The Planning Director has completed a review of your application for a consistency
determination ,for the revision of the approved, yet not constructed, banquet room to an
extension of the existing dining patio, (APN: 211-021-31). After careful consideration of the
circumstances surrounding this request, the Planning Director has determined that the
application qualifies for a consistency determination with the approved permit and therefore,
approves the changes to the project based on Planning Director Administrative Policy No. 35.
The plans which were submitted for the determination will be stamped as "Consistency
Determination" exhibits and retained on file. The City is retuning one set to you for your
records. Future building permits will be reviewed for consistency with the revised plan .

SUBJECT: PRE 01-09 -KINGS FISH HOUSE

A preliminary review of your project was conducted on February 28, 2001. Listed
below are the issues raised by staff. Please note that the purpose of a preliminary
review is to provide you with direction and comments on the overall concept of
your project. The preliminary review does not represent an in-depth analysis of
your project. Additional issues of concern may be raised after your application is
submitted and processed for a more specific and detailed review.
Planning:
1 . Overall, Staff is supportive of the design concept and restaurant use
proposed. Please find below a list of items that will need to be addressed
with a formal project submittal to the City.
2. The project will require the processing of; a Conditional Use Permit pursuant
to the Commercial/Visitor overlay zone; A Coastal Development Permit, as
the site is located in the coastal zone; and a Site Development Plan
Amendment will be needed to reconfigure the parking lot of the adjacent
Holiday Inn project site.
3. A study should be done for the reconfigured Holiday Inn parking lot with the
total number of parking spaces provided and required to show that the
redesign will work and meet the parking demand of the hotel. The parking
lot will need to adhere to the same development/design standards as the
restaurant parking lot. Shared parking with the hotel is not allowed.
4. Please review the Commercial/Visitor section of the Carlsbad Municipal code
(21 .208), which provides the development standards for this project site.
Specifically:

a. Provide required parking in the ratios provided in the code (i.e. restaurant,
outdoor dining areas). The outdoor dining area, if enclosed and heated,
will be considered a part of the main restaurant area and not parked as
outdoor dining.
b. The site will not be considered a freeway service facility. The maximum
amount of signage allowed will be one square foot for every lineal foot of
building frontage, or 101 square feet. The sign on the south elevation,
directly facing the Interstate 5 freeway, will be prohibited. The City is
currently reviewing the prohibition of exposed neon signs, which may
affect the sign over the outdoor dining area.
c. The building's stucco wall areas will be visible from Paseo Del Norte and
the Interstate 5 freeway. This component of the elevations should have
additional wall treatment or texture. The addition of brick veneer as the
rest of the building, brick veneer columns, faux brick infill windows,
and/or landscaping such as climbing vines are some suggestions.
d. The landscape plan shall incorporate the landscape design elements of the
overlay zone. The monument sign should show the Bird-of-Paradise and
Palm tree plantings as required.
e. Landscaping should be incorporated into the striped paved areas, which
occur at the corners of the parking areas adjacent to the building.
f. Please provide number of trees per parking space on the landscape plan
(one tree per six parking spaces minimum required). Additional
landscaped parking islands may need to be provided to meet the
requirement and break up long sections of parking spaces.
g. The parking areas shall be screened from public view (streets and
freeway) by the use of 42-inch high screen walls. The screen walls shall
be architecturally finished to complement the project's architecture.
Engineering:
SIGNIFICANT ISSUES
1. Existing and proposed lot lines must be more adequately defined. For
example, the proposed lot lines probably do not go all the way across

Paseo Del Norte (PON), they probably end at the centerline. Are
additional lots being added? If they are, then a tentative and final map
will be required for the project.
2. The preliminary review application included a transmittal indicating that
street vacation is being requested at this time. A street vacation at the
preliminary review stage of a project is premature. Additionally, if the
project proposes mapping of the property, any requested street
vacations/abandonment and easement quitclaims can be accomplished on
the final map. Therefore, if a street vacation has been officially
submitted please withdraw it.
3. Please indicate the project's proposed Average Daily Traffic (ADT).
Additionally, submit documentation comparing the project's proposed
ADT with that which was approved in the most recent approved traffic
report for the area (i.e., Carlsbad Company Store report, and/or the KAKU
Legoland/Carlsbad Ranch report). Please be advised, if the project's
proposed ADT is greater than what was assumed in the previous reports,
then a traffic report will be required for the project.
4. Please submit a preliminary striping plan for PON. Include all "legs" of
the public street/private driveway intersections.
5. Major utility relocations are required to be constructed with this proposed
project. Therefore, please actually show the relocated water
lines/utilities. Show the relocated water lines/utilities within a paved on-
site drive aisle (not just a proposed 20 water line easement within the
parkway), with either a general utility and access easement or water line
easement over it, whichever is applicable.
6. Please indicate how National Pollutant Discharge Elimination System
(NPDES) criteria will be met. This could include, but not be limited to,
doing one or a combination of the following: directing surface run-off
through vegetated swales prior to discharge to a storm drain or the public
right of way, constructing a gravel/sand filter system, constructing de-
pollutant basins, numeric sizing, etc.
Comprehensive pollutant mitigations measures must be proposed with
this project. These measures should include the Pea Soup Andersen's
parking lot, and, the proposed parcels to the north of the project. The
project may be able to take advantage of an existing sump/pump facility
at the southwesterly corner of Pea Soup Andersen's.
Additionally, the proposed project falls under the statutory requirements
of San Diego Regional Water Quality Control Board (SDRWQCB) Tentative
Order No. 2001-01, which was adopted on February 21, 2001.
Attached, for your use, are applicable provisions of that Order.

Finally, please be advised that pre and post construction Storm Water
Pollutant Prevention Plans (SWPPP) will be required for this project.
ISSUES
1 . Please submit documentation from Caltrans and all effected utilities that
they are aware of, and concur with the proposed project.
2. Please indicate all existing and proposed street improvements and utilities
(i.e., concrete curb, gutter & sidewalk, storm drain, potable and reclaimed
water, sewer, street light standards, fire hydrants, etc.) for on-site and
off-site along PDN. Indicate gravity flow sewer facilities with inlet
elevations. Indicate on-site and off-site surface drainage and storm drains
with inlet and out-fall elevations.
3. Clear Caltrans Corner Sight Distance sight lines of a minimum of 440'
must be met at the PON/project intersections. Any vegetation, walls,
monument signs, structures, etc. must be located out of these sight lines.
Also, sight distance should be met at all on-site drive aisle intersections.
Upon formal application submittal, sight distance requirements must be
indicated on the site plan tentative map and landscape plan.
4. Raised planted islands should be used to delineate drive aisles and parking
radii, rather than striping.
5. Please show any additional existing intersections/driveways along PDN.
6. Please Provide a Vicinity Map on the site plan.
7. Show a typical street section for PDN. Indicate that the street is public
and show the existing and proposed improvements on the typical section.
8. Please add proposed handicap ramps at the project entrance curb returns.
9. Are there any existing overhead utilities located within or adjacent to the
property? If so, please indicate that the project will underground the
utilities.
10. Please indicate the amount of grading proposed for the project in cubic
yards of cut/fill and import/export. Show existing and proposed
topography and any slopes and retaining walls (with top & bottom of wall
height).
11 . Show proposed drainage patterns for the site.
12. A recent Preliminary Title Report (PR) (issued within 6 months of formal
application submittal) will be required for the proposed project.
13. Please include the A.LT.A. Survey as part of the formal application
submittal, on 24" x 36" sheets. Show all applicable easement and

encumbrance information, as identified in Schedule 'B' of the PR, on the
actual project site plan. The future disposition of all easements and
encumbrances must also be identified.
14. The complete property boundary, as identified in the PR, must be shown
on the site plan, including bearings and distances.
15. Please indicate how a 42' radius truck (Caltrans 407-E) will circulate from
PON throughout the site.
16. The proposed project must include designated loading zone, unless
deliveries will be provided after business/patron hours of operation.
Therefore, please either show a designated loading zone or supply
documentation of (authentic) delivery times.
17. Please provide 5' offsets at proposed parking stalls that are located 90°
adjacent to each other.
18. Adequate queuing area must be shown at the project driveway before
impacting the proposed north/south on-site drive aisle. Generally 20 feet
of queuing must be provided for each 1 000 ADT from the back of the
PON sidewalk.
19. Indicate the appropriate utility service areas this proposed project falls
under (e.g., Carlsbad Municipal Water District, SDG&E, etc.).
20. Reciprocal access and maintenance, and drainage easements will
probably be required. Please indicate them on the site plan and tentative
map.
21. Please indicate all existing and proposed utilities (i.e., storm drain, water,
sewer, etc.) for on-site and off-site along PON.
22. Indicate gravity flow sewer facilities with inlet elevations. Show inlet
elevations for proposed storm drain facilities also.
23. Are the three (3) driveways located north of the proposed project existing
or proposed? If they are proposed, make sure that intersection spacing is
in accordance with City Standards.
24. Please indicate all existing and proposed improvements in plan view.
25. Please fully dimension the site plan and tentative map.
26. Please submit a hydrology report at formal application submittal. Since
the project is located within the California Coastal Commission, Mello II
jurisdictional boundary, post developed off-site runoff for a 10-year/6-
hour storm event cannot be increased.
27. Please make sure that all changes that are made on one plan, are made
on all applicable plan sets.

review of the proposed project, additional items of concern may be
identified upon formal project application submittal.

4. Please submit a preliminary striping plan for Paseo Del Norte (PON). Include all "legs" of
the public street/private driveway intersections.
5. Major utility relocations are required to construct this proposed project. Therefore,
please actually show the relocated water lines/utilities. Show the relocated water
lines/utilities within a paved on-site drive aisle (not just a proposed 20 water line
easement within the parkway), with either a general utility and access easement or water
line easement over it, whichever is applicable.
6. Please indicate how National Pollutant Discharge Elimination System (NPDES) criteria
will be met. This could include, but not be limited to, doing one or a combination of the
following: directing surface run-off through vegetated swales prior to discharge to a storm
drain or the public right of way, constructing a gravel/sand filter system, constructing de-
pollutant basins, numeric sizing, etc.
Comprehensive pollutant mitigations measures must be proposed with this project.
These measure should include the Pea Soup Andersen's parking lot, and, the proposed
parcels to the north of the project. The project may be able to take advantage of an
existing sump/pump facility at the south westerly corner of Pea Soup Andersen's.

Additionally, the proposed project falls under the statutory requirements of San Diego
Regional Water Quality Control Board (SDRWQCB) Tentative Order No. 2001-01, which
was adopted on February 21, 2001. Attached, for your use, are applicable provisions of
that Order.
Finally, please be advised that pre and post construction Storm Water Pollutant
Prevention Plans (SWPPP) will be required for this project.
ISSUES
1 . Please submit documentation from Caltrans and all effected utilities that they are aware
of, and concur with the proposed project.
2. Please indicate all existing and proposed street improvements and utilities (i.e., concrete
curb, gutter & sidewalk, storm drain, potable and reclaimed water, sewer, street light
standards, fire hydrants, etc.) for on-site and off-site along PON. Indicate gravity flow
sewer facilities with inlet elevations. Indicate on-site and off-site surface drainage and
storm drains with inlet and out-fall elevations.
3. Clear Caltrans Corner Sight Distance sight lines of a minimum of 440' must be met at the
PON/project intersections. Any vegetation, walls, monument signs, structures, etc. must
be located out of these sight lines. Also, sight distance should be met at all on-site drive
aisle intersections. Upon formal application submittal, sight distance requirements must
be indicated on the site plan tentative map and landscape plan.
4. Raised planted islands should be used to delineate drive aisles and parking radii, rather
than striping.
5. Please show any additional existing intersections/driveways along PON.
6. Please Provide a Vicinity Map on the site plan.
7. Show a typical street section for PON. Indicate that the street is public and show the
existing and proposed improvements on the typical section.
8. Please add proposed handicap ramps at the project entrance curb returns.
9. Are there any existing overhead utilities located within or adjacent to the property? If so,
please indicate that the project will underground the utilities.
1 O. Please indicate the amount of grading proposed for the project in cubic yards of cut/fill
and import/export. Show existing and proposed topography and any slopes and

Please find attached a set of plans for the proposed King's Fish House
Restaurant for your review and comment. The project is located north of
Palomar Airport Road and West of Paseo Del Norte, across from the Company
Stores and north of Holiday Inn within the CommercialNisitor-serving overlay
zone. Pprojects are routed to you for review and comments. As you will recall,
you saw the colored elevations in my office the other day. They can be made
available to you if you wish to review or present them along with the plans.
This project is proposing an Alternative Architectural style rather than the Village
or Contemporary Southwest Architectural style. This alternative architectural
style may accommodate a reasonable version of a user's corporate architectural
style, provided the corporate architectural elements do not dominate the building
design so as to create incompatibility in the area; or detract from the overlay
zone's objective of ensuring high quality appearances for commercial/visitor-
serving uses. Final approval of the proposed alternative architectural style is by
the city council as part of the conditional use permit review.

STATE CEQA GUIDELINES, Chapter 3, Article 5, Section 15063 requires that the City
conduct an Environmental Impact Assessment to determine if a project may have a significant
effect on the environment. The Environmental Impact Assessment appears in the following
pages in the form of a checklist. This checklist identifies any physical, biological and human
factors that might be impacted by the proposed project and provides the City with information to
use as the basis for deciding whether to prepare an Environmental Impact Report (EIR), Negative
Declaration, or to rely on a previously approved EIR or Negative Declaration.
• A brief explanation is required for all answers except "No Impact" answers that are
adequately supported by an information source cited in the parentheses following each
question. A ''No Impact" answer is adequately supported if the referenced information
sources show that the impact simply does not apply to projects like the one involved. A
"No Impact" answer should be explained when there is no source document to refer to, or
it is based on project-specific factors as well as general standards.
• "Less Than Significant Impact" applies where there is supporting evidence that the
potential impact is not adversely significant, and the impact does not exceed adopted
general standards and policies.
• "Potentially Significant Unless Mitigation Incorporated" applies where the incorporation
of mitigation measures has reduced an effect from "Potentially Significant Impact" to a
"Less Than Significant Impact." The developer must agree to the mitigation, and the
City must describe the mitigation measures, and briefly explain how they reduce the

• An EIR must be prepared if "Potentially Significant Impact" is checked, and including

·DISCUSSION OF EN(~lONMENTAL EVALUATION
Please use this area to discuss any of the environmental factors that were checked "No impact"
yet lack any information citations and any factors that were checked "Potentially Significant
Impact" or "Potentially Significant Impact Unless Mitigation Incorporated." The City has
adopted a "Statement of Overriding Consideration" with regard to air quality and circulation
impacts resulting from the normal buildout according to the General Plan. The following sample
text is intended to guide your discussion of the impacts to these environmental factors.
AIR QUALITY:
The implementation of subsequent projects that are consistent with and included in the updated
1994 General Plan will result in increased gas and electric power consumption and vehicle miles
traveled. These subsequently result in increases in the emission of carbon monoxide, reactive
organic gases, oxides of nitrogen and sulfur, and suspended particulates. These aerosols are the
major contributors to air pollution in the City as well as in the San Diego Air Basin. Since the
San Diego Air Basin is a "non-attainment basin", any additional air emissions are considered
cumulatively significant: therefore, continued development to buildout as proposed in the
updated General Plan will have cumulative significant impacts on the air quality of the region.
To lessen or minimize the impact on air quality associated with General Plan buildout, a variety
of mitigation measures are recommended in the Final Master EIR. These include: 1) provisions
for roadway and intersection improvements prior to or concurrent with development; 2) measures
to reduce vehicle trips through the implementation of Congestion and Transportation Demand
Management; 3) provisions to encourage alternative modes of transportation including mass
transit services; 4) conditions to promote energy efficient building and site design; and 5)
participation in regional growth management strategies when adopted. The applicable and
appropriate General Plan air quality mitigation measures have either been incorporated 1into the
design of the project or are included as conditions of project approval.
Operation-related emissions are considered cumulatively significant because the project is
located within a "non-attainment basin", therefore, the "hritial Study" checklist is marked
"Potentially Significant Impact". This project is consistent with the General Plan, therefore, the
preparation of an EIR is not required because the certification of Final Master EIR 93-01, by City
Council Resolution No. 94-246, included a "Statement Of Overriding Considerations" for air
quality impacts. This "Statement Of Overriding Considerations" applies to all subsequent
projects covered by the General Plan's Final Master EIR, including this project, therefore, no
further environmental review of air quality impacts is required. This document is available at the
Planning Department.
CIRCULATION:
The implementation of subsequent projects that are consistent with and included in the updated
1994 General Plan will result in increased traffic volumes. Roadway segments will be adequate
to accommodate buildout traffic; however, 12 full and 2 partial intersections will be severely
impacted by regional through-traffic over which the City has no jurisdictional control. These
generally include all freeway interchange areas and major intersections along Carlsbad
Boulevard. Even with the implementation of roadway improvements, a number of intersections
are projected to fail the City's adopted Growth Management performance standards at buildout.

To lessen or minimize~ impact on circulation-associated wi~neral Plan buildout, numerous
, mitigation measures .._ ., e been recommended in the Final """"'1ster EIR. These include 1)
measures to ensure the provision of circulation facilities concurrent with need; 2) provisions to
develop alternative modes of transportation such as trails, bicycle routes, additional sidewalks,
pedestrian linkages, and commuter rail systems; and 3) participation in regional circulation
strategies when adopted. The diversion of regional through-traffic from a failing Interstate or
State Highway onto City streets creates impacts that are not within the jurisdiction of the City to
control. The applicable and appropriate General Plan circulation mitigation measures have either
been incorporated into the design of the project or are included as conditions of project approval.
Regional related circulation impacts are considered cumulatively significant because of the
failure of intersections at buildout of the General Plan due to regional through-traffic, therefore,
the "Initial Study" checklist is marked "Potentially Significant Impact". This project is
consistent with the General Plan, therefore, the preparation of an EIR is not required because the
recent certification of Final Master EIR 93-01, by City Council Resolution No. 94-246, included
a "Statement Of Overriding Considerations" for circulation impacts. This "Statement Of
Ove¢ding Considerations" applies to all subsequent projects covered by the General Plan's
Master EIR, including this project, therefore, no further environmental review of circulation
impacts is required.
