This letter was submitted as a result of concerns expressed at the City Council meeting of May 22, 1990 at which time the Council was considering a five-lot subdivision called West Palm. The letter has been assigned to a staff member to prepare a report which will be scheduled for the earliest available Planning Commission meeting. The Commission would be considering whether to adopt a Resolution of Intention to set the matter to public hearing. MICHAEL J. HOLZMILLER Planning Director arb Attachment cc: Community Development Director Assistant Planning Director STEPHEN & CHERYL ELAINE 2755 WILSON STREET CARLSBAD, CA 92008 May 31, 1990 Michael Holzmiller Planning Director City of Carlsbad 2075 Las Palmas Drive Carlsbad, CA 92009 Re: Wilsonia Tract Downzone Dear Mr. Holzmiller: This letter is sent to formally request that the City Planning Commission pass a Resolution of Intent to call a public meeting to consider whether that portion of the Wilsonia Tract south of Forest, east of Highland and Arland Avenues, north of Buena Vista Drive and west of Wilson Street should be downzoned, from Rl-7500 to Rl-9500. A request was made, at the City Council's May 22, 1990 public hearing, to downzone the Wilsonia Tract from Rl-7500 to Rl-9500. Issues relating to a possible Resolution of Intent were referred to staff for further consideration. However, the City Council approved the West Palm tentative tract map 89-32 with net lot sizes less than 9,500 square feet, given that the West Palm tentative tract map had already been processed. The Council felt that the residents' request to downzone was made too late to fairly effect the West Palm subdivision. With the imminent development of the first extension of the James Court cul-de-sac north of Buena Vista Drive, and further considering the recent death of Gloria Gamble, Charlie Dix' apparent financial stress, and other neighborhood matters, it is clear that other action will soon be taken to further develop the Wilsonia Tract under the present zoning status. If immediate action is not taken, we will most certainly see the development of undersized lots completely out of character with the homes which presently exist in the neighborhood. 68-10A.ltr C 0Scores of neignLors signed our petition requt-oting a downzone. A downzone would cause our particular portion of the Wilsonia Tract to conform with the zoning status of the single family lots east of Wilson Street, with the undeveloped agricultural land immediately south of Buena Vista Drive, and with other tracts in the immediate vicinity. The majority of the residents of that tract, including my wife and I, feel it is very important that our request for a public hearing to discuss the possibility of a downzone be convened immediately. We do not want to be placed in the same position as we were with respect to the West Palm tentative tract map - that our request for a downzone was made too late to be applicable to developments which commence in the interim. Please contact me at your earliest convenience to further discuss the situation and the City's intentions.
