I am faxing you a copy of a revised plan showing one of the cart corrals being
relocated to the seasonal outdoor sales area. This will enable customers who exit and/or
park to the north of the main drive aisle in front of our store to place carts. Please

I think I have gotten to the bottom of the issue. We actually have a site plan which shows
where the corrals go, since they were sited when Albertson's and GTP redid the so called
"Exhibit A" site plan to the Declaration of Restrictions which encumbers the Center, to
convert the compact spaces to full size spaces. I will fax this to you. The cart storage
areas are effectively A regular sise parking spaces. However, the parking count did not
include these cart corral areas, so the addition of cart corrals at this time will not
affect the number of spaces in the center, since their inclusion had been contemplated by
the Albertson's planning staff in Boise.
Whatever you can do to expedite whatever the City needs to do (hopefully,
nothing) would be appreciated. If you have any questions, give me a call.

Gentlemen:
This is to confirm the following information:
The current zoning of the Property is C-l, Neighborhood Commercial Zone. The property
consists of four one-story shop buildings under construction for retail and commercial purposes,
which is consistent with the above zoning. Specifically, we have been advised that the initial uses
at the project will be First National Bank of San Diego, Bruegger's Bagels, Starbucks, Tommy
V's Restaurant, Cingular Wireless, Supercuts, Postal Annex, a nail salon, a cleaners and a
Washington Mutual Loan Office. Each of these uses is allowed under the C-l zone.
There are no variances, conditional use permits or special use permits required for the use of the
Property described above.
Each lot of the Property is in compliance with the Carlsbad subdivision ordinance and each lot of
the Property can be conveyed alone, without the necessity of filing of a new subdivision or parcel
map.
Minimum required on-site parking for the shopping center is 379 parking spaces (based upon
75,670 s.f.), and according to our records, the on-site parking proposed meets this requirement.
The buildings/proposed uses at the Property are not non-conforming.

This letter is a follow-up to the letter sent to you on August 14, 2002, regarding the "La
Costa Plaza" shopping center.
Upon further review of the project conditions and of information provided by Mr.
Tucker, the City Attorney's Office has determined that the condition regarding the
"issuance of permits" has been fulfilled at a project level. The City rescinds the August
14, 2002, letter requesting for the submittal of applications to amend the conditions of
approval, as they are no longer needed.

RE: CT 97-09 - LA COSTA ALBERTSON'S SHOPPING CENTER
This letter is in regards to the development project located on the corner of El Camino
Real and La Costa Avenue in Carlsbad, CA. The project is the development of an
Albertson's grocery store, other outlying retail buildings, and a gas station.
Many of the project's permits contain a condition which states "This approval shall
become null and void if building permits are not issued for this project within 24-months
from the date of project approval." During the review of the project conditions, it has
been identified that the 24-month timeframe in which building permits are to be issued is
rapidly approaching. In reviewing the project's status at this time and remaining work to
be completed prior to building permit issuance, it is unlikely that building permits could
be issued by the September 15, 2002, expiration date. The City approved the project on
August 4, 1998, and the Tract Map for the property recorded September 15, 2002. The
City has determined that the 24-month period would begin from the recordation of the
tract map.
At this time, the City suggests that applications be submitted as soon as possible and prior
to September 15, 2002, to the City to amend the project's permits to modify or extend the
24-month period so the project does not become null and void. The permits that need to
be amended are Site Development Plan 97-07, Conditional Use Permit 97-03, Special
Use Permit 97-02, and Special Use Permit 97-03.

SUBJECT: PRE 01-72 -LA COSTA PLAZA SUBSTANTIAL CONFORMANCE
The Planning Director has completed a review of your application for substantial conformance for
the architectural changes to the Albertson's building within the La Costa Plaza Shopping Center,
(APN: 216-580-01-00). After careful consideration of the circumstances surrounding this request,
the Planning Director has determined that the application qualifies for substantial conformance with
the approved permit and therefore, approves the changes, with the conditions below, to the project
based on Planning Director Administrative Policy No. 35.
This substantial review only reviews the front elevation of the building. The remaining elevations
and the roof are to follow the approved plans and conditions for the project.
The project shall provide landscape pockets and trees and/or vines in the front concrete sidewalk
area on each side of the front elevation of the building. This is to help break up the large building
mass on each side of the building's front elevation.
The projects landscape plan must be revised to reflect the proposed changes. The applicant shall
submit and complete a landscape construction change to the approved landscape plans prior to
building permit issuance.
The applicant shall submit and receive approval of a tentative map substantial conformance review
through the Engineering Department prior to building permit issuance.
Please submit two (2) blueline copies (24" X 36") of all applicable exhibits for the project file with
the changes noted above. The plans must be submitted, stamped "Substantial Conformance", and
signed by the Planning Director prior to issuance of any building permits for the project.

Van,
After a great deal of technical research and exchanges of information, Albertsons and LCWD have
reached an agreement on the method of relocation of LCWD facilities at La Costa Plaza. This issue has
placed the project in abeyance since February. On Friday at an all hands meeting attended by six
representatives and consultants of LCWD and fourteen representatives, contractors and consultants of
Albertsons, the means, methods and standards by which the LCWD facilities are to be installed was
discussed in detail, one facility at a times and agreement was reached. Albertsons is scheduled to have
revised plans to LCWD by December 5, 2001 and LCWD is expected to have comments back to
Albertsons by December 12, 2001. Work on the LCWD facilities is expected to be in a position to
commence by December 17, 2001, if all goes according to plan.
One of the consequences of the solution is that the Albertsons building will be downsized somewhat.
Albertsons will have the elevations available by November 28,2001 and we would like to meet with you
then to show you the new elevations. I have suggested to Albertsons and Albertsons has agreed that the
elevations look virtually like what the city approved, except to the extent they change due to the modest
downsizing of the building.
I would like you to send to me an application for a staff finding of substantial conformance so that
Albertsons is in a position to make such application on November 28, 2001 if the staff believes that such
application is necessary or advisable at that time.
Because this project is in a very high profile location and has been the subject of repeated and
understandable inquiry and concern by Councilmembers and Planning Commissioners, we would like to
have Gary Wayne attend the meeting as well. Albertsons will be represented by Mark Steinman, who is
the head of construction for Southern California, Jeff Dierck, Senior Real Manager and John Le of
Courtney Le Architects, the project architect. May I suggest a meeting time of 10:00a.m. We would expect
