WHEREAS, Homes For Industry - Carlsbad, LLC., hereinafter called the "Grantor" is the owner
in fee of that certain parcel of land situated in the County of San Diego, State of California, more
particularly described as follows:
Lots 1 and 4 , of City of Carlsbad Tract no. CT 95-04, in the City of
Carlsbad, County of San Diego, State of California, according to map
there no. , filled in the office of the county recorder of San
Diego County, .
hereinafter called "Grantor's property;"
In consideration of and as a condition of approval by the City of Carlsbad, California, of a
tentative tract map, non-residential Planned Unity Development and Planned Industrial Permit, receipt of
which is hereby acknowledged, Grantor does hereby grant to the County of San Diego, hereinafter
referred to as "Grantee", its successors and assigns, a perpetual non-exclusive easement in gross for
aircraft operation, aircraft sound and noise, aircraft avigation and flight, hazard and air space
("Avigation Easement"), over and through all air space above Grantor's property, as particularly
described herein before, from the surface to an indefinite height above said surface.
The Grantor herein, its heirs, administrators, executors, successors, and assigns, grants the
Avigation Easement to Grantee, for the use and benefit of the use and benefit to the public, including
the United States Armed Forces, for the passage of all aircraft ("aircraft" being defined for the purposes
of this instrument as any contrivance now known or hereafter invented, used or designed for navigation
of or flight in the air) by whomsoever owned and operated, together with the right to cause in all air
space above the Grantor's property such noise, vibrations, fumes, dust, fuel particles and all other effects
that may be caused by the operation at or on the McClellan-Palomar Airport; and Grantor herein, its
heirs, administrators, executors, successors and assigns, does hereby fully waive, remise and release any

right of cause of action which it may now have or which it may have in the future against Grantee, its
successors and assigns, due to such noise, vibrations, fumes, dust, fuel praticles and all other effects that
may be caused or may have been caused by the operating of aircraft landing at, or taking off from, or
operation at or on said McClellan-Palomar Airport at, Carlsbad or other airport or air facility which is or
may be located at or near the site of McClellan-Palomar Airport.
TO HAVE AND TO HOLD said easement and right-of-way and all rights appertaining thereto
unto the Grantee, its successors and assigns, it being understood and agreed that these covenants and
agreements shall run with the land.
This easement is granted for any use by any aircraft present or future, from or to the McClellan-
Palomar Airport at Carlsbad including any future change in volume of operation or noise or pattern of
air traffic thereof, consistent with a general aviation airport and the airport's boundaries as indicated by
Carlsbad's General Plan.
"Grantor" also agrees to defend, indemnify and hold harmless the City of Carlsbad and its
officers, employees, agents and volunteers for any and all costs, liabilities, claims or damages related to
the use of this Avigation Easement by the county.

Subjects: 1. Findings regarding Noise Mitigation Requirements for Building "J"
on Lot 39 — Airport Business Center
2. Evaluation of Roll-Up Door Acoustical Performance for Buildings in
75 dB CNEL Zone
Dear Mr. Glaser:
This report addresses two issues which I believe are of concern to you.
1. Building "J" Noise Mitigation Requirements
We recently provided you with an acoustical analysis report for two industrial
buildings on lots 39 and 40 which were found to be within the 75 dB CNEL noise
contour at the McClellan-Palomar Airport. It is our understanding that
SANDAG's Airport Land Use Commission requires modifications to building
shell to achieve reduced interior noise levels when the building exterior noise
levels equal or exceed 75 dB CNEL. Interior noise levels are required to be
reduced to 50 dB CNEL or less.
Building "J" on lot 39 lies between the forecast 75 and 70 dB CNEL contours.
While the buildings previously analyzed were within the 75 dB CNEL contour,
the average sound level at Building "J" is 70 to 73 dB CNEL.
Based upon our understanding of the Comprehensive Land Use Plan
requirements, this building requires no mitigation since the forecast exterior
sound levels are below 75 dB CNEL.
2. Roll-Up Door Suitability for High Noise Building Zones
Our report (ref. 1) recommends a roll-up door with better than average sound
insulation qualities. An STC rating of 15 is the minimum required, with a goal of
22 STC. In order to achieve the better rating, the door must possess high-quality
edge and floor seals as they are the key to good sound insulation.

Porvene Door
We received specifications for the Porvene Model 232, insulated, continuous sheet
door. No sound rating is available for this door but our estimate is that the edge
seals are minimal and thus we feel this door is not adequate.
Cookson Door
We asked Vinyard doors if a higher-quality door was available and received
specifications for a Cookson Type FCWI-chain operated Insulated Service Door.
This door consists of 2 layers of sheet metal and 13/16" rigid insulation. The
bottom bar has a layer of 1" diameter vinyl while the edge seals are vinyl snap-on
weather-stripping to reduce air penetration.
No sound insulation rating is available for this door but our estimate of the STC
is as follows:
• STC of basic door panel - est. 30
(22 ga panel; 13/16" rigid insulation; 24 ga panel)
• Estimated air gap area = 1/4" x 40 ft = .84 ft2
• Door area approximately 168 ft2
• Air gap Ratio = .42/168 = .0048
• Reduction in door STC = 8 dB
• Estimated door STC = 22
Our feeling is that the Cookson Door is acceptable so long as all edge seals are
installed.

SUBJECT: Homes for Industry Lots 39 & 40 - Carlsbad
Dear Dennis:
Your letter of January 22nd requested an answer to the question: "If a level 75 contour
exists at the northerly portion of a lot and a building is situated whereby it is located
southerly of that contour, is the building required to be constructed with an interior noise
level of 50?"
SANDAG recommends noise attenuation for buildings that are impacted by noise contours.
If a contour splits a property, SANDAG would recommend that the buildings within the
higher contour be attenuated. However, the final decision regarding noise attenuation is
the prerogative of the land use agency. Noise contours fluctuate over time and the land
use agency may require noise attenuation for all buildings.

Your application has been tentatively scheduled for a hearing by the Planning Commission on
January 1 7, 1 996. However, for this to occur, you must submit the additional items listed below.

City to comply with the Permit Streamlining Act, and the required items listed below have not

A) Eleven (11) copies of your (site plans, landscape plans, building elevation plans,
floor plans) on 24" x 36° sheets of paper folded into 8 1/2° x 11" size.

plans. These copies must be of a quality which is photographically reproducible.

HOMES FOR INDUSTRY (LOT 40), CT 95-04/PIP 95-09/PUD 95-02
The Engineering Department has completed its review of the subject project. The Engineering
Department is recommending that the project be approved subject to the following conditions:
General
36. There shall be one final subdivision map recorded for this project.
39. NOTE: Unless specifically stated in the condition, all of the following engineering
conditions upon the approval of this proposed major subdivision must be
met prior to approval of a final map.
40. The developer shall provide an acceptable means for maintaining the private easements
within the subdivision and all the private: streets, sidewalks, street lights, storm drain
facilities and sewer facilities located therein and to distribute the costs of such
maintenance in an equitable manner among the owners of the properties within the
subdivision. Adequate provision for such maintenance shall be included with the CC&Rs
subject to the approval of the City Engineer.
42. The developer shall defend, indemnify and hold harmless the City and its agents, officers,
and employees from any claim, action or proceeding against the City or its agents,
officers, or employees to attack, set aside, void or null an approval of the City, the
Planning Commission or City Engineer which has been brought against the City within
the time period provided for by Section 66499.37 of the Subdivision Map Act.
Fees/Agreements
46. Prior to issuance of a building permit for any buildable lot within the subdivision, the
property owner shall pay a one-time special development tax in accordance with City
Council Resolution No. 91-39.
47. The developer shall pay all current fees and deposits required.
48. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
Grading
55. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall comply with all conditions and
requirements the City Engineer may impose with regards to the hauling operation.
Dedications/Improvements
67. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide best
management practices as referenced in the "California Storm Water Best Management
Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be approved by the City
Engineer. Said plans shall include but not be limited to notifying prospective owners and
tenants of the following:
A. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm drain
or storm water conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical treatments shall meet
Federal, State, County and City requirements as prescribed in their respective
containers.
C. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.

Avenue/Camino Vida Roble intersection. For onsite circulation, the site layout meets City
standards and includes adequate parking lot aisles and parking stalls, turning radii sufficient for
small commercial vehicles, and designated loading areas for each of the 8 lots.

SANDAG staff has reviewed the proposals to construct manufacturing buildings on lots 39 and
40. The proposed sites are within the McClellan-Palomar Airport Influence Area and affected
by the 65, 70, and 75 Community Noise Equivalent Levels.
SANDAG's Airport Land Use Commission rules and regulations authorize staff to make a
determination if the proposal is compatible with the McClellan-Palomar Comprehensive Land
Use Plan. The following comment has not been reviewed by the SANDAG Board of Directors,
serving as the region's Airport Land Use Commission.
Lots 39 and 40 are within the Carlsbad Airport Center Specific Plan, which was previously
reviewed by SANDAG. In 1994, the McClellan-Palomar CLUP was amended to reflect
updated noise contours. The projected 75 CNEL noise contour for McClellan-Palomar
Airport is forecasted to increase and cover portions of these lots.
The proposed projects are compatible land uses with the McClellan-Palomar Comprehen-
sive Land Use Plan if two items are achieved. First, the applicant executes an avigation
easement with the City of Carlsbad, as the land use agency, and the County of San Diego,
as the airport operator. The purpose of the easement is to notify the applicant, airport
operator, and land use agency that the lots will be impacted by aircraft overflight.
Second, the buildings proposed for construction within the 75 CNEL should be attenuated
to an interior noise level of 50.

Department for processing and approval.
C. Prior to the preparation of sewer, water and reclaimed water improvement plans,
a meeting must be scheduled with the District Engineer for review, comment and
approval of the preliminary system layouts and usages (ie - GPM - EDU).
4. This project is approved upon the expressed condition that building permits will not be
issued for development of the subject property unless the water district serving the
development determines that adequate water service and sewer facilities are available at
the time of application for such water service and sewer permits will continue to be
available until time of occupancy. This note shall be placed on the final map.

As a follow-up to the City Planning Department's letter of October 4, 1995, the following is a list
of the items or information required by the Engineering Department to complete your application.
These items should be included with your submittal of the Planning Department incomplete
items, and are to be submitted directly to your staff planner, Teresa Woods, by appointment. The
Engineering incomplete Hems are as follows:
1. Legal description noted on the plans.
2. Parking stall and aisle dimensions, and truck turning radii for all parking areas.
3. Grades of the parking lot sufficient to indicate rates of drainage. The City recommends
a minimum rate of 1.0%.
In addition, the Engineering Department made a preliminary review of the project for Engineering
issues. Engineering Issues of Concern, which are to be resolved or adequately addressed prior
to conditioning of the project are as follows:
1. The parking lot is to be designed so that a minimum 42' truck turning radius can be
accommodated in all areas. This radius is in accordance with Caltrans Highway Design
Manual, Figure 407E. It appears that the loading area at the north end by Lot 1 does not
meet this standard.
2. Trucks parked in the loading area for Lot 8 will protrude into the parking aisle. We
suggest moving the trash enclosure further back to create additional length for the
parking space.
3. A minimum width of 32' is required for those parking aisles loaded with both parking stalls
and loading doors.
4. A back out area, with a minimum depth of 5', is required in the parking lot area between
Lot 5 and Lot 7.
5. The dimensions for the travel way on the typical street cross section are incorrect.
Additionally, sidewalk exists on only one side of Kellogg Avenue.

6. A lot line dimension is missing between Lot 6 and Lot 7.
7. The dimensions of the proposed trash enclosures appear to be 10* x 10', which does not
match the City's standard for a trash enclosure, (City standard drawing GS-15 and GS-
16). We suggest reducing the number of trash enclosures and enlarge the remaining
facilities to meet the required size.
8.If the open grate located in the southwest corner of the lot is to remain, a swale should
be provided from the paved area to the inlet for secondary or emergency overflow.
9. Openings should be provided in the curb islands in the event of overflow at the grate
inlets.
10. In parking lot aisles that are minimally loaded with parking stalls, such as between Lot 5
and Lot 6, or between Lot 2 and Lot 3, we advise against directing drainage next to
buildings.
11. This project is to comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. This permit requires the project to provide best
management practices to reduce surface pollutants to an acceptable level prior to
discharge to the public storm drain system. Please indicate on the plans the method to
be utilized for meeting this requirement, including any loading areas located in a sump.
Examples of methods and practices used on other previously approved industrial projects
include the installation of a modified inlet containing a filter to treat surface runoff; or
directing surface runoff through a lengthy grass lined area prior to discharge into the
storm drain.
12. There is a water meter located in the main driveway to the project. We suggest either
relocating this meter out of the driveway, or discuss this location with the Carlsbad
Municipal Water District to determine if a special design for a meter cover that can
withstand heavy loads will be required.
Attached is a redlined check print set of the project, and is being forwarded to you for corrections
and changes as noted. Please must return this check print with the corrected plans to assist us

ENGINEERING:

ISSUES OF CONCERN
PLANNING;
1. Please indicate on the plans, the parking requirements for office and manufacturing
uses as proposed. Based on the plans, approximately 3,440 square feet of office (430
sq. ft. per building) and 46,750 square feet of manufacturing area are proposed.
Based on these figures a total of 131 parking spaces are required. Please note that
this project will be deed restricted for parking based on the proposed uses. Parking
on the site is minimal, any user wishing to have more than 430 square feet of office
will be required to process a PUD amendment to adjust the parking.
2. Please revise plans so that the proposed trash receptacles are designed to City
standards and screened with a 6-foot wall.
3. Please note that the building code requires separate restrooms for uses generating
more than four employees. Please revise plans as necessary to meet building code
requirements.
4. Please indicate why the buildings on lots 6 and 7 are not attached. The area between
the buildings appears to be dead space.
5. The building on Lot 3 appears to hang over the slope. City policy does not permit
structures to hang over slope areas. Please make necessary corrections to the plans.
6. The Landscape manual requires that at least one tree be planted for every five
parking spaces within the parking lot. There does not appear to be enough trees
provided within parking areas. Please check parking area landscaping and make any
changes as warranted.
7. The proposed project is located within a business park with high development
standards. To improve project design, staff recommends that the reveals and tile be
provided on both the right and left sides of the structures and that additional
landscaping be provided within the parking areas. Also, please identify the color of
the proposed reveals on the buildings.
8. The site is very congested as designed. Structures are encroaching into slope areas,
driveway isles are too narrow, truck turning radius are tight and, only minimal
landscaping is provided on the developable portion of the site. To open up the site
the buildings on lots 6 and 7 should be attached and at least one of the buildings on
the west portion of the site (Lots 1, 2 and 3) should be reduced in size. The
additional area could be used for landscaping and possibly additional parking.

1. The entire potable water system, reclaimed water system and sewer system shall be
evaluated in detail to insure that adequate capacity, pressure and flow demands can be
met.
2. The Developer shall be responsible for all fees, deposits and charges which will be
collected before and/or at the time of issuance of the building permit. The San Diego
County Water Authority capacity charge will be collected at issuance of application for
meter installation.
3. Sequentially, the Developers Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection requirements.
Also obtain G.P.M. demand for domestic and irrigational needs from appropriate
parties.
B. Prepare a colored reclaimed water use area map and submit to the Planning
Department for processing and approval.
C. Prior to the preparation of sewer, water and reclaimed water improvement plans,
a meeting must be scheduled with the District Engineer for review, comment and
approval of the preliminary system layouts and usages (ie - GPM - EDU).
4. This project is approved upon the expressed condition that building permits will not be
issued for development of the subject property unless the water district serving the
development determines that adequate water service and sewer facilities are available at
the time of application for such water service and sewer permits will continue to be
available until time of occupancy. This note shall be placed on the final map.

This easement is granted for any use by any aircraft present or future, from or to the McClellan-
Palomar Airport at Carlsbad including any future change in volume of operation or noise or pattern of
air traffic thereof, consistent with a general aviation airport and the airport's boundaries as indicated by

The common property line walls in adjacent buildings should be two separate wall systems to
provide an independent structural system for each building. That wall must be a fire rated wall
system finished as an exterior wall with a 30 " parapet above the roof line. The buildings may
not share any plumbing systems. With only one restroom in each building, its extremely likely
that any tenant improvement will trigger the installation of another handicap restroom. After
January 1, 1996, this will not be an option; it will be mandatory. Please advise the applicant
to plan accordingly.
Projects that come into building plan check after January 1, 1996 shall comply with the 1994
UBC,UPC,and UMC and the 1993 NEC.
