HomeMy WebLinkAboutCT 98-12; Magnolia Gardens; Tentative Map (CT) (32)May 19, 1999 TO: PLANNING COMMISSION FROM: Senior Planner ERRATA SHEET FOR THE MAGNOLIA GARDENS PROJECT - CT 98-12/SDP 98-22 The following revisions are proposed to the staff report and Planning Commission resolutions for the above referenced project: 1. All references in the staff report to the affordable housing requirement for the project and the fractional unit for which a fee must be paid shall be changed from 2.64 dwelling units and a .64 credit to 2.55 dwelling units and a .55 credit. In addition, all references to the proposed project density should be changed from 3.1 dwelling units per acre to 3.45 dwelling units per acre. 2. The following findings from Municipal Code Section 21.90.045 should be added to Planning Commission Resolution No. 4549 (CT 98-12) to allow a project density of 3.45 dwelling units per acre: 20. The project is not required to provide additional public facilities for the density in excess of the control point to ensure that the adequacy of the City's public facilities plans will not be adversely impacted, in that public facilities are adequate in Zone 1 to accommodate the additional 1.2 units above the Growth Control Point. 21. There have been sufficient developments approved in the quadrant at densities below the control point to cover the units in the project above the control point so that approval will not result in exceeding the quadrant limit. 22. All necessary public facilities required by the Growth Management Ordinance will be constructed or are guaranteed to be constructed concurrently with the need for them created by this development and in compliance with adopted City standards. 3. The mitigation measure found on page 15 of the Environmental Impact Assessment Form - Part II and on the Mitigation Monitoring and Reporting Form both attached to Planning Commission Resolution No. 4548 should be revised by changing the last sentence to read as follows: "The Developer shall implement one or more of the mitigation measures identified in the report prior to the issuance of building permits should mitigation be necessary so as to reduce the impact below a level of significance." 4. Finding 10 (A) of Planning Commission Resolution No. 4549 should be replaced with the following finding: Land Use - The project is consistent with the City's General Plan since the proposed density of 3.45 du/ac is within the density range of 0 - 4 du/acre specified for the site as indicated on the Land Use Element of the General Plan, and is above the growth control point of 3.2 du/acre. Although the project exceeds the growth control point, it is consistent with the General Plan provision allowing an infill subdivision located in LFMP Zone 1 to exceed the density range and/or Growth Control Point in certain circumstances. Public facilities are adequate in LFMP Zone 1 to accommodate the proposed units and there are excess dwelling units in the northwest quadrant to ensure that the maximum number of dwelling units in the northwest quadrant would not be exceeded at buildout. 5. Finding 10 (C) of Planning Commission Resolution No. 4549 should be revised to replace ".64" with ".55" . 6.
