HomeMy WebLinkAboutCT 99-10; Buerger; Tentative Map (CT) (53)February 21, 2001 TO: PLANNING COMMISSION FROM: ASSOCIATE PLANNER RE: ERRATA SHEET FOR CT 99-10 - BUERGER SUBDIVISION Revise Planning Commission Resolution Number 4767, to modify Condition Number 24 as follows: "The Developer shall dedicate Lot 13 to the Homeowner's Association and an open space easement for Lot 13 to prohibit any development, including but not limited to fences, walls, decks, storage buildings, pools, spas except as shown on Exhibit "F", dated February 21, 2001 and as allowed by the SDG&E easement." Revise Planning Commission Resolution Number 4767, to add a condition as follows: "Prior to approval of the final map, the Developer shall provide an irrevocable offer of dedication to the City of Carlsbad for a trail easement for trail(s) shown on the tentative map within Open Space Lot(s) 13. Prior to the issuance of any building permits, the trail shall be constructed as a public trail for public use and accepted by the City of Carlsbad upon adoption of a Citywide Trails Program that includes provisions for maintenance and liability. Otherwise, prior to issuance of any building permits, the obligation for acceptance, construction, maintenance, and liability shall be the responsibility of another agency designated by the City or the responsibility of the Homeowner's Association." Revise Planning Commission Resolution Number 4767, to add a condition as follows: "Prior to issuance of a grading permit, the applicant shall submit to the Planning Department a recorded copy of a right-of-way use agreement with San Diego Gas and Electric and a letter of permission for grading and construction of improvements from San Diego Gas and Electric for the proposed encroachments into the existing easement for the grading and construction of the improvments." Revise Planning Commission Resolution Number 4767, to delete Condition Number 46 (Redundant to Condition Number 22). VAN LYNCH VL
