Gray Gary & Freidenrich LLP 4365 Executive Drive, Suite 1100 San Diego, CA 92121-2133 "PERMISSION TO GRADE LETTER" AND SEPTIC ISSUES Dear Mr. Delany: Thank you for transmitting a copy of the Standard Pacific / Tabata Properties "Permission To Grade Letter" dated May 5, 2003. In contrast to this letter of permission we recall a letter from your office (dated February 20,2003) wherein you stated that the proposed grading adversely impacted the Tabatta's property. Issues of encroachment into septic fields, leech line reserve areas and Department of Health were raised in the letter. We assume by granting permission to grade over the same area of concern you have resolved your dispute and are satisfied with the design of Standard Pacific CT 98-14.
