Unfortunately, I did not receive the letter in the mail. However, your contractor, Mr. Jeff Piva, was kind enough to fax it to me yesterday. Mr. Piva expressed that you would like to continue with construction of the buildings and do not want to be delayed while the wall issues are being resolved. I can understand this concern. Mr. Piva also indicated that you have reduced the height of the wall and that the sight distance concerns have been addressed. Therefore, Planning and Engineering staff have agreed that because the sight distance issues related to the wall have been corrected, that the stop work order may be lifted. However, there are still outstanding issues related to the walls that will need to be resolved prior to obtaining final occupancy for the residences. Wall on Carlsbad Boulevard As I noted in my letter dated December 22, 2004, that in order to comply with the Planned Development Ordinance, the wall located along Carlsbad Boulevard must be relocated so that it is set back 10 feet from the front property line. The only way to allow the wall closer to the street is to apply for a Variance to the development standards. The fee for a Variance is $2,140.00 plus noticing costs. The Variance requires approval by the Planning Commission. Staff would not support the Variance request since there are no unique circumstances applicable to the property that would prevent you from complying with the standards. Wall on Juniper Street The landscape buffer/wall setback requirements on Carlsbad Boulevard do not apply to the wall located along Juniper Street. In order to approve construction of the wall on Juniper Street, you will need to obtain approval of a Consistency Determination from the Planning Department. The fee for this application is $530 and the form was included as an attachment to my previous correspondence.
