L-1060) Dear Skip: To follow up on our discussion this morning, enclosed are some graphics that show the approximate limits of the land slide behind lots 24, 25, and 28 as identified by Randy Wagner at Leighton & Associates this morning. I have also identified on the graphic the two test sites where we would like to get a drill rig in tomorrow morning if possible. The next step would be for the geologist to calculate the buttress size and to determine the limits of removals that we need to do to build the buttress. This will define the areas that we do need to mitigate. One of the exhibits that I have attached is the biology resources map put together by Mooney & Associates back in '97 for the project. I have identified on the biology map the approximate limits of the slide area also. Mooney will be providing a letter to me today relative to the impacts of the two tests sites. We met out there with a representative from Mooney this morning and picked two spots that are very accessible that are openings in the brush areas. There should be minimal impacts. Dear Mr. Ladwig; Mooney &. Associates was retained by Michael Ugar of Concordia Homes to conduct construction monitoring for the Colina Roble/CT98-02 project. The 35-acre property is located along the western side of Rancho Santa Fe Road, south of Olivenhain Road, and north of Avienda La Posta. During the construction process an area of potential slope instability was identified by the geotechnical monitors Leighton and Associates. Inc. This area occurs immediately south of Lots 24, 25, and 28. Drilling of holes approximately 30 inches in diameter and 40 feet in depth, is proposed to determine optimal methods for stabilization of this slope. This letter reports on the biological effects of the immediate area where drilling has been proposed. Prior to any clearing, a biological survey was conducted for active bird nests and sensitive plants on the 0.027-acre area that will be impacted. The survey was conducted on August 18, 2000, between the hours of 9:00 a.m. and 10:00 a.m., by Mooney & Associates biologist Ana Gaisiner. Survey conditions included temperatures ranging from approximately 75-80°F, clear sunny skies, and winds less than 10 mph. Photo documentation of the site was taken. One habitat type was detected during the survey: Coast Live Oak Woodland. Previous biological surveys describe this habitat in detail. One drill site will impact approximately 750 square feet of habitat. Species in this area include Mohave Yucca (Yucca schidigera), scrub oak (Quercus burberidifolki), white sage (Salvia apiana), coyote brush (Baccharis pilularis), flat-top buckwheat (kriogomtrnfascicitlatiim), and southern honeysuckle (Lonicera subspicata). The second drill she will impact approximately 375 square feet of habitat. Vegetation in this area is dominated by scrub oak. flat-top buckwheat, chamisc (Adenostumafasciculatd) and several non- native grasses. F.xtcnsive surveys were conducted throughout the area to be impacted for birds nests, and included inspecting vegetation from both below and above the canopy layers. Broad surveys were also conducted from several vantage points. No bird nests were detected within the 0.027-acre . Furthermore, no birds were flushed from the brush during inspection suggesting that no nests are likely to be present on the grading site. The proposed clearing of this area of vegetation will not affect any nesting birds. Coast live oak woodland habitats are considered important resources due to their diminishing loss to development. A no net loss would be required as mitigation. Mitigation may include revegetation on-site or purchase of credit in an oak woodland mitigation bank. ; / I The results of surveys for state or federally listed plants and birds, conducted on August 18, 2000, indicate that there are no resources present which would prevent clearing and drilling activities from proceeding. Previous surveys on other parts of the property found similar results. Mooney & Associates is continuing to monitor the process of the construction and will be on site during the clearing of this additional vegetation. This action is authorized under Section 1600 of the Fish and Game Code and has been approved by the California Department of Fish and Game. Pursuant to the requirements of the California Environmental Quality Act (CEQA), the Department filed a Notice of Determination (NOD) on the project on file* 6 ,l-l)[}i) Under CEQA regulations, the project has a 30-day statute of limilalions dn court challenges of the Department's approval under CEQA. The Department believes that the project fully meets the requirements of the Fish and Game Code and CEQA. State of California. hereinafter called the Operator, is as follows: WHEREAS, pursuant to Section 1603 of California Fish and Game Code, the Operator, on the 18th day of November. 1999. notified the Department that they intend to divert or obstruct the natural flow of, or change the bed, channel, or bank of, or use material from the streambed(s) of, the following waterfs): Encinitas Creek, tributary to Batiauitos Lagoon . San Diego County, California, Section _ Township _ Range _. WHEREAS, the Department (represented by Tamara Spear through a site visit on the 21st day of December. 1999) has determined that such operations may substantially adversely affect those existing fish and wildlife resources within Encinitas Creek. specifically identified as follows: Southern mixed chaparral, one Coast Live Oak and a mosaic of wetland habitat including freshwater marsh, coastal salt marsh, and southern willow scrub. THEREFORE, the Department hereby proposes measures to protect fish and wildlife resources during the Operator's work. The Operator hereby agrees to accept the following measures/conditions as part of the proposed work. If the Operator's work changes from that stated in the notification specified above, this Agreement is no longer valid and a new notification shall be submitted to the Department of Fish and Game. Failure to comply with the provisions of this Agreement and with other pertinent code sections, including but not limited to Fish and Game Code Sections 5650, 5652, 5937, and 5948, may result in prosecution. Nothing in this Agreement authorizes the Operator to trespass on any land or property, nor does it relieve the Operator of responsibility for compliance with applicable federal, state, or local laws or ordinances. A consummated Agreement does not constitute Department of Fish and Game endorsement of the proposed operation, or assure the Department's concurrence with permits required from other agencies. This Agreement becomes effective the date of Department's signature and terminates January 31. 2002 for protect construction only. This Agreement shall remain in effect for that time necessary to satisfy the terms/conditions of this Agreement. The following provisions constitute the limit of activities agreed to and resolved by this Agreement. The signing of this Agreement does not imply that the Operator is precluded from doing other activities at the site. However, activities not specifically agreed to and resolved by this Agreement shall be subject to separate notification pursuant to Fish and Game Code Sections 1 600 etseq. 2. The Operator proposes to alter the streambed of Encinitas Creek to accomodate the development of 28 residential units on 35 acres located south of the southwest corner of Rancho Santa Fe Road and Olivenhain Road impacting 0.47 acres of streambed, 0.04 acres of southern mixed chapparal, and one coast live oak. 3. The agreed work includes activities associated with No. 2 above. The project area is located in Encinitas Creek, San Diego County. Specific work areas and mitigation measures are described on/in the plans and documents submitted by the Operator, including a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, and shall be implemented as proposed unless directed differently by this agreement. 4. The Operator shall not impact more than .47 acres of streambed and one coast live oak tree. All impacts are permanent. 10.8 acres of wetlands will be preserved and 1,0 acres of wetland habitat will be restored on site. Impacts to the southern mixed chapparal will be offset by the preservation of remaining chaparral habitat in the 8.4 acre open space lot (Lot #29). 5. The Operator shall submit a plant palette and long-term maintenance provision for the 1.00 acre restoration area identified on-site. The Operator shall receive Department approval prior to project initiation/impacts. Revegetation shall use only native species. All mitigation shall be installed no iater than March 31. - 6. The Operator shall not remove vegetation within the stream from March 15 to July 15 to avoid impacts to nesting birds, 7. No equipment shall be operated in ponded or flowing areas. 8. Disturbance or removal of vegetation shall not exceed the limits approved by the Department. The disturbed portions of any stream channel shall be restored. Restoration shall include the revegetation of stripped or exposed areas with vegetation native to the area. 9. Installation of bridges, culverts, or other structures shall be such that water flow is not impaired. Bottoms of temporary culverts shall be placed at stream channel grade; bottoms of permanent culverts shall be placed at or below stream channel grade, 10. Preparation shall be made so that runoff from steep, erodible surfaces will be diverted into stable areas with little erosion potential. Frequent water checks shall be placed on dirt roads, cat tracks, or other work trails to control erosion. 11. Water containing mud, silt or other pollutants from aggregate washing or other activities shall not be allowed to enter a lake or flowing stream or placed in locations that may be subjected to high storm flows. 12. All contractors, subcontractors and employees shall also obey these laws and it shall be the responsibility of the operator to ensure compliance. 16. If a stream's low flow channel, bed or banks/lake bed or banks have been altered, these shall be returned: as nearly as possible to their original configuration and width, without creating future erosion problems. 17. All planting shall have a minimum of 80% survival the first year and 100% survival thereafter and/or shall attain 75% cover after 3 years and 90% cover after 5 years for the life of the project. If the survival and cover requirements have not been met, the Operator is responsible for replacement planting to achieve these requirements. Replacement plants shall be monitored with the same survival and growth requirements for 5 years after planting. •y/o^igao 18. All planting shall be done between October 1 and March 31,2069 to take advantage of the winter rainy season. 19. An annual report shall be submitted to the Department by Jan. 1 of each year for 5 years after planting. This report shall include the survival, 80% cover, and height of both tree and shrub species. The number by species of plants replaced, an overview of the revegetation effort, and the method used to assess these parameters shall also be included. Photos from designated photo stations shall be included. 20. Access to the work site shall be via existing roads and access ramps. 21. Spoil sites shall not be located within a stream/lake, where spoil shall be washed back into a stream/lake, or where it will cover aquatic or riparian vegetation. 22. Raw cement/concrete or washings thereof, asphalt, paint or other coating material, oil or other petroleum products, or any other substances which could be hazardous to aquatic life, resulting from project related activities, shall be prevented from contaminating the soil and/or entering the waters of the state. These materials, placed within or where they may enter a stream/lake, by Operator or any party working under contract, or with the permission of the Operator, shall be removed immediately. 23. No debris, soil, silt, sand, bark, slash, sawdust, rubbish, cement or concrete or washings thereof, oil or petroleum products or other organic or earthen material from any construction, or associated activity of whatever nature shall be allowed to enter into or placed where it may be washed by rainfall or runoff into, waters of the State. When operations are completed, any excess materials or debris shall be removed from the work area. No rubbish shall be deposited within 150 feet of the high water mark of any stream or lake. 24. No equipment maintenance shall be done within or near any stream channel where petroleum products or other pollutants from the equipment may enter these areas under any fiow, 25. Where the useable rear/side yard is less than 20-feet deep, the location may be taken at the back of the useable rear/side yard, as may be approved by the Planning Director. AH sound levels discussed in this report are A-weighted. Methodology The noise analysis methodology is based on the City's noise assessment methodology documented in the City's Noise Guidelines Manual (City of Carlsbad, 1995). The future noise level along Rancho Santa Fe Road was determined based on an ambient noise measurement and using Caltrans' SOUND32 Highway Traffic Noise Prediction Model (Caltrans, 1983) with California noise emission factors (Caltrans, 1987). The noise model is based on the Federal Highway Administration's traffic noise prediction model (FHWA, 1978). Input used in the noise model included the buildout traffic volume of 24,900 ADT (City of Carlsbad, 1997) with vehicle speeds of 45 rriph along Rancho Santa Fe Road. The truck mix used was 1.83 percent medium trucks and 0.28 percent heavy trucks. The traffic mix is based on vehicle mix surveys conducted by the City. The lots would typically be located above Rancho Santa Fe Road and the intervening ground, therefore, a hard site noise propagation factor was used. 2.0 EXISTING CONDITIONS Ambient Noise Monitoring A noise measurement was conducted at the site on December 16, 1997 ,to determine the existing noise level. The measurement was made using a calibrated Larson-Davis Laboratories Model 700 (S.N. 2132) digital integrating sound level meter. The sound level meter meets the current American National Standards Institute standard for a Type 1 precision sound level meter. • . r '.'.'_• The traffic noise measurement location was selected to provide an unobstructed view to Rancho Santa Fe Road and is depicted as Site 1 on Figure 1. Site 1 is approximately 40 feet from the existing center line of Rancho Santa Fe Road. The sound level meter was positioned at a height of approximately five feet above the ground. Concurrent traffic counts were made during the noise measurement. The measured average noise level was 67 dB. Table 1 shows the measured noise levels and the concurrent traffic volumes. - . . " . Noise Modeling The existing CNEL was calculated for the noise measurement location based on the current traffic volume along Rancho Santa Fe Road using Caltrans' SOUND32 noise model. To verify the input used in the noise model, the same traffic volume and vehicle composition ratios counted during the noise measurements were used. The modeled hourly average noise level was within one dB of the average noise level measured at the site, thereby, confirming the assumptions used in the noise model. The CNEL at the measurement site was calculated by adjusting the traffic volume and truck percentage to a set of normalized conditions (i.e., the City traffic mix and existing ADT). The existing traffic generated CNEL at Site 1 is calculated to be 70 dB. . , ; 3.0 ANALYSIS Exterior Noise Levels Rancho Santa Fe Road would be the primary noise source in the future. Residences on Lots 1 through 6 adjacent to Rancho Santa Fe Road would be exposed to a future CNEL greater than 60 dB. The closest residence adjacent to Rancho Santa Fe Road would be located on Lot 1. The first floor CNEL would be approximately 68 dB, at this lot. The noise level would exceed the City's noise guideline by up to eight dB, and would result in a significant noise impact unless mitigation measures are incorporated into Mr. David Bentley January 7, 1998 PageS the project. The backyards of Lots 7 through 28 would be exposed to a future CNEL of 60 dB or less. Figure 2 depicts the future first floor noise level at the backyards of several representative lots. Interior Noise Levels The City requires that interior noise levels not exceed a CNEL 45 dB. Typically, with the windows open, and using standard California construction materials and methods, the building shells provide approximately 15 dB of noise reduction. Therefore, homes exposed to an exterior CNEL greater than 60 dB could result in an interior CNEL greater than 45 dB. The exterior CNEL at Lots 1 through 6 would exceed 60 dB CNEL. 4.0 MITIGATION Exterior Noise Mitigation Measures To mitigate the exterior noise impact at the homes on Lots 1 through 6 would require noise barriers ranging from five to seven-feet in height. Lots 1 and 2 would require a minimum seven-foot high noise barrier; Lots 3 and 4 would require a minimum six-foot high noise barrier; and Lots 5 and 6 would require a minimum five-foot high noise barrier to mitigate the noise impact. The noise barriers should be constructed alongthe top-of-slope of the lots as depicted in Figure 3. The noise barriers may be constructed as a wall, berm or combination of both. The noise barriers must have a surface density of at least 3.5 pounds per square foot; and have ho openings or cracks. The wall may be constructed of 5/8-inch plexiglas, any masonry material or a combination of these materials. The mitigation, measures are based on a review of the tentative map. If changes are made to the proposed building pad elevations or lot setbacks as shown in the tentative map dated December 8, 1997, a noise study will be required to determine whether the proposed barrier heights and locations will mitigate the noise level. , - .: -• . , " . < - Interior Noise Mitigation Measures To comply with the City's interior noise standard, an interior noise analysis will be required for the project if two story homes are proposed on Lots 1 through 6. This assumes that the exterior noise mitigation measures are implemented. If two story homes are proposed on these lots, the interior acoustical analysis will be required for the homes on these lots prior to issuance of building permits to ensure that the interior CNEL would not exceed 45 dB. Concordia Homes property (Colina Robfe); File #2000-00-427 Dear Mr. Tucker: Mooney & Associates was retained by Concordia Homes to conduct surveys for sensitive plant species and bird nests within the grading limit lines on the future she of Concordia Homes, This property is located along the western side of Rancho Santa Fe Road, south of Olivenhain Road, and north of Avenida La Posta. Plant surveys were performed as a precautionary measure prior to grading the site. Surveys were conducted on May IS, 2000., between 9-11 a,m by Ana Gaisner and myself. Survey conditions included temperatures ranging from approximately 70-75 "F, 0-50% cloud cover, and winds less than 10 mph. The vegetation within the survey area was comprised of three distinct communities: non-native grassland, chaparral, and oak woodland. Non-native grassland habitat was dominated by ripgut grass (Bromtts diandns) and several species of mustard (Brassica spp.) Native species in the habitat included checker bloom (SMatea matveflora) and tarweed (Hemitoniafasciculala). The chaparral community was typical of this region ami consisted of a range of species including toyon (Meteromeles arbttftfolia), coyote brush (Boccharis pilvlarisi), aawtooth goJdenbush (Hazardia squarrosa), and lemonade beny (Rhus tntegrtfoKa), The oak woodland was dominated by coast live oak (Quercus agri/olia) and scrub oak (Quercvs dumosa) with honeysuckle (Lwicera subspicata) in the undentory. Ail vegetation within the area was surveyed thoroughly for sensitive plant species. No sensitive species were observed on site and therefore will not be impacted by the proposed construction activities, The property was also surveyed for bird nests on May 17,, 2000 between 12-3 p.m. by Erin Robbins and Ted Lee. Mooney & Associates staff biologists conducted extensive surveys throughout the chaparral and oak woodland habitats inspecting vegetation for birds nests from both below and above the canopy layers. Broad surveys were also conducted from several vantage points using binoculars. No bird nests were detected during the surveys. Furthermore, no birds were flushed from the brush during inspection suggesting that no nests are likely to be present on the grading site. In the event that the Architectural Control Committee determines that it is reasonably necessary for an Owner to temporarily remove a perimeter wall maintained by the Association in order to install a pool, spa or other Improvement in his or her rear yard, the Architectural Control Committee may authorize such temporary removal subject to the conditions, including but not limited to: (1) the Owner, at his or her sole cost, shall reconstruct such wall with substantially the same types of materials as originally used by Declarant and restore any damaged Common Area landscaping to substantially the same condition as existed prior to such work; (2) if applicable, the Owner shall re-stucco and/or repair an extended portion of the wall as reasonable necessary to avoid a patched appearance; and (3) obtain all approvals and permits as provided in this Declaration. ARTICLE X REPAIR AND MAINTENANCE Section 1. Repair and Maintenance bv Association. Section 7. Amendments to Notice of Annexation. Not- withstanding any other provisions in this Declaration to the con- trary, a Notice of Annexation may be amended by the requisite affirmative vote of Members (and first Mortgagees, if applicable), as set forth in the Article herein entitled "General Provisions," in only the annexed property described in said Notice of Annex- ation, rather than all Members (and first Mortgagees, if applica- ble) in the Project, on the following conditions: (a) Such amendment applies only to the annexed property described in said Notice of Annexation; and (b) Such amendment shall in no way contradict, revoke or otherwise alter any of the Protective Covenants set forth in this Declaration. ARTICLE XVIII GENERAL PROVISIONS Section 1. Enforcement. (a) The Association, the City.^ or the Owner of any Lot in the Project, including the Declarant, shall have the right (but not the obligation) to enforce, by proceedings at law or in equity, all of the Protective Covenants now or hereafter imposed by this Declaration and the Ey-Laws, respectively (and the Rules and Regulations duly adopted by the Association), including, without limitation, the right to record a notice of noncompliance or violation, to prosecute a proceeding at law or in equity against the person or persons who have violated, or are attempting to violate, any of said Protective Covenants, to enjoin or prevent them from doing so, to cause said violation to be remedied and/or to recover damages for said violation; provided, however, that with respect to Assessment liens, the Association shall have the exclusive right to the enforcement thereof. (d) The failure of the Association, the Citv. or any Owner to enforce any of the Protective Covenants contained in this Declaration or the provisions of the By-Laws shall not constitute a waiver of the right to enforce the same thereaf- ter. (e) Prior to filing a civil action by the Associa- tion, Jihe Citv. or by an Owner solely for declaratory relief or injunctive relief, or for declaratory relief or injunctive relief in conjunction with a claim for monetary damages other than Association Assessments, related to the enforcement of the Association governing documents, the parties may be required to comply with Civil Code Section 1354, if applica- ble. Failure to comply with the prefiling requirements of Section 1354 of the Civil Code may result in the loss of the right to sue regarding enforcement of the Association govern- ing documents. Upon motion by any party for attorneys' fees and coats as the prevailing party, the court, in determining the amount of the award, may consider a party's refusal to participate in alternative dispute resolution prior to the filing of the action. (f) A breach of the Protective Covenants contained in this Declaration or of the provisions of the By-Laws shall not affect or impair the lien or charge of any bona fide Mort- gage or deed of trust made in good faith and for value on any Lot; provided/ however, that any subsequent Owner of such property shall be bound by said Protective Covenants, whether or not such Owner's title was acquired by foreclosure, a trus- tee's sale or otherwise. (g) The Board, for and on behalf of the Associa- tion, may assess monetary penalties against an Owner as a Compliance Assessment and/or temporarily suspend said Owner's voting rights for the period during which any Assessment against said Owner's Lot remains unpaid; provided, however, the requirements for Notice and Hearing set forth in the By- Laws shall be followed with respect to the accused Owner before a decision to impose discipline is reached. (i) In addition to the above general rights of enforcement, the City and any other governmental entity with appropriate jurisdiction shall have the right, through its agents and employees, to enter upon any part of the Project for the purpose of enforcing all applicable codes and/or local ordinances, including, but not limited to, the California Vehicle Code, and is hereby granted an easement over the Project for such purpose. (j) The rights of City to compel performance shall include the following: (1) Failure of Association to Maintain Common Area. In the event that the Association fails to maintain the Common Area (including the easements shown on Exhibit "B"), as required in this Declaration, the City shall have the right, but not the duty, to perform the necessary maintenance. If the City elects to perform such maintenance, the City shall give written notice to the Association, with a copy thereof to the Owners in the Project, setting forth with particularity the maintenance which the City finds to be required and requesting the same be carried out by the Association within a period of thirty (30) days from the giving of such notice. In the event that the Association fails to carry out such maintenance of the Common Area with the period specified by the City's notice, the City shall be entitled to cause such work to be completed and shall be entitled to reimbursement with respect thereto from the Owners as provided herein. (2) Special Assessments Levied by the City. In the event the City has performed the necessary maintenance to the Common Area, the City shall submit a written invoice to the Association for all costs incurred by the City to perform such maintenance of the Common Area (including the easements shown on Exhibit "B") . The City shall provide a copy of such invoice to each Owner in the Project, together with a statement that if the Association fails to pay such invoice in full within the time specified, the City will pursue collection against the Owners in the Project pursuant to the provisions of this Section. Without limiting the generality of the foregoing, in addition to all other rights and remedies available to the City, the City may levy a special assessment against the Owners of each Lot in the Project for an equal prorata share of the invoice, plus the late charge. Such Special Assessment shall constitute a charge on the land and shall be a continuing lien upon each Lot against which the Special Assessment is levied. Each Owner in the Project hereby vests the City with the right and power to levy such special assessment, to impose a lien upon their respective Lot and to bring all legal actions and/or to pursue lien foreclosure procedures against any Owner and his/her respective Lot for purposes of collecting such Special Assessment in accordance with the procedures set forth in this Declaration. Section 2. Severability. Invalidation of any one of these Protective Covenants by judgment or court order shall in no way affect any other provisions hereof, which shall remain in full force and effect. Section 3. Term. The Protective Covenants set forth in this Declaration shall run with and bind the Project, and shall inure to the benefit of the Association and be enforceable by the Board, the Citv. or the Owner of any land subject to this Declara- tion, their respective legal representatives, heirs, successors and assigns, for a term of fifty (50) years from the date this Declaration is recorded, after which time said Protective Covenants shall be automatically extended for successive periods of ten (10) years, unless an instrument, signed by a majority of the then Owners agreeing to terminate said Protective Covenants, in whole or in part, has been recorded within one (l) year prior to the termination of the initial fifty (50) year term, or within one (1) year prior to the termination of any successive ten (10) year period. Section 4. Construction.. The provisions of this Dec- laration shall be liberally construed to effectuate its purpose o£ creating a uniform plan for the development and maintenance of the Project. As mentioned in my faxed memorandum to you dated 3-20-00 and our subsequent telephone conversation on 3-30-00, the city's contract plan checker for the Final Map questioned why the trail, north facing slope and open space easement are shown only to affect lots 1-18 rather than lots 1-19 as discussed in conditions 13D, 24, 25 and 26 of PC Resolution No. 4342. The reason for the difference is that the size of the existing detension berm to the north of lots 18 and 19, and therefore the illustration of the trail and associated transitional grading, is incorrectly shown on the conforming Tentative Map approved on 10-7-1999. The top of the berm, at an elevation of 112.6 feet, is approximately 62 feet wide and Lot 19 is not affected by the 8 foot wide trail, grading or open space easement. The detension berm, trail and slope are correctly shown on the grading plan for the project, city drawing no. 384-3. The Final Map is in agreement with the grading plan. If you find it necessary, please respond to this issue in your interdepartmental clearance letter to the Engineering Department. Mhpntological Services PALEONTOLOGICAL RESOURCE ASSESSMENT COLINA ROBLE PROJECT SITE CARLSBAD, CALIFORNIA x INTRODUCTION / This report provides a summary of findings concerning the paleontological resource potential of the Colina Roble project site, Carlsbad, California. The project site is located on the south side of Encinitas Creek, immediately west of Rancho Santa Fe Road, south of Olivenhain Road, and north of Avenida La Posta. As defined here, paleontological resources (i.e., fossils) are the remains and/or traces of prehistoric plant and animal life exclusive of man. Fossil remains such as bones, teeth, shells, and leaves are found in the geologic deposits (rock formations) within which they were originally buried. For the purposes of this report paleontological resources can be thought of as including not only the actual fossil remains, but also the collecting localities and the geologic formations containing those localities. It is important to point out that many fossil sites presently on record in San Diego County have been discovered only during residential development activities, during highway and freeway construction projects, or during pipeline and other utility construction projects. This close correlation between fossil sites and construction is related to the fact that surface weathering quickly destroys most fossil materials and it is not until fresh unweathered exposures are created by grading that well-preserved fossils can often be recovered. In addition, because of the amount of grading proposed for some sites, the chances are increased that grading will unearth rich fossil horizons. METHODS Because of the direct relationship between fossils and the geologic formations within which they are entombed, knowing the geology of a particular area and the fossil productivity of particular rock formations, one can reasonably predict where fossils will (or will not) be encountered. Paleontological resource assessment of the project site is based upon a review of existing published geological literature (Eisenberg, 1985), a review of museum paleontological records (San Diego Natural History Museum), and a walkover of the project site to field check the results of the literature and record reviews. Bedrock exposures are limited due to a heavy cover of native vegetation and occur in a/ few isolated erosional amphitheaters and in a low roadcut on Rancho Santa Fe Road. General Geology- As summarized on the Rancho Santa Fe, CA, 7.5' USGS quadrangle geologic map Eisenberg (1985) and observed during the field walkover, the geology of the project site consists of Eocene-aged (45-48 million years old) sedimentary rocks along southern (hillside) portion of the site overlain by Recent colluvial and alluvial deposits along the valley.floor. Eisenberg (1985) refers the Eocene rocks to the Delmar Formation and Torrey Sandstone. Recent Colluvium & Alluvium Introduction- The Recent colluvial and alluvial deposits exposed on the project site are the products of modem erosion and stream transportation. Paleontology- The Recent age of the colluvial and alluvial deposits on the project site indicates that these deposits are too young to contain fossil remains. Resource Sensitivity- The colluvial and alluvial deposits exposed on the project site are assigned a low paleontological sensitivity. Eocene Sedimentary Rocks Introduction- The Eocene sedimentary rocks exposed on the project site consist of light colored, massive arkosic sandstones (Torrey Sandstone) underlain by an interbedded sequence of greenish-gray siltstones and sandstones (Delmar Formation). Paleontology- Previous mass grading projects (Arroyo La Costa) in the immediate vicinity of the project site have resulted in the discovery of several fossil-producing localities. These localities were discovered in the same deposits as those exposed on the project site. Fossils recovered from these localities include shells of estuarine molluscs (clams and snails), teeth and bones of aquatic vertebrates (rays), and leaves and stems of terrestrial plants. Resource Sensitivity- The Eocene sedimentary rocks exposed on the project site are assigned a moderate paleontological sensitivity based upon the recovery of estuarine molluscan invertebrate and vertebrate fossils and terrestrial plant fossils from adjacent properties. These direct impacts are in the form of physical destruction of fossil remains. Grading plans for me Colina Roble project site indicate that cuts will be made during construction to accommodate the various streets and building pads planned for Ihis site. The proposed mass excavation work will encounter the Eocene sedimentary rock units discussed above. Any grading in these rock units will have a high potential for encountering significant paleontological resources. SIGNIFICANCE OF IMPACTS Fossils are the remains of prehistoric animal and plant life and are considered to be nonrenewable. Direct impacts to high and moderate sensitivity formations are significant and, under CEQA guidelines, require mitigation. MITIGATION MEASURES Mitigation of the impacts discussed above can be ensured by implementing the following measures: [1] Prior to initiation of construction activities the project developer shall retain a qualified paleontologist to carry out the mitigation program outlined here. (A qualified paleontologist is defined as an individual with a MS or Ph.D. in paleontology or geology who is experienced in paleontological procedures and techniques.) [2] A qualified paleontologist shall be at the pre-construction meeting to consult with the grading and excavation contractors. [3] A paleontological monitor shall be onsite at all times during the original cutting of previously undisturbed deposits of moderate sensitivity formations (Eocene sedimentary rocks) to inspect exposures for contained fossils. (A paleontological monitor is defined as an individual .who has experience in the collection and salvage of fossil materials. The paleontological monitor shall work under the direction of a qualified paleontologist.) [4] When fossils are discovered, the paleontologist (or paleontological monitor) shall recover them. In these instances the paleontologist (or paleontological monitor) shall be allowed to temporarily direct, divert, or halt grading to allow recovery of fossil-remains in a timely manner. Because of the potential for the recovering of small fossil remains, such as rodent and primate teeth, it may be necessary to set up a screen-washing operation on the site. 7 [5] Fossil remains collected during the monitoring and salvage portion of the mitigation program shall be cleaned, repaired, sorted, and cataloged. [6] Prepared fossils, ,along with copies of all pertinent field notes, photos, and maps, shall be deposited (as a donation) in a scientific institution with permanent paleontological collections such as the San Diego Natural History Museum. Donation of the fossils shall be accompanied by financial support for initial specimen storage. [7] A final summary report shall be completed that outlines the results of the mitigation program. This report shall include discussions of the methods used, stratigraphic section(s) exposed, fossils collected, and significance of recovered fossils. In summary, tiie project site possesses a high potential for producing significant paleontological resources. Development of tiie Colina Roble project site may result in impacts to these resources. The purpose of the measures is to reduce the intrusion of storm water into the slide mass during the winter months, and help de-water the slide mass prior to the winter months, and prior to formal repairs perhaps in Spring, 2006. As you are aware, in around early 2005, a portion of a man-made fill slope experienced failure within the project development. This failure occurred in the southerly project slope, and within the designated open space (Lot 29) of the site. During the failure, a portion of the slide has involved designated open space. As mentioned, we request assistance in obtaining any necessary permits and approvals from the City of Carlsbad, prior to commencing the proposed interim measures outlined below. As of this writing, we have had several discussions with Mr. Marshall Plantz, (City of Carlsbad Engineering Department), and he has indicated the need for an roadway encroachment permit, and traffic control plan through the Engineering Department. Based on our discussions yesterday, you indicated that some permitting and planning approvals may also be require. Therefore, we request that you confirm the scope of any project permits you may required, prior to commencing these interim mitigative measures, and indicate in writing the next steps we should take to complete the necessary project permits. We should again note that the planned interim work is mainly expected to be performed within the active slide areas, and that it is the desire of the affected property owners and their representatives that the interim measures be commenced soon as possible, and preferably by approximately Tuesday or Wednesday (October 4, or 5, 2005). The actual sequence and scope of the mitigative measures may change, as site conditions are exposed and the effectiveness of the initial efforts are monitored. In effort to hold down costs, we have proposed sequencing what we consider the most practical and cost effective measures first, along with measures considered to be the greatest priority (maintaining reasonable roadway access, and reducing the groundwater elevation beneath portions of the slide, reducing surface water infiltration, in an effort and thereby reducing the potential for movement of the existing slide mass), until formal slide repairs can be implemented. At present, the slide mass is visibly saturated, and therefore the focus will be to lower the standing water conditions beneath portions of the slide. It is our preference (for engineering, costs, and other reasons) to install a gravity flow dewatering system, without the excavation into the existing road, curbs and gutters. Therefore, we have proposed a sequenced effort, with the initial efforts intended to dewater the toe of the slide, and as these measures become effective and reduce instability, expand the dewatering system into broader areas. As of this writing, it is anticipated that deep, slot-cut excavations in the slide mass as previous proposed by the original soil consultants, may not be feasible because of caving, sloughing and in-filling of the excavation. However, after a period of dewatering, it may be possible to branch, lengthen or enlarge the gravity flow dewatering system. In an attempt to achieve this, we anticipate that portions of the initial efforts will require a pump driven system. Additionally, to maintain reasonable roadway access, it is also anticipated that some degree of unloading or shifting of the slide mass from the back of the slide to the front of the slide will be required. This limited re-grading will also be used to construct improved surface drainage on the slide mass, and assist in the creation an access area for future soil drilling equipment. The generally anticipated sequence of repairs is listed below from first to last. The actual sequence may differ. See the attached Figure I, for the general area of the proposed interim mitigative measures. Interim Mitigative Measures 1. Temporary Repairs to Existing Fence-Gillis Property-Lot 28. ( Provide temporary fence to close-off access into rearyard where original fence has been damage by slide movement). 2. Initial Monitoring of Topographic Survey Points Along Swale For Monitoring of Slope Failure and Adjacent Area (Perform initial set-up and surveying of existing land survey points present along the concrete drainage swale in the affected and adjacent slope areas). Installation of Additional De-watering At Slide Corners (The excavation of two pump driven de-watering points located at the northeasterly and northwesterly corners of the slide toe, See attached Figure I). 4. Documentation and Interim Dewatering (The excavation of soil and debris behind the existing buried storm drain, and installation of one gravity flow dewatering point consisting of gravel and filter fabric. This measure is intended to allow the standing water within the fill slope key to drain through the filter fabric and gravel, and into the existing pipe opening present in the back of the existing storm drain box.). 5. Cleaning of Existing Storm Drain Pipe North of Slide (The cleaning of the storm drain pipe extending across the street and out to the creek. We have been informed by Mr. Marshall Plantz, that City of Carlsbad will assist with this process). 6. Limited Surface Clearing and Re-Grading for Improved Surface Drainage and Access For Future Equipment. (In order reduce surface water infiltration and clear the slide mass for storm water control [sand bags, berms, and visqueen cover] we recommend that the surface of the slide mass be cleared of the existing vegetative cover and debris. Following vegetative removals, the slide shall be surface re-graded and re-compacted, in order to allow for the future placement of storm water control measures, improved channeling of surface water in the slide mass, and for future equipment access). 7. Removal of Roadway Area Soils and Install Temporary K-Rails. (Improve soil stability along the toe of the slide, and install K-Rails for improved roadway access). 8. Install Interim Surface Drainage Improvements Within and Immediately Adjacent To The Slide Mass Area. (To perform interim surface water and storm water runoff and control). It should be noted that given the significant area of native hillside adjoining and above the failure area, and the concern that the upper hillside areas could contribute significant surface runoff into the impacted slope, we recommend that the implementation of controls to surface water from these areas be considered upon first likelihood of sustained/significant rainfall. Additionally, we recommend that an aerial topographic survey of slope be performed to assess the actual surface drainage patterns, and as a basis for the longer tenn surface water and erosion control measures in and adjacent to the failure area. We recommend that following the completion of a land and aerial survey topographic surveys, (to assess the surface drainage patterns and contributing watershed areas), that a civil design firm be retained to develop a longer-term storm water and surface water control measures, which can also be used to assess surface water contribution into the slope and slide area. Retain Landscape Contractor To Perform On-Call, First Response Erosion Control Measures. (Retain a local landscape contractor to provide a first response capability for the performance of follow-up surface erosion control measures, and attend to corrective erosion control repairs). 10. Installation of Additional Interim De-Watering Measures (Following surface regrading and the installation of toe area de-watering drains, the need for additional de-watering measures will be accessed. Additional, interim de-watering measures could include the installation of three pump driven de-watering wells constructed in soil boring located in the upper slide mass, or the possible installation of a expanded system of gravity or pump drained de-watering trenches extending from the toe of the slide towards the middle of the slide. The application and selection of additional interim de-watering measures will be determined as site conditions require and site constraints allow. The information outlined above, is based on our preliminary review of project conditions. It should be noted that once ground water information is obtained, it may be determined that other mitigative measures are required to properly control the significant water seepage observed emanating from the failure area. The need for additional mitigative measures or alterations in the interim measures outlined above, will be based on further studies, exposures, and monitoring. As of this writing, as part of the interim measures we do not foresee the need for significant constructive activities/repairs in the undisturbed areas of the natural open space hillside beyond the failure area, besides general storm water control measures (i.e., temporary sand bagging, berms, plastic lined channels, downpipes, and surface channeling). Our conclusions and recommendations have been based on all available data obtained from our limited observations and information collected to-date. It is therefore necessary that all observations, conclusions and recommendations be verified at the time interim measures begin. In the event discrepancies are noted, additional recommendations may be issued (if required). L-1039) Dear Clyde: I have obtained some information from the City of Encinitas reference Rancho Santa Fe Road that I thought I should pass on to you. I am still concerned about the requirement to do full major arterial grading through the flood plain area of Encinitas Creek within the Wiegand Property/Colina Roble. As I have indicated before, we have no problem showing the dedication of the 102 foot right-of-way within the property but would prefer to grade the road as a secondary arterial. The information that I received from Encinitas does support a position for a roadway narrower than the Carlsbad standard for a major arterial. Please find attached to this letter two items that I have obtained from the City of Encinitas. The first is a series of items from Rob Blough, who is their traffic engineer. The items that he sent is the copy of the circulation element, their roadway classifications and a description of their various roadway levels as well as examples of augmented roadways. The second item is from Gary Barbaric, who is their Advanced Planner. What he had sent me was the minutes from the City Council meeting in Encinitas of July 10, 1996. Item No. 7 on the top of the last page was the Staff recommendation to upgrade Rancho Santa Fe Road immediately south of Carlsbad from an augmented local street (2 lane to a collector road) to a four lane divided road. According to Gary, there was considerable opposition from the people along the roadway and the Council tabled the matter. In addition, according to Gary, whom I have mentioned is their Advanced Planner, there are no plans to bring this back up to the Council or to change the classification. The current classification of the roadway is an augmented local street. The existing road classification, the augmented local road, is a two lane road with one lane in each direction. Based on what the City of Encinitas has adopted immediately to the south of this area along with what the City of Carlsbad has done in estimating the cost for Rancho Santa Fe Road (CFD #2) in this area based on a secondary collector. Its function is to distribute traffic between local streets and major and prime arterials. Although some collectors serve as through routes, their primary function is to provide access from surrounding land uses. Local Street - This category of roadway is designed to provide access to individual parcels in the City. Local streets consist of two lanes with a typical right-of-way width of 50-70 feet and a pavement width of 40 feet. The Circulation Plan described in Figure 2 designates only those local roadways that provide an additional function beyond that normally expected for a local roadway. For example, a "designated local" may function as a collector in certain areas of the City. An undesignated local roadway refers to those facilities that are not indicated on the Circulation Plan described in Figure 2. For planning purposes, the closing of a designated local roadway will require a General Plan Amendment while the closing of an undesignated local roadway wiHl not. i Each of the last four classifications above may be further described based upon improvement refinements necessary where physical constraints exist and to insure the preservation of community character. Augmented Roadway - Any of the last four roadway categories (not Freeways) can have an augmented designation. The intent is to provide a means of Increasing the capacity of a given type of arterial by maximizing the utilization of the basic laneconfiguration. Such augmentation can range from simply adding lanes at intersections to adding or expanding a median and/or other midblock measures to Improve traffic flow and reduce side friction. The augmented local may in its simplest form be just a two-lane local street with special intersection treatments such as signalization and/or added lanes as shown in Figure 5. A more highly augmented form would have a central median for turn movements and would restrict access to the extent possible. Augmentation of a prime arterial may vary from added lanes at intersections to access control strategies such as 'provision of local frontage roads. An augmented form of a local street is more important as far as the circulation system is concerned, for example, since this roadway may function as a collector roadway while it is developed to local roadway standards. The Planning Department has not yet received a school letter from the San Diegiuto Union High School District. 2. The Planning Department recommends that the Citywide trail segment in this area be aligned and constructed within the riparian buffer area to eventually connect with the proposed City of Encinitas trail system. See the attached marked plans for a more detailed description and location. The tentative map must show the 20 foot trail easement and the grading to accommodate the 8 foot wide trail/path. Consider benching the trail into the manufactured slope and enhancing the upslope landscaping to provide screening of the trail from the building pads. 3. The Planning Department does not support the panhandle design for Lot No. 25, based on the long access portion of the panhandle and the fact that Lot No 24 has panhandle driveways along both sides. Consider a more standard cul-de-sac frontage design in this area. 4. The Engineering Department is requiring that you show, on the tentative map, full width dedication (Major Arterial -102 feet) and future grading for the widening of Rancho Santa Fe Road along your frontage. In addition, any future associated biological impacts to the wetland area under the future widened section of the road must be quantified and mitigated. We have made the changes requested or addressed your comments as follows: Issues of Concern: Planning 1. Lot 25 panhandle access- Code sections 21.10.080 3c was followed to design this lot. The buildable portion of a lot is described as more than 35' in width so the panhandle length would meet code. 2. City trail- Per your suggestion, we did not add the trail link 55-A to the plan. You indicated that you had sent the tentative map to the City of Encinitas for comments and that they had not responded to date. If a trail segment is to be added, we would prefer it follow our Northerly property line or Olivenhain Road as suggested in the City trail Plan document. 3. Hillside Ordinance- The changes you suggested have been made. 4. Noise wall- A small berm has been added so the wall height will not be exceeded. 5. Rear yard slope- We identified these slopes as requested. Engineering: 1. Plan clarity- The changes requested have been made. 2. Proposed intersections- We've added them as requested. Our cul-de-sac length variance request would be to the 3C1 standard on page 6 of the Engineering Standards. Our number of dwelling units is 28 when 50 are allowed, the ADT is 280 when 500 is allowed and the variance request is for length where 1200 may be approved where 1500 is requested. The reason for our request stem mainly from the following: A. Our entrance section has 36' curb to curb within a 56' right of way. B. From lots 1-12 we are requesting a Hillside street. (36' curb to curb in a 52' right of way with sidewalk only on the north side.) This section of roadway is 900 feet long and only has lots on one side. We also have a section of Crib wall opposite lots 3-6 as requested by the U.S. Fish & Wildlife Service, State Fish & Game and Corps of Engineers. "A" street was pulled south to pull the lots out of the wetlands and reduce impacts. 5. Rancho Santa Fe Road- We have shown your request on the cross section on sheet 1 to indicate the Road as a major arterial with improvements to secondary standards. We have re-worded the note reference future improvements and would prefer to leave the note on the plan. Clyde Wickham said he would work with us on the re-wording if the change is not acceptable. Sewer and Water: 6. Sewer and water laterals- These have been shown on the plan. 7. Drainage study-1 have attached the study "Interim Detention Study for Basin "D" on Encinitas Creek" by Howard Chang Ph.D., P.E. dated February 1992 along with a letter from Howard Chang dated February 27, 1998 stating that he has reviewed our plan and that the lots are free from flooding and that our fill has not impacted the storage volume of Basin "D." He also states that no rip-rap protection will be required adjacent to the basin. This could be shown on the tentative and final map for these lots to indicate clear public notice for the individuals who will later build on these two lots. In addition, I think your concern was accurate in that we do need to clearly show the setbacks for the cul de sac area so that we don't create conflicts for the planning and building departments in the future. What I've done is rather than continue the 20 foot setback completely around the cul de sac I have added the additional 20 foot setback parallel with the portions of the panhandle lot. This will clearly keep the area around the cul de sac open so that homes do not encroach into what appears to be the normal setback area. Again, I think it was a good concern of yours and hopefully my suggestion to show these setbacks on these two lots on the tentative map will satisfy that concern. This development is along the south bank of the east branch of Encinitas Creek. The fioodplain of Encinitas Creek adjacent to the development is within a floodgate detention basin, designated as Basin "D". A hydrology study for the basin is given in the technical report "Drainage Study for Encinitas Creek" by H. Chang, dated September 1990. According to the report, basin D has the peak water-surface elevation of 110 feet for the 100-yr flood. Since the building lots are above this elevation by at least 1 foot, they are therefore outside the 100-yr fioodplain. It is noted that the proposed development involves landfill in the fioodplain of the stream channel. Such landfill is out side the floodway boundary and it does not impact the storage volume of the floodgate detention basin. In the hydrologic design for the detention basin, the storage volume of the basin only includes the area within the floodway boundaries. The proposed development is outside the floodway boundary, this area was not included as a part of the detention basin volume calculation. The proposed development is located along the south bank of the detention basin. The bank itself will require no riprap protection since the flow velocities are very small in the basin during the 100-yr flood. The noise wall along the street side of Lot 1 exceeds the zoning's maximum wall height requirement of 6 feet for a wall located in a street side setback. Consider using a combination of a berm and wall to achieve the desired noise attenuation, while keeping the wall to 6 feet or less in height. 5. The Planning Department recommends that the rear yard fill slopes facing Encinitas Creek and Rancho Santa Fe Road be placed under Homeowners Association maintenance via a maintenance easement shown on the tentative map. Engineering: Engineering Department staff has completed a review of the above-referenced project for application completeness. The application and plans submitted for this proposed project are considered complete. Additionally, staff has conducted a review of the project for engineering issues of concern.
