Coast Highway Suite 110 Oceanside, CA 92054-6466 Re: Santalina Project, CT 98-06 Dear Board of Directors: I am responding to your letter dated October 17, 2000 regarding access to the Santalina project that you addressed to the City Council. The City understands your concern, however, the issue that you are raising is something that was identified and discussed in the public hearing process for the Santalina Subdivision almost a year at the January 20,1999 Planning Commission Hearing. At the Planning Commission Hearing residents spoke of the access issues and raised the objection to Navigator Circle being used as a secondary access. The original developer of Poinsettia Shores Master Plan created the design and concept for the master plan, master association and separate project associations, thus creating the issue that you have raised. There were many requirements that the developer had to meet prior to City approval of the master plan and individual projects. A critical issue that the City reviewed, as part of the approval process, was traffic circulation. The City requires at a minimum two points of access for developments with the density of Rosalina and Santalina. Rosalina has two points of access via Navigator Circle. Santalina has two points of access, one onto Navigator Circle and the other onto Windrose Circle. The developer of Santalina acquired access easement rights to Navigator Circle for their project. The access rights were created with the approval of the Poinsettia Shores Master plan and must be preserved. The City has already approved the design and construction of Poinsettia Shores Master Plan, Rosalina and Santalina. The Poinsettia Shores Master Plan was amended and approved by the City on July 16,1996. The Santalina project was approved by City Council on April 13,1999. The Rosalina project was approved to accept traffic from Santalina via Navigator Circle. It is unacceptable to the City to restrict the access to Santalina from Navigator Circle as described in your letter. The City has considered your request and does not support it. The Rosalena Community is made up of 75 homeowners located on Navigator Circle, a private street, in Southwest Carlsbad. At Windrose and Navigator Circle, Greystone Homes is building a new development called Santalina. As members of our community watch the new homes going in, they have expressed concern regarding the impact the additional traffic will have on the area communities, including Santalina. The concern is the access into Santalina from Navigator Circle. Santalina is a gated community with two entrances, the main entrance on Windrose and the second on Navigator Circle. The latter is the entrance that causes concern. This gated entrance onto Navigator Circle is located just across the street from the only access to the Vistamar Community, and onto the main access to Rosalena, which is a busy narrow two-way street with parking on both sides. With the addition of the traffic from the Santalina Community it will become a very dangerous street. This will be compounded when two or three vehicles are trying to enter the Santalina gate causing vehicles to backup into the street. Member of the Community met with representatives of the City and Greystone Homes to address die Communities concerns. At that time, the discussion was to eliminate the gate or make it an emergency gate only. It was determined that neither of these solutions was practical. In an effort to resolve their concerns, members of Rosalena continued to search for a solution that will accommodate everyone. They have found an excellent compromise. Driving through the communities in San Pacifica, all of the second gates are exit only gates. If the Santalina gate onto Navigator Circle was made an exit only gate and a right turns only exit, it would make the street considerably safer. In closing, the Rosalena Community request that the City consider making the Santalina Community gate at Navigator Circle be an exit only gate and a right turn only. We understand the developer does not object to this solution. Thank you for your consideration in this matter. In no case shall the grading extend beyond -©ctoberl 5, 1999. 3. 4. In consideration of the City granting this pre-map grading approval, you agree to remove and replace the asphalt pavement on Windrose Circle up to a maximum of the length of the street from Avenida Encinas to its terminus. Determination of what sections may be left in place will be solely left up to the City inspector. Along with the pavement replacement, root barriers shall be placed prior to repaving in areas directed by the City inspector to prevent future damage to the City street. With the reconstruction of Windrose Circle a reclaimed water line shall be installed. You shall diligently pursue the completion of your Final Map, improvement plans and landscape plan. Dear Bill: As you are aware, we currently have a *Jite Development Plan for Planning Area 5 of the Poinsettia Properties Specific Plan area under process with the City of Carlsbad. The site development plan proposes 92 affordable apartment units to be constructed on approximately 5 acres. Planning Area 5 serves as the affordable housing mitigation for approximately 500-600 market rate residential units being proposed on the balance of the Specific Plan area. A few months ago, we met with you and our civil engineer, Pat O'Day, to reconfirm the need for a sewer lift station to serve development on Parcel A (approximately 56 acres east of the railroad). We are pleased that following that meeting the Water District has reconfirmed its approval of the lift station for Parcel A. Planning Area 5 is located on Parcel A and is at an elevation that allows it to gravity flow into the exiting 27" sewer line located in the rail road right of way. This «s the sewer plan that was originally proposed on the site development plan. After learning that sewer gases may exist in the existing 27" rail road line, our engineers have recently proposed to you that Planning Area 5 now sewer into an existing line in Avenida Encinas as a method of avoiding sewer gas problems. At a future date, when the lift station is built with the development of the balance of Parcel A, Planning Area 5 would then be able to tie into the lift station. We understand that from talking to Pat O'Day that you are currently evaluating this new proposal. We understand also that the Water District is considering an alternative solution that would require Planning Area 5 to build the lift station as a condition of its development and then sewer into the new lift station. Unfortunately, Planning Area 5 is a 92 unit subsidized affordable housing project and could not finance such a facility. As the owners of Parcel A we agree to build the lift station with the development of the remainder of Parcel A and agree that Planning Area 5 can tie into the lift station at that time. As the owner of Parcel A, we agree not to seek reimbursement from Planning Area 5 for its share of the lift station. Our engineer will design Planning Area 5 to accommodate this future tie in. The following are the conditions for providing service to subject project: POTABLE WATER SYSTEM : (See approved potable water system analysis map). 1. 12" P.V.C. class 150 water main shall be constructed from connection point #2 (westerly end of Avenida Encinas) to connection point # 3 (in Windrose Drive, approximately 100' west of west Navigator Circle). 2. 12" P.V.C. class 150 water main shall be constructed from connection point #9 (in east Navigator Circle, approximately 200' south of Windrose Drive) to connection point #6 (located on the westerly boundary line of interstate #5 freeway). 3. 8" P.V.C. class 150 water mains shall be installed in remaining streets (except for portion of Avenida Encinas as shown on approved map). 4. Gate valves shall be installed as shown on approved map. 6. Existing 8" and 10" service stubs in Windrose Drive shall be disconnected at the existing main and sealed and abandoned. 7. The existing 16" A.C.P. and 8" A.C.P. and 8" "temporary" steel hi-line shall be put out of service and removed. Arrangements shall be made to keep residences in service. Developers Engineer shall prepare a phasing procedure for District approval. 8. There are existing bonds and agreements on file at District between the District and Batiquitos Pointe, C.T. 82-18 (CMWD 82-210 & 84-514 BLEP) for onsite and offsite (San Dieguito Water District Inter-tie System) improvements. Developer will place on hold the bonds and agreements until City resolves the Carlsbad Blvd. and Ponto Drive intersection alignment. After the City establishes alignment, the Developer will be required to enter into a new agreement. After its execution, the District will exonerate bonds, void the agreement and establish financial conditions. PUBLIC RECLAIMED WATER SYSTEM: (See approved reclaimed water system analysis map). 1. 6" P.V.C. class 200 water mains shall be installed in Windrose Drive and Avenida Encinas from the north boundary to the west boundary. 2. Gate valves shall be installed as shown on approved plan. 3. Prepare a colored reclaimed water use map for the private reclaimed system and submit to City Planning Department for processing. After review, possible additional public water mains may be required. PUBLIC SEWER SYSTEM LAYOUT; (See approved sewer system layout). 1. A minimum 10" diameter sewer main shall be installed beginning at Basin No. 2 connection point to the existing manhole at Windrose Drive and west Navigator Circle intersection. 2. The sewer mains shall be installed per the approved sewer system layout. 3. A portion of the existing sewer main in Windrose Drive and its northwesterly prolongation shall be removed.
