Box 1186 Carlsbad, California 92018-1186 Dear Mr, Hicks and Committee: Your letter of July 8,2000, expressing your concerns with regard to the Standard Pacific Development being processed adjacent to your community, has been forwarded to our office for response. The petition you delivered to the Mayor was forwarded to the Planning Department for consideration and inclusion in the record for the project. Standard Pacific Development is currently processing a Tentative Map and Planned Unit Development on both the north and south sides of Poinsettia Lane. The City's Municipal Code provides for a preliminary review of proposed applications by individual Council Members to inform them about a proposed development and obtain generalized feedback on its merits. Likewise, interested members of the public may meet with staff and review all Developer submittals to familiarize themselves with the project and voice their opinions to staff. No vote or action is taken by the City Council on the matter until it comes before the Council at a noticed public hearing. Prior to Council consideration, the application for Tentative Map and Planned Unit Development approvals must be considered by the Planning Commission at an open, noticed public hearing at which members of the public are invited to speak on the issues. I will deem your letter to the Mayor to be a request to include your name on the list of those to obtain individual notice of any public hearing scheduled for the Planning Commission concerning this development. Homeowners, with residences located within 600 feet of the proposed development will also be individually noticed. At the Planning Commission hearing, as well as the subsequent Council public hearing, you will have an opportunity to ask questions and voice your concerns prior to deliberation by the decision-makers. It would not be appropriate for the Commissioners or the Council to consider or respond to public input prior to that time. All votes by the Planning Commission and the City Council are "official" and are made in public at the public hearing. Prior to the public hearing, a staff report documenting the basis for staffs recommendations will be available for review upon request. I am informed by the Community Development Director that the history of the change in the proposed location of the affordable housing and RV storage locations to the parcel south of Poinsettia Lane was as follows. Concurrent with complaints being received from the Mariners Point homeowners about the location of the affordable housing and RV storage being in what they considered to be an already traffic congested area, the Community Development Policy Team, (consisting of the Community Development Director, the Planning Director, the Housing and Redevelopment Director, the Principal Engineer and the Principal Building Inspector) reviewed the proposed project to determine if the location of the affordable housing could be supported due to the fact that it was located in what appeared to be a "segregated" area from the remainder of the residential development. That team made a decision to recommend to Standard Pacific that it relocate its proposed affordable housing and RV storage to a more suitable location within the larger development. The team felt that the original location proposed was not acceptable due to its limited access, segregated appearance, and the fact that the RV storage area split the affordable town home project. In addition, the team felt that there were simply too many units being proposed for the single access cul-de-sac location and that it was not the best site in terms of circulation. Due to the concerns already expressed by residents of both your community and Mariners Point, and the need for sharing of accurate information, staff will be holding a public workshop to share the facts of the proposed project with the community before it is submitted to the Planning Commission or Council for action. Staff is currently working on an agenda and schedule for the subject workshop. You will be notified once that workshop is scheduled. It is currently anticipated that the Planning Commission will hear the matter in August, at the earliest, and that the Council will potentially hear the item in late September or early October. As for your impression that the City is obligated to inform prospective homeowners of Vista Pacifica that your subdivision might be "joined to another development" at sometime in the future, you should understand that the City has the authority to extend the public right-of-way upon development of vacant land. There are no guaranteed "boundaries" created by a street closure which are not subject to change as development progresses. The property adjacent to yours 6-21-01; 3.-42PM; ;7S043483t5/ has been designated for residential development by the City's General Plan for some time. It is the responsibility of prospective homebuyers to research any concerns they may have regarding future development prior to purchasing their homes. Please feel free to comment on the proposed development to Mike Grim, the planner for the project, or Clyde Wickham, the project engineer, throughout the process, and participate in the public hearings on the development.
