As per your conversation, with Terry Toby, Superintendent of
Vistamar, John Laing Homes has a remaining 14 homes left on the
project. Of those 14 homes, we are requesting lots 1-7 on
Escallonia Court to be released for C of O's the week of February
14th. We also understand that there will be no further C of O's
released until completion of the stairs at the nature trail.
The City of Carlsbad agrees not to hold up Final Inspections and to
release Certificate of Occupancy to allow our homebuyers to move
in while the above noted work is progressing.

Elaine, the purpose of this memo is simply to confirm our second phone discussion on
6/24/98 regarding the Area D map and the 7/1/98 Planning Commission Hearing.
As clarified by your second call, the agenda for the 7/1/98 hearing includes Area D on
the agenda, but recommends that the item be continued. This is a clarification from your
earlier call informing us that the item had been entirely pulled from the agenda. In
addition, we understand from your second call that the informational package given to the
Commissioners for the hearing does not include the staff report and related resolutions for
AreaD
As such, the Area D map will be continued and will not be heard on 7/1/98. Per your
confirmation, it is not necessary that we attend the hearing on 7/1/98 and we are not
planning to do so because the item will not be discussed other than to approve a
continuance. Further, even if turned out there was time to hear Area D on the night of the
hearing and if we asked that it be heard, the Planning Commission would not be able to
do so because they were not given the staff report and related resolutions as part of their
information packages. Please advise us if our understanding is not correct.

Your application has been tentatively scheduled for a hearing by the Planning
Commission on July 1, 1998. However, for this to occur, you must submit the
additional items listed below. If the required items are not received by June 4,
1998, your project will be rescheduled for a later hearing. In the event the
scheduled hearing date is the last available date for the City to comply with the
Permit Streamlining Act, and the required items listed below have not been
submitted, the project will be scheduled for denial.
1. Please submit the following plans:
A) Eleven (11) copies of your site plans, landscape plans, building
elevation plans, floor plans on 24" x 36" sheets of paper, stapled in
complete sets folded into 8Vz' x 11" size.

floor plans. These copies must be of a quality which is
photographically reproducible. Only essential data should be included

SUBJECT: Poinsettia Shores Master Plan - Park Fee Credit
Dear David:
This letter is prepared as an update to my letter to you dated February 19, 1998
regarding the decreasing park land credit for the Poinsettia Shores Master Plan. This
update letter provides a revised Park Land Demand table that increased the number of
units within Planning Area J from 75 to 77 units as you had requested. This change
resulted in a slightly different impact to the park land credits. As indicated to you
previously, I would like to obtain your concurrence regarding the amount of the park in-
lieu fee required for the approval of the remaining final maps within the Poinsettia
Shores Master Plan.
Based on our recent conversations, it is acknowledged that the park land credit for the
Poinsettia Shores Master Plan area is dwindling. Once the credit is expended, the
remaining planning areas requesting final map approval will be required to pay park in-
lieu fees prior to the issuance of building permits. Currently, the park in-lieu fee is
$1,575 per dwelling unit. This fee per unit amount will be effective until the City revises
the Dedication of Land for Recreational Facilities Ordinance (Carlsbad Municipal Code
20.44) and the Park In-Lieu Fee amount.
As you may know, three final maps are currently being processed in the Poinsettia
Shores Master Plan. These maps are for Planning Areas A-3, A-4 and B-1. The last of
these three maps to receive approval will deplete the remaining park credits available
within the Poinsettia Shores Master Plan. Since none of these maps have been
scheduled for City Council as of this date, it is not known which map will deplete the
remaining credits. However, the impacts to park facilities beyond the park land credit
can be determined. These impacts result in a park in-lieu fee that must be paid.
The impacts to park facilities created by Areas A-3, A-4 and B-1 are determined by
multiplying the total number of units for these three planning areas (269 dwelling units)
by 393 square feet per single family detached dwelling unit as required by the

Dedication of Land for Recreational Facilities Ordinance. This results in 105,717.00
square feet of park land demand created by these three planning areas. Since there
are currently only 2.344 acres (102,104.64 sf.) of credit remaining, a deficiency of
3,612.36 square feet is projected (105,717.00 sf. -102,104.64 sf. = 3,612.36 sf.) once
the final maps for Planning Areas A-3, A-4 and B-1 are approved. This deficiency
must be corrected and is done so by paying the park in-lieu fee.
The park in-lieu fee amount is determined by converting the deficient square footage to
a dwelling unit equivalency. This is done by dividing the deficient square footage of
3,612.36 by 393 square feet per dwelling unit. The result is 9.19 dwelling units. The
9.19 dwelling unit deficiency is then multiplied by the current park in-lieu fee of $1,575
which results in a fee amount of $14,474.25 ($1,575 x 9.19 = $14,474.25).
The payment of the park in-lieu fee, or securing a bond or a letter of credit in the
amount of the park in-lieu fee identified above must be provided to the City prior to the
approval of the third final map. Providing a bond or letter of credit allows for the actual
payment of the park in-lieu fee to be deferred until the issuance of building permits.
Since all the park land credits within the Poinsettia Shores Master Plan will be depleted
after the approval of the final maps for Areas A-3, A-4 and B-1, the remaining Planning
Areas (Planning Areas C and D) will be required to pay a park in-lieu fee on a per unit
basis in the amount of the fee that is in effect at the time of the issuance of building
permits.
At this time, I would like to obtain your concurrence for the amount identified above.
Upon your concurrence, the necessary documents to ensure the payment of the park
in-lieu fee will be prepared.
Please give me call if you have any questions or if you are in agreement with the
contents of this letter.

STANDARD CODE REMINDERS
Staff Application of Code Reminders
A) In the past, the following items were applied to projects in the form of Standard
Conditions. They have now been moved to this new section of the form entitled
"Standard Code Reminders" because they reiterate requirements that are already adopted
and codified as part of the Carlsbad Municipal Code or other applicable ordinances. The
Planning Department's use of these Code Reminders has evolved through practical
application in approving and implementing development projects. The Code Reminders
emphasize and highlight important requirements and this information has been useful to
the Planning Commission, Developer, and Staff.
B) When a Code Reminder is applicable to a specific project or permit, it should be placed at
the end of ALL CONDITIONS of the resolution in a separate section entitled "Code
Reminders." To further qualify the Code Reminder section of the resolution, a note
should be added stating that: "The project is subject to all applicable provisions of local
ordinances, including but not limited to the following code requirements.
1. The Developer shall pay park-in-lieu fees to the City, prior to the approval of the final
map as required by Chapter 20.44 of the Carlsbad Municipal Code.
2. The Developer shall pay a landscape plan check and inspection fee as required by Section
20.08.050 of the Carlsbad Municipal Code.
Final Map Notes
3. The Developer shall provide the following note on the final map of the subdivision and
final mylar of this development submitted to the City:
"Chapter 21.90 of the Carlsbad Municipal Code established a Growth Management
Control Point for each General Plan land use designation. Development cannot exceed
the Growth Control Point except as provided by Chapter 21.90. The land use designation
for this development is [Click Here] dwelling units per non-constrained acre.
Parcels [Click Here] were used to calculate the intensity of development under the
General Plan and Chapter 21.90. Subsequent redevelopment or resubdivision of any one

Dear Jonathan:
Per your request, we have looked at the conceptual Landscape Design to see if
any entry areas for the housing clusters could be enhanced. As you know, the
areas are very tight and have limited space.
We would suggest that a specific type of tree, for example a palm tree
(Washingtonia robusta, Mexican Fan Palm), be used at each side of the entries in
lieu of the street tree. This palm tree would not be used anywhere else on.the
project. The plant palette is quite limited because of the close proximity of the
ocean. Plants must be selected that can take high salt exposure. The Mexican
Fan Palm is currently used on other areas of this development and can withstand
this exposure.

Re: CT 97-19 Poinsettia Shores - Planning Area D
Dear Ms. Blackburn:
North County Transit District (NCTD) has reviewed the above referenced project and has
the following comments:
Lot 8 of Planning Area D is located immediately adjacent to the SDNR railroad right-of-
way. The railroad is host to high speed train service including Coaster commuter trains,
Amtrak intercity trains and BNSF freight trains. Currently, over forty trains operate daily
between San Diego and Oceanside. In the future additional trains may be added.
Maximum speed on the railroad is 90 miles per hour. Given the high service frequency and
train speed, NCTD is very concerned about individuals trespassing in the railroad right-of-
way.
As you are likely aware, efforts have been underway to provide for non-railroad uses in the
right-of-way. NCTD has been participating in the planning for the Coastal Rail Trail which
is planned to be located along the eastern edge of the railroad right-of-way in the project
area. NCTD has been working with the cities to address outstanding issues including
liability, ownership and trail management, operations and maintenance funding, non-
motorized at-grade crossings, safety issues, and the physical separation of the railroad
facilities from the rail trail.
For the proposed project, a noise barrier wall is planned along the railroad right-of-way.
On the west side of the noise wall a 5 foot pedestrian trail is planned within the existing 20
foot public utility easement. This pedestrian trail is of concern to NCTD. While the
pedestrian trail would be located on private property, there is no barrier proposed to keep
trail users from entering the railroad right-of-way. Issues similar to those of concern with
the Coastal Rail Trail planning need to be addressed. First, the unfenced pedestrian trail

will invite pedestrians into close proximity to the railroad and will provide easy access to the
tracks. Second, the pedestrian trail will be out of view from homes and may become an
area in which security can not be assured. Third, the development of this trail could also
create potential future problems along the railroad including graffiti, vandalism, vagrancy,
and trespassing. In addition, when the Coastal Rail Trail developed, two trails would run
along Lot 8. Lastly, NCTD has been working with other city staff in addressing issue
regarding development near the railroad. We have met on several occasions with Dee
Landers and UDC Homes to discuss the Poinsettia Properties project. Noise walls are also
required for that project. We have recommended that the noise wall and associated slope
area be landscaped to create an attractive view by minimizing solid block walls which invite
graffiti.
NCTD would like to work with the city to create a more uniform approach in addressing
issues that have arisen due to the new development along the railroad right-of-way and the
planning of the Coastal Rail Trail. NCTD would welcome a meeting with City of Carlsbad
staff to discuss these issues further.

Dear Tim,
Our Report for Planning Area D, Lot 8 (Report #96-95) specifies the walls required for the project
to meet the 60 CNEL exterior noise standared. At the northern portion of the specified 7.0 foot
section of wall, the water district requires an access gate. The location of this acces gate is shown
in Exhibit 1. In order to remain an effective noise barrier, the gate must maintain a surface density
of at least 3.5 pounds per square foot. This can typically be achieved by using 1 1/2" plywood or
heavy guage metal. The gate must close snugly or must overlap at the point of closure. The gap at
the bottom of the gate shall be kept to a minimum, and should be provided with a resilient flap to
reduce flanking noise under the gate.

ISSUES OF CONCERN
Planning:
1. Any approval of this project will be conditioned to pay agricultural mitigation fees (per
the Master Plan).
2. The site plan (Sheet 3 of 3) will need to be corrected to match the landscape plan with
regard to the noise wall. The site plan still shows a noise wall which exceeds 6' in
height rather than the revised design (maximum 6' in height combined with berming)
shown on the landscape plan.
3. The proposed landscaping along the noise wall is shown on railroad-owned or other-
owned property (i.e., property not owned by the developer). This landscaping is also to
be located on top of a 20' easement for sewer access. The necessary landscaping may
be incompatible with the need for vehicles (trucks) to use the easement. Also, the
degree of slope of the easement may make it difficult for the trucks to use it. This
situation could be exacerbated by the additional berming required to keep the noise wall
to a maximum height of 6'. These conditions/problems will need to be resolved so that
1) the easement can be used by the necessary vehicles, 2) the noise wall includes
berming to keep the height to 6', 3) the noise wall is adequately landscaped, 4) the
necessary maintenance arrangements can be made satisfactorily. Staff suggests you
provide 2-3 cross-sections/profiles at the "worst case" points of the easement to assist
in finding the best solution to this issue. (See next item for a related issue.)
4. You will need to incorporate a gate in the noise wall to allow vehicular access to the
sewer access easement. You will need to provide a letter from the noise analyst
regarding this issue. The letter should address the impacts of incorporating the required
gate and any recommendations regarding the best location for it. (The current noise
study assumes and depends upon there being no cracks or openings in the wall.)

Plans 2 & 30 comply with minimum garage dimensions, see sheets A2.1 and A30.1.
4. Porch and deck information has been clarified on the title sheet under PROJECT INFORMATION and again

LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
Planning:
1. You must demonstrate on the architectural elevations compliance with the City's
building height regulations. The height must be measured from either the existing or
proposed grade (whichever is the more restrictive) to the peak of the structure.
2. The floor plans for Plans 2 and 3 call out a loft area. You will need to call out the
square footage of the loft portion individually and demonstrate compliance with the
City's definition of a "loft" (copy enclosed). If the loft area does not comply with
the City's "loft" definition, it must be counted as a "story" when calculating building
height.
3. The floor plans do not call out the dimensions of the proposed garages. This
information must be included on the plans.
4. The floor plan sheets for all of the structures call out square footages for
decks/balconies. However, the locations and dimensions of the decks are not
shown on the floor plan sheets for Plans 2 or 3. This information must be included
on the plans. (The information is provided for Plan 30. The information should be
provided for the other plans in a similar manner.)
5. The PFF Agreement provided requires an additional signature. As indicated on page
6 of the document, the signature of both the president or vice-president and the
secretary or assistant secretary are required. The president's signature is on the
document. However, the secretary's or assistant secretary's signature is also
required. Staff is returning the original document to you for the additional signature
and notarization. Staff suggests you return the corrected form as quickly as
possible as the preliminary title report (which must accompany the PFF Agreement
and be no more than 6 months old) is dated November 6, 1997.
ISSUES OF CONCERN
Planning:
1. The floor plans contain a note indicating that the area calculations are "for Building
Department purposes only". These notes will need to be removed from the plans.
Engineering:
Engineering Department staff has completed the 2nd review of the above-referenced project
for resolution of issues. The application and plans submitted for this proposed project are
not ready for approval and many of the previous comments are still unresolved.
Engineering issues which need to be resolved or adequately addressed prior to staff making
a determination on the proposed project are as follows:
Traffic and Circulation:
1. Please show the approved emergency access across lot 5. The final development plans
are in review and close to approval. Check with Fire Department regarding the closure
or gate of this access. Generally we cannot support the plan as shown.
2. Please show the full offsite improvements that will serve this project. Street "E" to
Avenida Encinas and the current street network proposed on lot 5. Identify the
maintenance and responsibility of this secondary access.
3. A detail of the Cul De Sac at the entrance to this project should be shown to verify
turnaround of inaccessible vehicles. The Cul De Sac Turnaround will be required as part
of this project if a Gate system is proposed.
4. Please extend pedestrian access (i.e., concrete sidewalk) around the cul de sac to trail
access gate #2. From an Engineering view, gate #1 could move to the north to better
serve this project as opposed to the location at the south end.
Sewer:
1. Please show existing easement and provide vehicle access to the proposed system.
The existing issue with this facility is large truck access and turnaround, tree planting in
an existing easement, and tree root intrusion or damage from vegetation. Contact Bill
Plummer or Randy Klausen to discuss this further. Consider the adjacent project (Area
B-1) and the similar solution to this issue.
Drainage:
1. Please show the terminus of the off-site drainage at the north end of the site. Indicate
the easement rights of the proposed 36" private facility.
2. Please show the terminus of the on-site 18" drainage system at the north end of the
site. Indicate any easement rights needed offsite to handle this design.
Miscellaneous:
1. Please show what is proposed on the adjacent parcel (Lot 5), within 100' of the
property boundary. The adjacent project is ahead of this with specific design and

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Carlsbad Tract Map, Coastal Development Permit, and
Condominium Permit, application no. CT 97-19/CDP 97-48/CP 97-06, as to its
completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals. No
processing of your application can occur until the application is determined to be complete.
The second list is issues of concern to staff. When all required materials are submitted the
City has 30 days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially
filed, November 5, 1997, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the
application. If an application is withdrawn or deemed withdrawn, a new application must
be submitted.

Planning:
1. Please identify individually (in square feet) the floor area of each level (first floor,
second floor, loft) of each of the floor plans.
2. Please identify on the floor plans the boundaries of the loft for Plan 1 (Sheet 1 of 6).
3. Please show any proposed decks/patios on the plan (site plan and floor plans).
4. Please show top and bottom elevations for all fences, walls, retaining walls, and
noise walls. Show these elevations at each end of such walls, in the middle, and at
the "worst case" points.
5. Please show the lot area and the total building coverage for each of the lots.
6. You must provide a completed table demonstrating how the project complies with
the City's "Small Lot Single Family Architectural Guidelines".
7. The master plan requires that a Site Development Plan (SDP) for the required
affordable housing project (if off-site) must be approved prior to or concurrent with
the tentative map for Planning Area D. Has this been accomplished?
8. Units 2 and 10 do not show any private recreation area.
Engineering:
No incomplete items have been identified at this time by Engineering.
ISSUES OF CONCERN
Planning:
1. The noise study states that, and the Landscape plan shows that a noise wall of 6'
to 8' in height will be required to mitigate noise impacts to the project. Staff
recommends that a combination of berming and noise wall be utilized to limit the
height of such walls to a maximum of 6'. This method will minimize the aesthetic
impacts of the necessary noise wall.
2. The combination fireplace/home entertainment center of the floor plans encroach
into the proposed yard setbacks for a greater distance (length) than would be
allowed for a typical (fireplace) encroachment. Therefore, the setback dimensions
will need to be measured from the more restrictive edge of the structures or the
entertainment center portion of the encroachments will need to be eliminated.
Engineering:
No incomplete issues have been at this time by Engineering.
