Dear Mr. Miltenberger:
As a follow up to our phone conversations I thought it would be appropriate to memoralize our
conversation for clarity and to formally address your requests.
1. The first request, for an advanced grading permit (received May 2, 2000), was presented to
the Community Development (land use) Committee made up of the Deputy City Engineer,
Planning Director, Community Development Director and Housing & Redevelopment
Director. The request was denied. The committee felt there was no direct and measurable
benefit for the City of Carlsbad in granting a grading permit ahead of the project design and
the final map approval. Typically the idea of an advance permit is reserved for large projects
bridges, surcharging, or abutments or for major arterials for the City.
With this decision in mind you should proceed, by the book in compliance with conditions of
approval and Municipal Codes.
2. The second request was for City support in the acquisition of public easements for street,
sewer, and water facilities. I have attached a standard form agreement for condemnation
and also a copy of the development processing guide applicable to this topic. Please review
the agreement and the guidelines and return the draft with all blanks filled in. / will
prepare the original copy to be executed on City Watermark. I believe the guide is clear
on the processing and timing that we can issue a permit.
