RE : CT 99-08 - SPYGLASS II
Dear Mr. Ugar:
This letter is in regards to the two documents, Notice of Restriction and Notice and
Waiver Concerning Transportation, that were signed by yourself in September of
this year. The documents have been returned by our Attorney’s office because
there is a concern that you are unable to sign for LB/L Concordia Carlsbad 19 LLC.
Your signature represents the operating manager of LB/L Concordia Carlsbad 19,
LLC which is Concordia Communities LLC. The operating agreements provided do
not include the operating agreement for Concordia Communities LLC that would
show your ability to sign for the company.
There are a couple of ways I’m told that this can be rectified. The first option is to
add, (on the signature page) after (Name of Owner) LB/L Concordia Carlsbad 19,
LLC, “by Initial Member, LB/L Concordia Master LLC.” The second option is to
have Mr.‘s Andrews or Lee sign the documents as the operating agreements
provided allow either of them to singularly represent the company.
Please find the original documents and another.set of blank originals for your use.
