Reference: "Preliminary Geotechnical Investigation, Twelve Lot Subdivision,
Northeast of Hillside Drive and South of James Drive, Carlsbad,
California," by Hetherington Engineering, Inc., dated August 8, 1989.
Dear Ms. Russell:
In accordance with your request, we are providing this update to our previous
geotechnical investigation (Reference 1). A recent site reconnaissance indicates that the
property is in a generally similar physical condition as during our previous work. The
approximate 4.28 acre parcel is presently barren of structures and covered by a moderate
and locally dense growth of weed variety plants and grasses. Some areas of the property
have experienced varying amounts of erosion since our report. Further, it appears that
some additional materials have been stockpiled along the general east-central portion of
the site east of the drainage channel that traverses the property. The geotechnical
conclusions and recommendations presented in our original report (Reference 1) remain
applicable for site development. A grading and foundation plan review should be
performed by the geotechnical consultant when plans have become finalized in order to
confirm conformance with the geotechnical recommendations presented in our original
report (Reference 1) or to modify those recommendations as necessary.

AGREEMENT
We, the undersigned, hereby certify that we are the owners of APN 207-130-22, the land north of Hall
Investment Company, Inc.'s property and further certify that we have reviewed the proposed grading plan
and do hereby grant to the owners of said land or their agents permission to grade for construction of
James Drive together with construction of slope as shown on said plans within the limits of the above
described areas.
It is understood that all grading shall be done in accordance with prevailing regulations of the City of
Carlsbad and from plans approved by said City of Carlsbad.
It is further understood that all costs incurred for construction qf the grading shall be paid by the owners
of said Hall Investment Company, Inc. project. The owners of APN 207-130-22 will not be responsible
for any reimbursement costs to Hall Investment Company, Inc. for the improvements completed under the
City approved plans for Hall Investment Company, Inc.
Hall Investment Company, Inc. will provide a copy of the final compaction report for the grading work
performed on the property described as APN 207-130-22 to the Rombotis Bros.
Any fence removal on the property described at APN 207-130-22 which is required for said grading and
improvements shall be removed and replaced in its entirety by Hall Investment Company, Inc. All costs
associated with said fencing shall be the responsibility of Hall Investment Company, Inc.
All existing deeds and easements signed by the owner:; of property APN 207—130-22 which are recorded
with the County of San Diego shall remain in effect as required by the City of Carlsbad for the grading
and improvements noted herein.
We do further agree to hold the City of Carlsbad free and clear on any damages arising from said
construction and will permit employees of said City of Carlsbad to enter upon the premises to do
inspection as may be required.

AGREEMENT

(formerly APN 207-022-18), the land easterly of Hall Investment Co., Inc.'s property and further certify
that we have reviewed the proposed grading plan and do hereby grant to the owners of said land or their
agents permission to grade for construction of James Drive together with construction of slope as shown
on said plans within the limits of the above described areas.
It is understood that all grading shall be done in accordance with prevailing regulations of the City of
Carlsbad and from plans approved by said City of Carlsbad.
It is further understood that all costs incurred for construction of the grading shall be paid by the owners
of said Hall Investment Co., Inc. project. The owners of APN 207-022-59 and APN 207-022-60 will not
be responsible for any reimbursement costs to Hall Investment Company, Inc. for the improvements
completed under our approved plans.
We do further agree to hold the City of Carlsbad free and clear on any damages arising from said
construction and will permit employees of said City of Carlsbad to enter upon the premises to do

Investment Company, Inc.'s property and further certify that we have reviewed the proposed grading plan
and do hereby grant to the owners of said land or their agents permission to grade for construction of
James Drive together with construction of slope as shown on said plans within the limits of the above
described areas.
It is understood that all grading shall be done in accordance with prevailing regulations of the City of
Carlsbad and from plans approved by said City of Carlsbad.
It is further understood that all costs incurred for construction of the grading, street curb, gutter and
sidewalk shall be paid by the owners of said Hall Investment Company, Inc. project. The owners of APN
207-022-04 will not be responsible for any reimbursement costs to Hall Investment Company, Inc. for the
improvements completed under the City approved plans for Hall Investment Company, Inc.
Any existing fence removal on the property described at APN 207-022-04 which is required for said
grading and improvements shall be removed and replaced in its entirety by Hall Investment Company,
Inc. All costs associated with said fencing shall be the responsibility of Hall Investment Company, Inc.
Hall Investment Company, Inc. will install a sewer lateral to the property line of property APN 207-022-
04 at the same time the improvements are installed on James Drive. All costs associated with the
installation of this sewer lateral will be paid by Hall Investment Company, Inc.
Hall Investment Company, Inc. will install a curb cut at James Drive to the property APN 207-022-04 and
will provide a graded pad area on the property for access in and out of the property for the RV motor
home.
We do further agree to hold the City of Carlsbad free and clear on any damages arising from said
construction and will permit employees of said City of Carlsbad to enter upon the premises to do
inspection as may be required.

limits of the above described areas.
It is understood that all grading shall be done in accordance with prevailing regulations of the City of
