I would like to hand this off as an administrative function to prepare Agenda Bill and schedule for the next available City Council Meeting. The process may not be as simple as we have planned and Dave Hauser / Galen Peterson might have actual expertise to complete this last step better than any of us. I am simply trying to find a way to finish this long and cumbersome task. It appears to take us enormous amounts of our time for what sounds incredibly easy. From discussion with Galen, I think there is a validation step involved to verify money spent. The total reimbursable construction costs for the roadway is estimated to be in excess of $1.2 million. Design has been completed for the work and construction has been secured. It is Western Pacific Housing's intention to use $213,890 of the estimated $1.2 million of fee credit to offset the BTD#2 fees for all 73 lots of the Lohf project. I n accordance with the Reimbursement Agreement, the remaining $986,110 would then be eligible for reimbursement to Western Pacific Housing. Given the great disparity in available fee credits compared to fees due, it is evident that 100% of B&TD#2 fees will be offset by actual construction costs. The basis for the City request was the City's desire to expedite this connection although it was not necessary to serve the proposed subdivision. The City agreed that certain on site and off site costs would be reimbursed subject to the execution of a reimbursement agreement prior to construction. These provisions are contained in Planning Commission Resolution 4427 conditions 47, 53 - ON-SITE IMPROVEMENTS - A, 53 - OFF- SITE IMPROVMENTS - A and 53 REIMBURSEMENT AGREEMENTS. At the City Council meeting, additional language was added requiring the improvements to be constructed within one year of final map recordation. Western Pacific submitted a reimbursement agreement draft nearly one year ago (October 1, 1998). Comments were provided by David Hauser in February of 1999 and the revised document was resubmitted following several redrafts in June of 1999. We have continued with design, acquisition and construction activities as demonstration of good faith in anticipation that the agreement would be expeditiously processed and put into place. Recent discussions with Mr. Hauser indicate that the agreement is not a high priority item due to the on going evaluation of the financial status of Bridge and Thoroughfare Benefit District #2. Western Pacific is well into the process of grading and installing infrastructure on the Lohf project. We have cleared Poinsettia Lane and need to begin grading and improvements in the roadway immediately. Furthermore, we have been negotiating the acquisition of rights of way from the Steiner, Levatino and Saska ownerships as a part of the required off site Poinsettia Lane construction. Given the timing of our construction activity, it is now necessary to have the required reimbursement agreement in place. The intent of our prior agreement with the City was to allow sufficient time to acquire offsite right-of-way without causing such a delay to our project, in accordance Sub-Division Map Act Section 66462.5. Furthermore, we have been diligently pursuing amicable acquisition agreements with the affected property owners. Our appraiser has recently completed appraisals based on methodologies acceptable to the City Attorney, and we are beginning our negotiations with the property owners at this time. The postponement would not adversely affect our grading schedule and would allow us to proceed with the on-site portion of Poinsettia and the extension of Dove Lane adjacent the new City Library. Because the off-site portion of Poinsettia is in a deep fill, we do not plan to grade that portion of the road for 5 to 6 weeks, leaving ample time for ROW acqujsition. However, although designed and secured, existing Dove was never constructed to the Lohf property tract boundary as proposed. Therefore, to complete the tie-in to existing Dove Lane as intended by the City's circulation plan, we are requesting that the City provide funding for the construction of the offsite portion of Dove. It is our understanding that this funding is readily available, either through a call of the existing construction bond or through other City funding sources. I anticipate that an agreement can be entered into that will provide reimbursement for the work on a "progress pay" basis. The outstanding issues cited by B&H and the resolution to those issues are described below. 1) Comment: Planning department approval must be obtained before proceeding. Resolution: Mike Grim has signed off on Planning Department issues. Outstanding conditions are in process for completion and will be completed prior final map recording. 2) Comment: Complete the design of improvements for Skimmer Court and Oriole Court extensions; provide cost estimates for bonding purposes. Resolution: Grading design is complete and on grading plans. Centerline precise alignment has been established, which is all that is necessary to complete road design. ROW will be dedicated on the final map. Water has been stubbed to the existing ROW line. Sewer is not relevant, as the project is upgrade from adjacent parcels. Cost estimates will be provided. 3) Comment: Design and bond for traffic signal at Poinsettia Lane and El Camino Real intersection. Resolution: Signal is not a condition of development for this project and should be omitted. All other minor comments have been addressed. Based on these understandings, you agreed that final plan check shall commence immediately, and you will direct B&H to proceed. Proposed Hardline Preserve Areas A number of proposed public and private projects have submitted proposed hardline design for inclusion in the HMP and the preserve system. Upon approval of the HMP, these proposals will obtain the same conservation status as the existing hardline areas and the City's General Plan will be amended to designate them as open space. Take of habitat will be authorized for the remaining portions of the projects. These projects include the City's municipal golf course, Lake Calavera, Veteran's Memorial Park, Hub Park, the Zone 19 park, Manzanita Properties, SDG&E south shore properties, Bressi Ranch, Carlsbad Oaks North Business Park, Holly Springs, Kelly Ranch, South Coast and the Raceway Property. The general location of the proposed hardline areas are shown on Figure 6, while detailed boundaries are shown for the individual projects on Figures 7 through 19. The proposed hardline boundaries on Veterans Memorial Park which provide a corridor between the City's Municipal Golf Course and properties to the north, constitutes mitigation for the development of the remaining portion of Veterans Memorial Park. A pedestrian trail, park road and five individual and two group passive picnic areas will be permitted in the corridor. The City is proposing to include the 266 acre public property at Lake Calavera as a public project mitigation bank for municipal projects such as the City golf course and the major roads shown on the City's Circulation Plan. The other City projects which could be covered by the City mitigation bank are identified in Appendix B. One of the key objectives of the HMP is permitting for City public facility projects mandated by the Growth Management Plan. The purpose of a public mitigation bank will be mitigation of unavoidable impacts to biological resources resulting from these public facilities projects. The mitigation credits available in the Lake Calavera mitigation bank are shown in the following table. There are 266.1 total acres at the bank. Deductions have already been made for the partial mitigation for the City's municipal golf course (46.45 acres and two pairs of gnatcatchers), mitigation for development in the portion of Hub Park not being conserved as a hardline preserve area (10 acres). Deductions have also been made for approved future improvements on the property which consists of a police shooting range (10 acres) and Water District projects (22 acres). In addition to mitigation credits at Lake Calavera, 10 acres of coastal sage scrub and two gnatcatcher pair mitigation credits for future City projects will be given for the conservation provided at Hub Park as a hardline preserve area. The levels of conservation achieved by the proposed hardline component of the preserve system by habitat type and by LFMZ are provided in Table 6. The total acreage of conserved habitat resulting from proposed hardline conservation areas is 1,353 acres or approximately 21% of the preserve system.
