Regretfully, we must decline your request made. We do not wish our property to be encroached upon in any manner, nor do we want the land altered or any dirt removed. 1 suggest you take care of all essential matters, including the temporary brow ditch, within your own property line. We feel that this is the obligation of your development company and the ditch should not infringe on our property. Yamamoto, Doris Yamamoto, and Adolfma Yamamoto: Western Pacific Housing is in the process of resubmitting a proposal to develop the Buerger Property located directly to the south of your parcel. The project proposal consists of subdividing the land and constructing twelve detached single-family homes. The purpose of this letter is to request permission to install a temporary brow ditch on the south side of your Carlsbad Property, APN 215-040-05. During the course of processing this plan, meetings were held with the City of Carlsbad to discuss issues related to adjacent property owners. The site design has been modified several times in order to comply with city engineering standards. In order to develop the Buerger Property, Western Pacific will need a temporary brow ditch to be graded and installed offsite along the southern boundary of your property to collect runoff from your property and divert it to Black Rail Road and the canyon to the east (attachment 1). The proposed temporary brow ditch will be constructed according to the Regional San Diego Standards for Drainage Ditches D-75 (attachment 2), and would remain as long as your property is undeveloped. We are in the process of preparing the legal easement documentation which would grant Western Pacific Housing the right to install and maintain a temporary brow ditch on APN 215-040-05. This documentation will be forwarded to you for your review within the upcoming month. However, in order to continue processing our plans through the City and to proceed with our design according to City Standards, a letter of permission to install the temporary brow ditch is necessary. The permission would be granted based on the preliminary design of the temporary brow ditch, subject to your approval of the final design and engineering prior to the execution of final agreements. A letter of permission granting preliminary approval is included for your consideration (attachment 3).
