The Planning Department recommends that the easements on the Seaview properties should
be re-recorded showing that the HOA is responsible for the maintenance of the affected slopes
and drainage system. The conditions of approval required dedication of an open space
easement on the affected slopes, which was done, and requires that the open space easement
and drainage system shall be privately owned and privately maintained by the HOA.
The slope is in fair shape with some weeds present. I noticed that there are some areas where
homeowners have built small crib walls to support fruit trees in the OS easement area. The
slope does not have a uniform appearance as would be typical for a slope maintained by an
HOA.
It is my understanding that the owners each maintain their own slope and I do not know if it is
acceptable for the "HOA" to designate maintenance responsibilities to the individual property
owners. To my knowledge, there have been no complaints with regard to slope or drainage
facilities maintenance. At this time, Planning would not take enforcement action to require
removal of any trees or crib walls that have been planted in the OS easement area, particularly
because the OS easement was not for habitat preservation or for fire suppression.
