Since it will take some time to draft and approve the ordinance for subdivision monument
acceptance, I am writing this letter (as you suggested) to request that the City waive the tie sheet

In accordance with the request of Rick Engineering Company, project civil engineer, and as modified
by the City of Carlsbad, this revised letter has been prepared to provide our opinion regarding the
precise grading of sideyard swales along residential units within all the villages within the subject
development.
It is our understanding that, due to the minimum 5 feet sideyard width and the surface drainage
requirements, drainage swales are planned for a location of a minimum of 3 feet from the structure
perimeter. Furthermore, the grade of the flow line of the swale to the house will be maintained at a
maximum of 21 percent and a minimum of 2 percent. Thus where the swale invert requires lowering
the soil elevation or ground at the footing, the footing will be deepened to accommodate minimum
foundation embedment. The maximum footing deepening will be V2 foot and the locations will be
shown on the plot plans.
Based on the above discussion, it is our opinion that the sideyard swales as planned, with the
deepened footing where necessary, are acceptable from a geotechnical engineering aspect. Geocon
Incorporated will be provided copies of the plot plans and will observe that the deepened footings are
excavated during the routine foundation excavation observation.

Thank you for taking the time to meet with Larry Black and me on September 4, 1998
regarding the position of street trees along the portions of Villages A and B which have
frontage with Melrose Drive. This letter will serve to summarize our understandings at the
meeting.
The primary purpose of the meeting was to review a study prepared by ONA dated
September 3, 1998. The study shows the positions of the street trees along the east side of
Melrose Drive between Palomar Airport Road and Rancho Bravado. In the meeting both you
and Larry Black concurred with the study and you asked to review the working drawings
once they were complete to ensure conformance to the study.
I will send you a copy of the workings once they are complete and enclosed for your use is a
blueline of the ONA study dated Sept. 3, 1998 that we reviewed at our meeting. ,

For the Building 300 driveways only, delete the "X" and make them contiguous driveway
approaches. All other Village "C" driveways must meet the 3' property line separation standard.
Additionally, narrow some of the driveways to be able to accommodate 20' longitudinal on-street
parking, as applicable. (See attached schematic.)
Please be advised, this standard's modification is only for Village "C," this is not a general
standards modification for other projects, both in and out of Rancho Carrillo.

The purpose of this correspondence is to inform you that the City Engineer has signed the
improvement plans for the project noted above. These plans are now the property of the City of
Carlsbad and have been filed for permanent record with this office.
The City of Carlsbad requires that contractors obtain a right-of-way permit prior to constructing any
improvements within publicly dedicated streets or easements. Since the improvements reflected on
your improvement plans fall within this category, you must first obtain a right-of-way permit prior to
initiating your construction activities. You may obtain a right-of-way permit by making application at
our Engineering Development Services Counter at 2075 Las Palmas Drive. This is a "no-fee"
permit. A Right-of Way Permit Submittal Package is attached for your convenience.
The following items need to be submitted and/or approved prior to the issuance of a right-of-way
permit:
1. Completed application form.
2. Contractors state license number and class (type).
3. City of Carlsbad Business License number.
4. Certificate of insurance in the amount of $1,000,000 naming the City of Carlsbad as
"additional insured" and as "certificate holder".
5. Traffic Control Plan (if not included in the improvement plan).
6. Four blueline sets of the signed improvement plans (one set of bluelines are for
CMWD).
7. As part of your permit approval, application with CMWD will be required to tap into
sewer, water and/or reclaimed water lines.
In addition, if your project requires a grading permit you must complete the items listed on the
completion of Grading Plancheck Letter and receive approval on a grading permit prior to or
concurrent with the issuance of a right-of-way permit. You may obtain the blueline sets and any
other plan reproductions you desire through one of the several bonded blue print firms in the area at
your cost.

Signature of your Grading Plans clears the way for issuance of your grading permit subject to the
limitations and requirements of City Ordinances, your conditions of approval (if any) and all
requirements for outside agency permits such as the Coastal Commission.
The approval of these plans by the City of Carlsbad does not authorize the applicant to violate any
federal, state, or city laws, ordinances, regulations or policies including, but not limited to, the
Federal Endangered Species Act of 1973 and any amendments thereto.
Presently, our records indicate your project is clear for grading permit issuance provided the

I have received your letter dated April 17, 1998 asking for permission to do grading
prior to final map. After discussions with the project engineer, Mike Shirey and the
project planner, Brian Hunter, with both of them recommending approval I was able to
get the approval from Michael Holzmiller and Marty Orenyak. Therefore, this letter is
your authorization to do the grading prior to final map. The only caveat is that the plans
must be signed and in our hands, fees paid, bonds posted, conditions of approval for
grading permit met. You have indicated in your letter that all of these have been done
and prior to permit issuance they will be verified.

unreasonably interfere with the free and complete exercise of any easement(s), held by
San Diego Gas & Electric Company within the boundaries of said tentative map.
This letter should not be construed as a subordination of the Company's rights, title and of
the provisions contained in said easement(s) or a waiver of costs for relocation of any
interest in and to said easement(s), nor should this letter be construed as a waiver of any
affected facilities.
In the event that the development requires relocation of facilities, on the subject property,
which facilities exist by right of easement or otherwise, the owner/developer will be
requested to bear the cost of such relocation and provide SDG&E with suitable

Dear Bob: ,
The purpose of this letter is to request approval of the grading permits for Villages H and
ABCD in advance of City signatures on the improvement plans and approval of the final
maps. The status of the plans are as follows:
1. Village H and ABCD Grading Plans - mylars are have been submitted to City for
signature. All plan check issues are resolved. All conditions relative to grading have
been resolved. Bonds, agreements, are executed and have .been submitted and fees have
beerupaid.
2. Village H and ABCD Improvement Plans - mylars have been submitted to Fire
Department and CMWD for signature. All plan check issues are resolved with City.
We are diligently working on resolving all conditions relative to the final-improvement
plans and final maps. Only a few minor items remain such as notices. Bonds,
agreements, are executed and have been submitted to the City and fees have been paid.
3. Palomar Airport Road Improvement Plans - maylars have been submitted to Fire
Department and CMWD for signature. All plan check issues have been resolved with
the City. Bond, agreement are executed and have been submitted to the City. Fees will
be paid as soon as we receive the amount from the City.
4. Village H and ABCD Final Map - All plan check issues have been resolved with the
City. We are attempting to get signatures on the map now.
We believe that this request is reasonable and necessary due to the following reasons:
1. The site has previously been mass graded. i
2. We are attempting to have a grand opening in August of this year. It is essential to
commence grading immediately for the final pads in order to be able to meet our grand
opening schedule.

3. We need to start construction of models in Villages H and ABCD by the first week
in June to be able to open in August. Model construction cannot commence until we
first grade the pads.
4. We need to complete grading in Village H as quickly as possible since we arex
slightly long there and will need to haul the material into Villages ABCD. We do not
want to haul the material across a completed Melrose Drive if at all possible.

I checked my two projects, Village's "H & A-D", and the way that they were conditioned was to pay the
PAR reimbursement to the City "prior to building permit," not final map.
I did state in the "A-D" conditions that Continental Homes could not obtain reimbursement for the full
median improvements per a September 29, 1997, Richard Allen letter to Dave Lother; and, in that letter, it
does say that they should reimburse the City for PAR, prior to FM. So, we may be able to get them to pay
before other FM's based on that letter; however, the condition doesn't say that.
I've thought about it, and I'm not sure why our condition says prior to BP, but it does. At any rate,
Continental does want to pull a grading permit for Village "H & A-D," and pull building permits ASAP; so,
we would definitely get the payment then.
I'm not sure how Ken conditioned the rest of Carrillo regarding this.

Gentlemen:
In accordance with your request, we herewith submit our reply to Condition No. 63 of the draft
Planning Commission Resolution 4241 for C.T.97-02, Rancho Carrillo, Villages A, B, C, and D,
dated February 4, 1998. Condition No. 66 indicates a concern regarding the presence of an
interformational fault at the vicinity of Lot Nos. 180, 183 and 182, within Village D. This fault was
identified in our report entitled: "Preliminary Geotechnical Investigation for Rancho Carrillo,
Villages A, B, C, and D, Carlsbad, California" dated March 3,1993.
A review of the aforementioned report and our observations during the site mass grading, indicate
that a number of interformational faults, with a general trend of north-south, exist within the Delmar
Formation. These faults are generally high-angle, normal faults with a few feet of displacement and
several hundred feet long. These faults are considered inactive and the potential movement along
these faults is nonexistent. Therefore, no mitigation measures are required during site development.

I have reviewed your letter and attached traffic report on the referenced subject with the Public
Works Director/City Engineer. Traffic signals should be considered for installation as follows.
1. Palomar Airport Road/Melrose Drive intersection - Scheduled to be energized this month.
2. Palomar Airport Road/Street A-B intersection - Construct and energize at the time public
access on Street A-B is available to Palomar Airport Road.
3. Melrose Drive/Alga Road intersection - Construct and energize at the time Melrose Drive is
opened to public traffic between Alga Road and Palomar Airport Road.
4. Melrose Drive/Street A-A intersection - Construct and energize when warrants are met as
directed by the Public Works Director/City Engineer.
5. Melrose Drive/Poinsettia Lane intersection - Construct and energize immediately prior to
the elementary school opening.
6. Melrose Drive/Carrillo Way intersection - Construct and energize when warrants are met as
directed by the Public Works Director/City Engineer.
7. Poinsettia Lane/Village J intersection - Construct and energize immediately prior to the
elementary school opening.
Staff will be monitoring the intersections for meeting traffic signal warrants. The traffic report
you submitted indicates when traffic signal warrants might be met. This will help us and you in
evaluating the potential timing as to when a traffic signal may be necessary. The final
determination, however, will be based upon field data and observations and/or the authorization
by the Public Works Director/City Engineer.
