SUPPLEMENTARY DECLARATION
OF LA COSTA OAKS
THIS SUPPLEMENTARY DECLARATION OF LA COSTA OAKS ("Supplementary
Declaration") is made by REAL ESTATE COLLATERAL MANAGEMENT COMPANY, a
Delaware corporation ("Declarant")> °n ^€^f-f^*-J"-r £ 3. £c£/7 with reference to
the facts set forth below.
RECITALS
A. Declarant caused to be filed for record on June 27, 2003, in the Official Records-
of San Diego County, California, as Instrument No. 2003-0765993, that certain Declaration of
Covenants, Conditions and Restrictions of La Costa Oaks, and re-recorded September 30, 2003
as Instrument No. 2003-1200575 (collectively, the "Declaration"). Except as may otherwise be
defined herein, all capitalized terms used herein shall have the meanings set forth in the
Declaration.
B. Pursuant to Section 12.7 of the Declaration, prior to annexation, Declarant may,
upon recordation of a Supplementary Declaration, delete any portion of the Additional Property
by so designating such portion of land to be excluded from the Additional Property in a
Supplementary Declaration.
C. Declarant is the sole Owner of all of the real property described on Exhibit "A"
attached hereto and incorporated herein ("Property") which has not been annexed into the
Declaration.
D. Declarant desires to exclude the Property as a portion of the Additional Property.
E. The City herein provides its consent to the exclusion of the Property as Additional
Property. Such consent is attached hereto and recorded concurrently herewith

NOW THEREFORE, Declarant declares as follows:
1. Deletion of Additional Property. Upon the recordation of this Supplementary
Declaration in the Office of the Recorder of San Diego County, the Property shall be excluded
from the definition and designation of Additional Property as described in the Declaration.
IN WITNESS WHEREOF, this Supplementary Declaration has been executed as of the
date first above written.
