According to the code, prior to submitting for a CUP in the overlay zone, a Preliminary Review shall be
completed (normally takes 30 days to complete). However, if time is an issue, we can process them
concurrently. The whole CUP and other application process will take at a minimum 4-5 months to get through
Planning Commission and City Council approval. However, it could take longer if there are issues that need to be
resolved or other hold ups.

NOTICE IS HEREBY GIVEN to you that the Planning Commission of the City of Carlsbad will hold a public
hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on
Wednesday, March 20, 2013, to consider a request for the following:

3,000 square foot building and to allow the addition of a 700 square foot outdoor dining patio, located
within the Poinsettia Village shopping center, on the east side of Avenida Encinas between Poinsettia
Lane and Loganberry Drive in the Mello I Segment of the Local Coastal Program and in Local Facilities
Management Zone 9.

Land Development Engineering has completed its review of the above referenced project. Prior
to next submittal, it is suggested the following items are adequately addressed:
1. Please submit a completed Stormwater Standards Questionnaire, form E-34. This
questionnaire will guide you in determining what type of reports and storm water
mitigation must be completed to satisfy state and city storm water quality

This project is adding approximately 700 sq. ft. of impervious area. Our initial review
suggests that this project is a non-priority project, based on the city's Stormwater
Standard Questionnaire. A SWMP report is not required for a non-priority project.
However, the project is required to comply with Standard Stormwater Requirements.
This means that the project is required to incorporate applicable best management
practices (BMP) techniques, source control and low impact design (LID) in the project
design to minimize the introduction of pollutants from the project run-off. For example,
route run-off from the impervious area to landscape area before connecting into the
storm a drain system. Please see page 10 of City's Standard Urban Storm Water
Mitigation Plan (SUSMP) for more information on Standard Stormwater Requirements.
On the site plan, show that the run-off from the new concrete patio drains into a
landscaped area before discharging into a storm drain system or a public street
A grease control device is required for all restaurant projects. Show the location of the
existing or proposed grease control device on the site plan.

2. The parking analysis is incorrect. The total provided parking is not 923 spaces. Please see the
attached redline plans, as the number of spaces has been field verified. Also, please note on the
plans that the parking requirement ratio for the patio is 1/100 in excess of 400 s.f.
3. The total number of existing parking spaces shown on the site plan is incorrect. Only 909
parking spaces are currently striped on-site. The latest proposal shows the addition of 3 spaces
behind Building H which were approved by SOP 82-03(F) (but never installed) and would bring
the total to 912 spaces. Also, 3 spaces are proposed by removing handicap loading areas near
Building C. This would bring the parking to 915 spaces and still 4 spaces short of the 919
required. Please update the plan to show the correct number of existing parking spaces and
enough proposed spaces to have a total of at least 919.
4. On Sheets 1 and 2, please label Building M as "existing food service" for the 2,000 s.f. suite and
"existing retail/proposed food service" for the 1,000 s.f. suite.
5. Sheet 2 states the proposed patio will be concrete. Please label this on Sheet 3 as well and
clearly identify if the proposed material for the patio floor will be standard concrete, colored,
stamped, etc. Please also identify any proposed gates or access points to the patio from inside
and/or outside the building.
6. Please label each sheet as shown in the bottom right corner of the red line plans.

determined that the following environmental review process (pursuant to CEQA) will be required for the
project:
The project is exempt from the provisions of CEQA, pursuant to CEQA Categorical Exemption for Existing
Facilities-State Guidelines Section 15301. No environmental review is required for the project.
A Notice of Exemption will be filed after approval of the project with the San Diego County Clerk's Office
which involves a filing fee. Please submit a check to the project planner in the amount of $50.00 made

2. The parking analysis is incorrect. Please update appropriate sections based on the information
in the attached parking analysis.
3. The site plan in not accurate. Please show the current layout that incorporates the demolition
of Building G and the expansion of Building F which was approved under SOP 82-03(F).
4. The parking shown on the site plan is not accurate. Please update the site plan parking and
show any proposed parking changes in order to accommodate the required parking spaces. A
copy of the site plan from SOP 82-03(F) has been included for reference. This plan is more
accurate than what was provided, but still has a few errors in regard to what is existing on-site.
5. The total number of parking spaces required for this project is 919. Currently, only 909 parking
spaces are striped on site. The last approval (SOP 82-03(F)) shows 912 spaces, but 3 spaces
were never striped behind Building H. With the striping of the 3 spaces behind Building H and
the addition of 2 spaces proposed by re-striping in front of Building C, the total spaces on site
would be 914. This is still 5 parking spaces short of the required 919 spaces. Please
demonstrate that 919 spaces will be provided on site. Please note that any cart returns that
utilize a parking space will not get credit for a parking space.
6. The site data needs to be updated to show that Building F now has a size of 55,255 square feet.
Building G needs to be deleted as it no longer exists due to the merger with Building F.
7. Please label all facilities as "existing" or "proposed."
8. The "floor plan" located on the elevations sheet needs to have the correct dimensions. The
current dimensions shown amount to more than the 700 square feet as labeled and as
described in the project description.
9. The only elevations provided are existing elevations. Please add proposed elevations and
include any proposed cover, if any.
10. The proposed outdoor dining area will remove existing landscaping and a tree. No upgrade in
landscaping appears to be proposed. It is recommended that landscaping be enhanced around
the proposed outdoor dining area, the tree be replaced and decorative construction materials
and unique design elements be incorporated into the project.

11. Please submit the proposed design for the outdoor dining area that includes materials, colors,
fences, walls, access points, etc. The design needs to be completed before the project can move
forward. All exhibits shall be incorporated into sheets that are 24" by 36".
Engineering:
1. Please submit a completed Stormwater Standards Questionnaire, form E-34. This questionnaire
will guide you in determining what type of reports and storm water mitigation must be
completed to satisfy state and city storm water quality requirements. The questionnaire can be
printed from the following website link:

2. This project is adding approximately 700 sq. ft. of impervious area. Our initial review suggests
that this project is a non-priority project, based on the city's Stormwater Standard
Questionnaire. A SWMP report is not required for a non-priority project. However, the project is
required to comply with Standard Stormwater Requirements. This means that the project is
required to incorporate applicable best management practices (BMP) techniques, source control
and low impact design (LID) in the project design to minimize the introduction of pollutants from
the project run-off. For example, route run-off from the impervious area to landscape area
before connecting into the storm a drain system. Please see page 10 of City's Standard Urban
Storm Water Mitigation Plan (SUSMP) for more information on Standard Stormwater
Requirements.
3. On the site plan, show that the run-off from the new concrete patio drains into a landscaped
area before discharging into a storm drain system or a public street
4. A grease control device is required for all restaurant projects. Show the location of the existing
or proposed grease control device on the site plan.
5. Please comply with all·comments shown in red on the site plan.
6. Attached is the rough estimate of the Building Permit fees based on the preliminary building
