Dear Sirs:
This is a request that you condition your approval of
above L.C.P. and tenative tract map, as above. To the
following enumerated three issues.
1. Make provision for sever service for properties
northerly of subject parcel.
2. To preserve the westerly viev shed to the ocean/ any
structures of 2 stories be located on the western half of the
subject property.
3. Black Rail is presently developed to oooondar
standards and vill have to be up-graded to pgitmai-jPfeVfej. , entail-
Ing installation of shoulder pavement, sidewalks, curbs and gutters,
underground ing of utillities, landscaping, lighting etc. It is
self evident that piece-mealing a project effecting 16 parcels
would not be feasible.
Construction of Black Rail Road over the past five years
has been a comedy of errors, with Aviara mislocating 2, 18"
water pipes in a S.D. G. & E. easement and contant controversary
and litagation over covenants and survey datd;
It is herein recommended that parcels 1-6 in section 27 be the
responsibility of Hillman Properties West, Western Homes, and
Brehm-Aviara III Development Assn. LP. to design, construct and
finance.
and
parcels 7 to 16 in Fract. Section 22 be the responsibility of
Spectrum Communities, Galagher, Kaiser and De Jong, to design,
construct and finance.,
