Subject: Planning Area 8 of the Poinsettia Properties Specific Plan - Noise Study
Dear Dee:
Per your request, the purpose of this letter is to provide a history of the documentation addressing
noise for the Poinsettia Properties Specific Plan. When the Environmental Impact Report for the
Specific Plan (EIR 96-01) was approved on December 3,1997, Section 5.5 of the EIR (attached)
stated that noise levels can be mitigated to a level less than 60 CNEL with construction of noise
barriers ranging in height from 3 feet to 10 feet tall. Since that time a revised noise study has
shown that anticipated noise levels have increased due to site elevation changes requested by
City Council and the City's realignment of Carlsbad Boulevard.
The realignment of Carlsbad Boulevard will increase noise levels by up to two (2) decibels on the
ease side of the northbound lanes of Carlsbad Boulevard. This increase noise level is noted in
the attached Agenda Bill for the Phase I Report for the Realignment of Carlsbad Boulevard and
the attached El A Part II for the Addendum to EIR 96-01. This situation causes the noise standard
of 60 CNEL dBA to be exceeded along Planning Area 8. Specific considerations regarding the
realignment of Carlsbad Boulevard, visual impacts and economic viability make the use of higher
noise walls infeasible to mitigate the environmental effect of noise.
Per the Noise Element of Carlsbad's General Plan, the exterior noise impact can be found
acceptable where there are economic or site constraints. These findings can be made since the
site was lowered to address "view" concerns of residents a half mile from the site and since
Carlsbad Boulevard was realigned (closer to the site) at the last minute to benefit all Carlsbad
residents. One of the conditions of approval under this situation would require all purchasers of
impacted units to be notified prior to purchase, and by deed disclosure, that the property is, or
will be, noise impacted and does not meet Carlsbad noise standard for residential property. This
notice must be submitted to the Planning Department, along with a deed disclosure, and must be
approved prior to Final Map.

Noise Levels in Excess of the City Standards: Mitigation Measures. The acoustical analysis
conducted for Poinsettia Properties Specific Plan and Pacific Shores South determined that ground floor
exterior noise levels of the residences adjacent to Carlsbad Boulevard and Poinsettia Lane could be
exposed to noise levels as high as 65 A-weighted decibels community noise equivalent level ("dB
CNEL"). City approvals for the Project required mitigation measures to be implemented on the Property
to meet City Standards for interior noise levels (defined below).
The Seller implemented mitigation measures within the residence on the Property as set forth in
the "Interior Noise Technical Report For Pacific Shores South - Carlsbad, California," dated
, 1999, prepared by RECON [need to verify the name of report], to ensure:
(1) that the interior noise levels do not exceed 45 dB CNEL ("City Standard") with all windows
and/or doors closed;
(2) that if windows and doors were required to be closed to meet the City Standard, mechanical
ventilation has been provided; and
A copy of the Report is available for review at the sales office. [Need to verify that the above is accurate]

POINSETTIA PROPERTIES - PLANNING AREA 8, CT 97-22/PUD 97-18/CDP 97-55
The Engineering Department has completed its review of the resubmitted project application for
completeness and/or engineering issues. The project application is now or was previously
found complete for the purpose of continued engineering review. The project application does
contain some engineering issues or concerns which remain to be resolved by the applicant. All
engineering issues should be fully resolved or addressed prior to resubmitting the project for
our review. The outstanding engineering issues or concerns are as follows:
1. Configuration of the residential lots has been modified from the last submittal, resulting
in cross-lot drainage, which is not allowed.
2. The tentative map indicates that the sideyards of several buildings will be less than 5'
wide and hence, not meet the City standard which requires that finish grading provide a
positive drainage of 2% to swale a minimum 5' away from the face of building. This
concern may be resolved by having the applicant's soils engineer provide a letter
indicating their approval of the proposed drainage design prior to tentative map
approval.
3. Please note that all lots are to drain towards the street, in accordance with City standard
drawing GS-15, and not towards the rear of the lot.
4. Please provide on the plans a detail of the emergency access area that runs between
Street "B" and Carlsbad Boulevard. The City recommends that this emergency access
area be designed so as to be compatible with the proposed surrounding improvements.
For example, rolled curb could be used for the portion fronting Carlsbad Boulevard, as
opposed to a standard concrete driveway apron; "grass-crete" or a similar material could
be used for the portion of the area that crosses the open space lot; and if necessary,
gating of the emergency access should be done to blend in with surrounding walls and
fences.
5. This project is required to provide improvements to Carlsbad Boulevard, including half-
width major arterial improvements along the project frontage with a raised landscaped
median. Please show on the plans, in plan view, the proposed improvements to
Carlsbad Boulevard.
6. Show on the tentative map the proposed locations of fire hydrants.
7. Please provide on the plans a cross section of the driveway fronting Lots 107-112. The
minimum width required for this driveway is 24', as opposed to the 20' shown on the
plans.
8. The proposal to connect Planning Area 8 to the existing sewer is unacceptable, as there
are major concerns that gas in the line will travel back towards the units. While this can
be prevented with an inverted siphon, such a facility requires frequent maintenance.
Related to this issue is that sewage from Planning Area 2 is planned to be conveyed to
the Poinsettia Shores pump station (Knots Lane) through an 8" sewer collector line. It is
anticipated that the alignment of this collector line will be parallel with the railroad tracks.
For sewage from Planning Area 8, a better and more appropriate alternative is to install
the 8" sewer collector line along the project frontage, and join to it once the connection
to the pump station is completed with the Planning Area 2 improvements. During the
interim, Planning Area 8 will be allowed to connect to the existing sewer along with the
provision of an inverted siphon.
9. It is unclear if there is to be one final map for the project, or if there will be several
phases or units. If there are to be several units, please indicate on the tentative map
the boundaries of each unit. Otherwise, it is implied that the project will be approved as
one final map.
Please note the City requires that both the project phases and the lots be numbered
consecutively in the intended order of mapping. For example, if the intention is to map
10 lots in each phase, then Phase 1 or Unit 1 will consist of Lot Numbers 1 through 10;
Phase 2 or Unit 2 will consist of Lot Numbers 11 through 20; and so on.
10. It is unclear as to how the access is gained to the proposed maintenance easements
located behind the wall, on the east side of the project site.

As requested, attached is a revised Public Facilities Fee Agreement, Disclosure
Statement and Land Use Review Application for Planning Area 8 of the Poinsettia
Properties Specific Plan. As you will notice, the owner of this property has changed
from HSL/BP/Michan, L.P. to Poinsettia investors, L.L.C.
We have previously discussed the Owner's Policy rather than a Preliminary Title
Report since the Owner's Policy is a final report with higher legal standing. HPA will be
coordinating with Magellan and Burkette & Wong to prepare applications for a Parcel
Map to split Planning Area 1 from Planning Area 8. Therefore, we will have a new
Preliminary Title Report to submit in the near future if the Owner's Report is not
accepted by the City Attorney.

As requested, following is a copy of the letter which was sent to Bob Wojdk from Burkett &
Wong regarding drainage for Pacific Shores South (CT 97-22) and Parkside (CT 92-02(B)). This
letter explains the drainage system to which Mr. Wojcik has agreed to. As stated in the letter, the
drainage system will be connected to a 6" diameter collector drain running along the rear of the
lots and will be connected to the underground drainage system. The collector drain will be
maintained by the HOA and clean-outs will also be provided at the top ends of the drains to
minimize the impact of access into the individual lots.

Your letter of August 31, 1998 addressed some concerns concerning the
proposed drainage scheme for the lot* at subject projects and recommended
we worK together to receive this issue, Since that time we have had several
discussions about different alternative schemes evan to tha extent of visiting
9 sample project site. As a result, It is our understanding that you have
tentatively approved a revised scheme which allows tha installation of one
eras drain in the rear yard of each lot which will be connected to a 6"
diameter collector-drain running along the rear of several of the lots and
connected to the underground drainage system. This collector drain will ba
maintained by the Homeowners Association with easements through each lot
provided to facilitate this. Cleanouts will also be provided at the top ends of
these drains to minimize the impact of access into the Individual lots.

This memo relates to the sewer issues on area 8 of Poinsettia Properties. The conditions are as follows:
1. Area 8 shall place an 8" sewer in Private Street B and project the line accross the railroad right-of-way
easement and intercept the 27" interceptor sewer perpendicular. The 8" line shall be in a steel casing pipe
and connect to the 27" at invert.
2. Install a 24" casing pipe parallel to the 27" sewer perpendicular to and accross Poinsettia Lane
right-of-way at an elevation that will allow a future extension of the 8" sewer north to the proposed lift
station on Area 2.
3. Extend the 8" sewer in private street B westerly to the centerline of Carlsbad Boulevard. This will be a
future tie-in point for Area 7.
4. Eliminate all sewer easements between homes and place the 8" sewer lines in future streets.
5. Extend an 8" sewer in private street A or B southerly to the future commercial lot. This sewer shall be
at sufficient depth to gravity flow the commercial lot. This depth will be approximately 7' below the street
finished grade.
In addition the developer will be required to build an 8 inch recycled water line on the frontage of Carlsbad
Boulevard for the length of the frontage.

The District is responding to your request for conditions on the subject project dated

District has reviewed the subject project. Based on our review of the project, we have
the following conditions regarding potable water, recycled water and sewer systems:
1 . The Developer shall be responsible for all fees, deposits and charges which will
be collected before and/or at the time of issuance of the building permit. The
San Diego County Water Authority capacity charge will be collected at issuance
of application for any meter installation.
2. The Developer shall provide detailed information to the District Engineer
regarding water demand, irrigation demand, fire flow demand in gallons per
minute, and projected sewer flow in million gallons per day.
3. The entire potable water system, recycled water system and sewer system shall
be evaluated in detail by Developer and District Engineer to insure that adequate
capacity, pressure and flow demands can be met.
4. All District pipelines, pump stations, pressure reducing stations and
appurtenances required for this project by the District shall be within public right-
of-way or within easements granted to the District or the City of Carlsbad
"Serving Carlsbad for over 40 years"

5. Sequentially, the Developer's Engineer shall do the following:
A. Meet with the City Fire Marshal and establish the fire protection
requirements.
B. Prepare and submit a colored recycled water use area map and submit
this map to the Planning Department for processing and approval by the
District Engineer.
C. Prior to the preparation of sewer, water and recycled water improvement
plans, the Developer shall submit preliminary system layouts to the District
Engineer for review, comment and approval.
6. The following note shall be placed on the final map. "This project is approved
upon the expressed condition that building permits will not be issued for
development of the subject property unless the District serving the development
has adequate water and sewer capacity available at the time development is to
occur, and that such water and sewer capacity will continue to be available until
time of occupancy."
7. All potable water and recycled water meters shall be placed within public right of
way.
8. The following items shall apply if checked:
0 No more than 19 homes shall be served on a single potable water distribution
pipeline. For those locations with more than 19 homes, a looped potable water
pipeline system shall be designed.

The Engineering Department has completed its review of the subject project. The Engineering
Department is recommending that the project be approved subject to the following conditions:
42. NOTE: Unless specifically stated in the condition, all of the
following engineering conditions upon the approval of this
proposed major subdivision must be met prior to approval
of a final map.
General
38. Prior to issuance of any building permit, the developer shall comply with the
requirements of the City's anti-graffiti program for wall treatments if and when such a
program is formerly established by the City.
39. There shall be one final subdivision map recorded for this project.
43. The developer shall provide an acceptable means for maintaining the private easements
within the subdivision and all the private: streets, sidewalks, street lights, storm drain
facilities and sewer facilities located therein and to distribute the costs of such
maintenance in an equitable manner among the owners of the properties within the
subdivision. Adequate provision for such maintenance shall be included with the
CC&Rs subject to the approval of the City Engineer.
45. The developer shall defend, indemnify and hold harmless the City and its agents,
officers, and employees from any claim, action or proceeding against the City or its
agents, officers, or employees to attack, set aside, void or null an approval of the City,
the Planning Commission or City Engineer which has been brought against the City
within the time period provided for by Section 66499.37 of the Subdivision Map Act.
46. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, the developer shall submit to and receive approval from the City
Engineer for the proposed haul route. The developer shall comply with all conditions
and requirements the City Engineer may impose with regards to the hauling operation.
47. Rain gutters must be provided to convey roof drainage to an approved drainage course
or street to the satisfaction of the City Engineer.

50. The developer shall pay all current fees and deposits required.
51. The owner of the subject property shall execute an agreement holding the City harmless
regarding drainage across the adjacent property.
56. Prior to approval of any grading or building permits for this project, the owner shall give
written consent to the annexation of the area shown within the boundaries of the
subdivision plan into the existing City of Carlsbad Street Lighting and Landscaping
District No. 1 on a form provided by the City.

58. Based upon a review of the proposed grading and the grading quantities shown on the
tentative map, a grading permit for this project is required. The developer must submit
and receive approval for grading plans in accordance with City codes and standards
prior to issuance of a building permit for the project.
59. Prior to the issuance of a grading permit or building permit, whichever occurs first, the
developer shall submit proof that a Notice of Intention has been submitted to the State
Water Resources Control Board.
61. No grading for private improvements shall occur outside the limits of the subdivision
unless a grading or slope easement or agreement is obtained from the owners of the
affected properties and recorded. If the developer is unable to obtain the grading or
slope easement, or agreement, no grading permit will be issued. In that case the
developer must either amend the tentative map or modify the plans so grading will not
occur outside the project site in a manner which substantially conforms to the approved
tentative map as determined by the City Engineer and Planning Director.
Dedications/Improvements
63. Additional drainage easements may be required. Drainage structures shall be provided
or installed prior to or concurrent with any grading or building permit as may be required
by the City Engineer.
64. The owner shall make an offer of dedication to the City for all public streets and
easements required by these conditions or shown on the tentative map. The offer shall
be made by a certificate on the final map for this project. All land so offered shall be
granted to the City free and clear of all liens and encumbrances and without cost to the
City. Streets that are already public are not required to be rededicated.
66. Prior to issuance of building permits, the developer shall underground all existing
overhead utilities within the subdivision boundary.
67. Direct access rights for all lots abutting Poinsettia Lane and Carlsbad Boulevard, with
the exception of the emergency access road, shall be waived on the final map.
70. The developer shall comply with the City's requirements of the National Pollutant
Discharge Elimination System (NPDES) permit. The developer shall provide best
management practices as referenced in the "California Storm Water Best Management
Practices Handbook" to reduce surface pollutants to an acceptable level prior to
discharge to sensitive areas. Plans for such improvements shall be approved by the
City Engineer. Said plans shall include but not be limited to notifying prospective
owners and tenants of the following:
a. All owners and tenants shall coordinate efforts to establish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
b. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm drain
or storm water conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical treatments shall meet
Federal, State, County and City requirements as prescribed in their respective
containers.
c. Best Management Practices shall be used to eliminate or reduce surface
pollutants when planning any changes to the landscaping and surface
improvements.
71. Plans, specifications, and supporting documents for all public improvements shall be
prepared to the satisfaction of the City Engineer. In accordance with City Standards, the
developer shall install, or agree to install and secure with appropriate security as
provided by law, improvements shown on the tentative map and the following
improvements:
a. Full-width street improvements to Ponto Road between Carlsbad
Boulevard and the southern subdivision boundary.
b. Half-width street improvements and raised median along the project
frontage on Carlsbad Boulevard to Major Arterial standards and to the
satisfaction of the City Engineer.
c. Removal of the existing northbound ramp from Ponto Drive to Carlsbad
Boulevard and installation of a cul-de-sac bulb at the northern terminus of
Ponto Drive.
d. Storm drain improvements within the railroad right-of-way from the
northern subdivision boundary and south to join the existing 78" storm
drain.
e. Installation of a traffic signal at the intersection of Ponto Road and
Carlsbad Boulevard.
All street improvement plan are to include signing and striping plans.
A list of the above improvements shall be placed on an additional map sheet on the final
map per the provisions of Sections 66434.2 of the Subdivision Map Act. Improvements
listed above shall be constructed within 18 months of approval of the secured
improvement agreement or such other time as provided in said agreement.
76. The design of all private streets and drainage systems shall be approved by the City
Engineer. The structural section of all private streets shall conform to City of Carlsbad
Standards based on R-value tests. All private streets and drainage systems shall be
inspected by the City. The standard improvement plan check and inspection fees shall
be paid prior to approval of the final map for this project.
Final Map Notes
78. Note(s) to the following effect(s) shall be placed on the final map as non-mapping data:
No structure, fence, wall, tree, shrub, sign, or other object over 30 inches above the
street level may be placed or permitted to encroach within the area identified as a sight
distance corridor in accordance with City Standard Public Street-Design Criteria, Section
8.B.3. The underlying property owner shall maintain this condition.
Code Reminder
The project is subject to all applicable provisions of local ordinances, including but not limited to
the following:
79. The developer shall exercise special care during the construction phase of this project to
prevent offsite siltation. Planting and erosion control shall be provided in accordance
with the Carlsbad Municipal Code and the City Engineer.
80. Some improvements shown on the tentative map and/or required by these conditions
are located offsite on property which neither the City nor the owner has sufficient title or
interest to permit the improvements to be made without acquisition of title or interest.
The developer shall conform to Section 20.16.095 of the Carlsbad Municipal Code.
