RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 5931 APPROVING Conditional Use Pennit CUP 05-11 based upon the findings and subject to the conditions contained therein. II. INTRODUCTION The proposed Conditional Use Permit CUP 05-11 will allow the continued operation, for an unlimited period of time, of the Buena Vista Pump Station located on the east side of Jefferson Street and south of Highway 78. The pump station has operated in conformance with the required conditions of approval of its approved CUP 92-06, which has since expired. III. PROJECT DESCRIPTION AND BACKGROUND On October 7, 1992 the Planning Commission approved a Negative Declaration issued by the City of Vista's Planning Director (Resolution No. 3430), CUP 92-06 (Resolution No. 3431) and SUP 92-03 (Resolution No. 3432) to allow for the operation and construction of improvements designed to increase capacity and efficiency of the existing Buena Vista Pump Station located on the east side of Jefferson Street and south of Highway 78. The CUP has since expired and a new CUP application is required to allow the pump station to continue to operate at its present location. The applicant. City of Carlsbad, is requesting that the Planning Commission approve CUP 05-11 to allow the continued operation of the Buena Vista Pump Station at this site for an unlimited period of time. This CUP Resolution No. 3431 includes previous conditions of approval that are still applicable to this CUP even though some of the conditions have already been satisfied. To ensure that the pump station remains consistent with the General Plan and compatible with the surrounding uses, several new conditions have been added to bring the project up to date with cunent City of Carlsbad practices and Califomia State regulations, such as granting CUP-05-11 for an unlimited period of time and storm water quality regulations, which includes, but is not limited to, CUP 05-11 - BUENA VISTATUMP STATION August 3, 2005 Page 2 implementing Best Management Practices (BMPs) to minimize storm water contact with pollutants. Conditional Use Permits for Capital Improvement Projects are typically granted for an unlimited period of time. The CUP will be reviewed by the Planning Director annually to detennine if all conditions of this project have been met and that the use does not have a substantial detrimental effect on sunounding land uses and the public's health and welfare. IV. ANALYSIS The recommendation to approve CUP 05-11 was developed by analyzing the project's consistency with the applicable City regulations. The four findings required for approval of a Conditional Use Permit can be made, specifically: A. That the requested use is necessary or desirable for the development of the community, is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses specifically permitted in the zone in which the proposed use is located. The upgraded pump station increases the station's pumping capacity and the upgraded public facility is consistent with Carlsbad's General Plan, Land Use Element, and Growth Management and Public Facilities, Goal A.S, which its purpose is for the City to responsibly deal with the disposal of solid and liquid waste. B. That the site for the intended use is adequate in size and shape to accommodate the use, in that all previous improvements are easily accommodated on the existing pump station pad. C. That all the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained, in that the building and landscaping was designed to eliminate any offsite impacts to adjacent vacant or non-developable areas. D. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. The existing Jefferson Street roadway and existing access road is adequate to properly handle the maintenance vehicle traffic that is generated by this project. As conditioned, the Buena Vista Pump Station will provide a much-needed service to the Chy and will not adversely affect the environment. V. ENVIRONMENTAL REVIEW The Planning Director has determined that this project (CUP 05-11) is exempt from the requirements of the Califomia Environmental Quality Act (CEQA) per Section 15301, Existing CUP 05-11 - BUENA VISTATUMP STATION August 3, 2005 Page 3 Facilities, of the State CEQA Guidelines and will not have any adverse significant impact on the environment.
