Inc Please describe fully the proposed project. Include any details necessary to adequately explain the scope and/or operation of the proposed project. You may also include any background information and supporting statements regarding the reasons for, or appropriateness of, the application. Use an addendum sheet if necessary. Description/Explanation. The development of 9 single family homes on a 3.97 acre infill site located in Local Facilities Management Zone 1, located on Seaview Way, north of Chestnut Drive. This project includes an application for a Tentative Subdivision Map, Hillside Development Permit, Site Development Plan and an Environmental Impact Assessment. The site was previously used for agricultural purposes and therefore does not contain environmentally sensitive material. STATEMENT OF AGREEMENT TENTATIVE SUBDIVISION MAP CITY OF CARLSBAD The Subdivision Map Act and the Carlsbad Municipal Code sets a fifty (50) day time restriction on Planning Commission processing of Tentative Maps and a thirty (30) day time limit for City Council action. These time limits can only be extended by the mutual concurrence of the applicant and the City. By accepting applications for Tentative Maps concurrently with applications for other approvals which are prerequisites to the map; i.e., Environmental Assessment, Environmental Impact Report, Condominium Plan, Planned Unit Development, etc., the fifty (50) day time limits and the thirty (30) day time limits are often exceeded. If You wish to have your application processed concurrently, this agreement must be signed by the applicant or his agent. If you choose not to sign the statement, the City will not accept your application for the Tentative Map until all prior necessary entitlements have been processed and approved. The undersigned understands that the processing time required by the City may exceed the time limits, therefore the undersigned agrees to extend the time limits for Planning Commission and City Council action and fully concurs with any extensions of time up to one year from the date the application was accepted as complete to properly review all of the applications. Either Trustors' separate property transferred to the trust shall be called the "separate trust estate" with reference to the contributing Trustor. By designating the property as community, the Trustors are confirming its community character or are intentionally transmuting separate property into community property. 1.4 Addition of Property: Other property acceptable to the Trustee may be added to the trust at any time, by Trustor or any other person, either during their lifetime or at death; such additional property upon its receipt and acceptance by Trustee, shall become a part of the trust estate. 1.5 Purpose: The purpose of this trust is to provide for the Trustors' health, education, support, maintenance, comfort, welfare and happiness to the fullest extent possible. The Trustee's goal shall be to preserve and if possible enhance the Trustors' standard of living. The avoidance of probate, the reduction of death taxes and providing for the residuary Beneficiaries, although important, are secondary. 1.6 Allocation of Trust Estate: The Trustee shall initially allocate the trust estate to the "Trust During Trustors1 Joint Lives". 12.11 Trust Assets Not To Be Commingled: If the Trustee receives government assistance benefits on Beneficiary's behalf, the Trustee shall collect, expend, and account for those benefits separately from, and not commingle them with, all other assets of this Trust. 12.12 Unproductive Property:The Trustee shall have the power to retain, purchase, or otherwise acquire underproductive property not withstanding any other duty of the Trustee as required by law or elsewhere stated in this Trust and instrument if, the Trustee, in its sole discretion determines such retention or Acquisition is appropriate. 12.13 Income Production: The Trustee shall have the power in its sole discretion, notwithstanding other provisions contained in this Trust, to purchase and acquire assets that produce minimal income and/or nontaxable income should the Trustee in its sole discretion determine that such purpose carries out the duties of this Special Needs Trust. 12.14 Compensation: Because of the demanding duties and responsibilities that this trust requires, the Trustee is named as the residual beneficiary in lieu of extra compensation. EXECUTION AND ACKNOWLEDGMENT The Trustors certify that the Trustors have read the foregoing Declaration of Trust and that it correctly states the terms and conditions under which the Trustee is to hold, manage, and distribute the trust estate.
