HomeMy WebLinkAboutCT 94-02; Pacific Pointe; Tentative Map (CT) (39)August 3, 1994 TO: PLANNING COMMISSION FROM: Planning Department SUBJECT: PACIFIC POINTE - CT 94-02/PUD 94-01 PLANNED DEVELOPMENT ORDINANCE In the Pacific Pointe staff report, the applicant's request to have the Planning Commission waive the recreation area requirements of the Planned Development (PD) Ordinance is discussed. The staff report notes that Section 21.45.072(b) of the Carlsbad Municipal Code permits the Planning Commission the discretion to waive PD requirements. Upon further review of Section 21.42.072(b) of the PD Ordinance, staff has determined that this interpretation was not correct. This section of the PD Ordinance only permits the Planning Commission the discretion to modify standards of the underlying zone (in this case the R-2 Zone) and not the standards of the PD Ordinance. Therefore, staff recommends that the Planning Commission approve the project consistent with the PD Ordinance to include the 1,200 sq. ft. tot lot on Lot 7 as depicted on Exhibit "A" . ENGINEERING CUL-DE-SAC STANDARD As discussed in the staff report, the Engineering standard allows for cul-de-sac lengths to be a maximum of 1,200 feet. From Olive Avenue, the site is located approximately 1,550 feet from Sequoia Avenue, which is the nearest available second access point to the site. As stated in the staff report, a second access point was determined to not be critical. The City Engineer may waive this standard as it is not Ordinance, which has been recommended in this case. To clarify this issue in the Tentative Map Resolution, a finding must be added. Please amend Resolution No. 3699 as follows: RESO. NO. 3699 Findings 9. The waiver of the Engineering cul-de-sac standard will not conflict with existing or future traffic and parking demands or pedestrian or bicycle use, will not cause significant hazards, will not impede emergency response times, will not be detrimental or injurious to the property or improvements in the vicinity, nor adversely affect the General Plan.
