone and other policies of the certified LCP. In this case, such a finding can be made. The proposed six lot subdivision is consistent with the Residential Medium High designation for the site found in the certified Mello II segment of the Carlsbad LCP. Proposed street and sewer improvements are consistent with the public works and public services capacities policies of the LCP. The project o 6-95-26 Page 3 is also consistent with the local zoning and has received all required discretionary approvals from the City of Carlsbad. The proposed project is consistent with the certified Carlsbad LCP Mello II segment and approval should not prejudice the ability of the City of Carlsbad to implement its Local Coastal Program. 4. California Environmental Quality Act Section 13096 of the Commission's administrative regulations requires Commission approval of the coastal development permit to be supported by a finding showing the permit to be consistent with any applicable requirements of the California Environmental Quality Act (CEQA). Section 21080.5(d)(2)(i) of CEQA prohibits a proposed development from being approved if there are feasible alternatives or feasible mitigation measures available which would substantially lessen any significant adverse impact which the activity may have on the environment. Notwithstanding the "no project" alternative, there are no feasible alternatives or feasible mitigation measures available which would substantially lessen any significant adverse impact which the activity may have on the environment. The Commission finds the project complies with the slope preservation provisions of the Mello II LCP. Therefore, the Commission finds that the proposed project is the least environmentally damaging feasible alternative and can be found consistent with the requirements of the certified LCP to conform to CEQA. 5026R AGUA HEDIONDA LAGOON EXHIBIT NO.
