Dear Mr. Wayne:
We are in receipt of your letter of October 14, 1998, and are requesting clarification of your determination
that our application for project approval must remain incomplete pending final action on our pending land
use applications.
The finding that the application must remain incomplete until land use approvals are final is not consistent
with the California Government Code in that this is not an item contained in the list of application
requirements required to be made available to applicants under Government Code section 65940. Section
65942 requires these lists to be current and accurate at all times. The Code also states that revisions cannot
be applied to applications that are submitted before anticipated revisions become effective.
The concurrent processing of applications requiring legislative actions with quasi- judicial actions is
consistent with the Permit Streamlining Act's (Government Code sections 65920 - 65963.1) intent to
expedite decisions on development projects. The City has consistently encouraged the concurrent
processing of applications of this type and is in fact continuing to process development proposals
concurrently with rezoning and general plan applications.
Therefore, it is requested that you reconsider your determination.
In the meantime we will be working on items that relate to your Government Code 65940 list in
anticipation of an early re submittal that will meet the requirements for a finding of completeness.
