HomeMy WebLinkAboutCT 98-14; Thompson/Tabata; Tentative Map (CT) (20)March 4,2003 Brian Utsler Standard Pacific Homes 5750 Fleet St, Suite 200 Carlsbad CA 92008 SUBJECT: CT 98-14 - THOMPSONflABATA - AGRICULTURAL CONVERSION MITIGATION FEE Thank you for your correspondence regarding the agricultural conversion mitigation fee for the Thompsonflabata residential subdivision, located within the Zone 20 Specific Plan area. Staff has reviewed the applicable regulations regarding the mitigation fee, as well as the Zone 20 Specific Plan Environmental Impact Report (EIR) and project-specific constraints exhibits. As you know, the Mello II segment of the City’s Local Coastal Program (LCP) requires mitigation for the conversion of prime agricultural lands to development. The areas considered as prime agricultural lands are identified in the LCP and are reiterated in the Zone 20 EIR. A large portion, but not all, of the Thompsonflabata project site is located within a prime agricultural area known as Site Ill (please see attached map from the Zone 20 EIR). Upon review the project-related environmental impact assessment, the Coastal Development Permit resolution, and the project specific constraints exhibits, it appears that the analysis in the environmental impact assessment is correct. The total amount of prime agricultural lands requiring an agricultural conversion mitigation fee is 63 acres. As shown in the Coastal Development Permit approving resolution (Planning Commission Resolution No. 5078), the total mitigation fees required are based upon the fiscal year in which they are paid. Therefore, to mitigate the conversion of the 63 acres of prime agricultural lands, the total fee would be as follows: For fiscal year 2002-2003, at $7,220.50 per acre, total fee is $454,891 50; For fiscal year 2003-2004, at 7,942.55 per acre, total fee is $500,380.65; For fiscal year 2004-2005, at $8,736.05 per acre, total fee is $550,371.1 5; For fiscal year 2005-2006, at $9,609.73 per acre, total fee is $605,412.99; and For fiscal year 2006 and beyond, at $10,000 per acre, total fee is $630,000.
