HomeMy WebLinkAboutCT 99-01; Carlsbad Beach Estates; Tentative Map (CT) (31)CARLSBAD BEACH GROUP INVESTORS, LLC 2171 El Camino Real, Suite 202, Oceanside, CA 92054 Tel: (760)721-6499 Fax: (760)721-6498 June 30, 2000 City Council of Carlsbad 1200 Carlsbad Village Drive Carlsbad, CA 92008 Re: Carlsbad Beach Estates CT 99-01 Dear Mayor and Council Members: Carlsbad Beach Group Investors, LLC, request the 5 lot subdivision (CT99-01) has been or should be released from "Old Carlsbad" moratorium (NS-516) for the following reasons: I. The tentative map was approved by the Planning Commission on March 15, 2000. There was no condition placed on permits regarding the "Old Carlsbad Moratorium". The project was approved because it conforms to, and enhances, the residential neighborhood. Chinquapin Avenue is a fully developed street, including City standard concrete curbs and sidewalks, from Garfield Avenue (800 feet +/-) east to the railroad tracks, where it terminates. There are no future needs or plans to change the current street improvements. II. The City's street and sidewalk Report Committee made it's presentation to the City Council on March 7, 2000. The Carlsbad Beach Estates Project CT 99-01 was excluded from the Committee's review and discussion. Since this portion of Chinquapin Avenue is fully developed with concrete curbs and sidewalks and according to table 1 of the report, is listed as a compatible improvement, and is consistent with current City standards or compatible in width and configuration with improvements already installed in the block. Therefore, since the Committee did not consider Carlsbad Beach Estates and there are no changes, (either recommended or contemplated for this section of Chinquapin Avenue from the standard city improvements in place), our project is, or should be exempt from the moratorium. III. We are H. David Buckmaster and Patricia A. Buckmaster, principals of Carlsbad Beach Group Investors, LLC with approximately 85% of our net worth comprised of this project. We currently reside at 265 Chinquapin Avenue and we plan to make this area our permanent home. Any delays will place an unfair hardship on our financial well being. Commencement of this project would have no affect on the Committee's report nor the implementing ordinances that will flow from the Committee's report, as accepted by the Council. The approval of issuance of permits, as designed, will not affect any determination, based upon the Committee and staff's actions. Based on all the above, we hope that our project is exempt.
