Description/Explanation:
The proposed project would demolish an existing Designated Emergency Shelter facility and replace with
a new Designated Emergency Shelter facility-all on the same parcel containing 157,856 sf (3.62 ac) or 51,104 sf
( ac) of buildable area (due to existing slopes & easements). The new facility would consist of 3 new buildings:
Farmworker Housing/Dorm with full restroom facilities, Family Farmworker Housing/Dorm with full restroom
facilities, and a Kitchen I Dining building. Site amenities would include a covered seating area, an open seating area,
courtyard with benches and landscaped to meet code requirements (including a herb garden). The project will
provide 4 parking stalls (including 1 HC van accessible stall) for staff & visitor use. The architecturru style is
inspired from the humble vernacular of California Mission Architecture.

At the August 3, 2011 Planning Commission meeting, your Conditional Use Permit application was
considered. The Commission voted 6-0-1 to recommend approval of CUP 10-08. The decision of the
Planning Commission is advisory and will be forwarded to the City Council.
At the August 3, 2011 Planning Commission meeting, your Habitat Management Plan Permit application
was considered. The Commission voted 6-0-1 to approve HMP 11-01. The decision of the Planning
Commission will become final on August 13, 2011. The time within which judicial review of this decision
must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable
in the City of Carlsbad by Carlsbad Municipal Code 1.16. Any petition or other paper seeking judicial
review must be filed in the appropriate court not later than the ninetieth day following the date which
this decision becomes final; however, if within ten days after the decision becomes final a request for
the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the
estimated cost of preparation of such record, the time within which such petition may be filed in court
is extended to not later than the thirtieth day following the date on which the record is either
personally delivered or mailed to the party, or his attorney of record, if he has one. A written request
for the preparation of the record of the proceedings shall be filed with the City Planner, Don Neu,
Secretary of the Planning Commission, 1635 Faraday Avenue, Carlsbad, CA 92008.

This early public notice is to let you know that a development application for a
Conditional Use Permit project within your neighborhood has been submitted to the City
of Carlsbad on May 24, 2010. The project application is still undergoing its initial
reviews by the City.
LOCATION: 2478 Impala Drive.
PROJECT DESCRIPTION: The applicant is proposing to demolish the Temporary
Homeless Shelter and construct a new shelter consisting of two (2) dormitory buildings,
totaling 10, 970 square feet, and one (1) dining hall, which is 2,330 square feet in size,
to include landscaping and hardscaping.
Please keep in mind that this is an early public notice and that the project design could
change as a result of further staff and public review. A future public hearing notice will
be mailed to you when this project is scheduled for public hearing before the Planning
Commission.

ENVIRONMENTAL SETTING DESCRIPTION

32. The existing project site is located on the north side of Impala Drive and is developed
with two (2) existing structures and an administration trailer. Site improvements
include a concrete vehicular area, sidewalks, and courtyards. According to the soils
investigation, there is little evidence of soil erosion and instability. Also, the entire site
is underlain with crystalline bedrock. It is bordered on it east side by an SDG&E
easement and graded slopes to the west. There are no animals, cultural or historical
aspects known at this time. The existing landscaping on the site consists primarily of
large eucalyptus trees planted along the east, west and south (street) sides of the
property, and a varied assortment of ornamental trees and shrubs scattered through
the interior courtyards and around the perimeter of the existing buildings. The
northern portion of the property beyond the fence slopes down into a large, natural
open space called Aqua Hedionda Creek, consisting of a "southern mixed chaparral"
plant community. The property's location and elevation afford scenic views to the
north across much of northern Carlsbad and beyond.
33. The adjacent surrounding properties are all industrial use. The property to the north
contains a 1-story office/warehouse building with an open storage yard closest to the
CCDSD property. The property to the south contains a 1-story warehouse building
utilized by the City of Carlsbad Public Works department. Between the CCDSD
property and the City of Carlsbad Public Works building is a wide SDG&E easement
for overhead & underground utility services. The property to the south (across Impala
Drive) contains a 1-story office/warehouse building, while the land to the north (within
CCDSD property) is an undevelopable steep slope area. The landscaping on the
adjacent properties consists mainly of mixed ornamental plantings that were typical of
this type of commercial I industrial development in the 1980's and 90's, with perimeter
hedges and plantings of durable shrubs and groundcovers. The streetscape is
dominated by large eucalyptus trees on the eastern end of Impala Drive, and
transitions into a more commercial park setting to the west, with groves of mature
Liquidambar trees and large expanses of turf grass, indicative of a time when water
use for landscaping was much less restricted than it is currently.

14. Please add a note to plans indicating that plantings located in bio-swales shall be fully
knitted in and provide complete coverage of the swale area in order to provide a working
filter prior to building occupancy permits being signed. (If current sizes/spacings will not
provide cover prior to requests for building occupancy, please revise as appropriate to
achieve desired results.)
15. Please obtain Carlsbad Municipal Water District (CMWD) and County Department of
Environmental Health (DEH) review and approval. Planning has forwarded one copy of
plans to CMWD/DEH for review. Comments will be forwarded back to the applicant
once received by Planning. Once mylars are requested by the City, the applicant is to
provide one set ofbond copies of plans along with mylars. The bond set is required for
DEH.
16. Please provide a 1" border on the right side of sheet as required for hanging mylars.
17. As-built plans for all projects (bonded and non-bonded, public and private) are required
to be submitted. Submittal of as-built plans shall be as required by the Engineering and
Planning Departments. The final plans should be prepared by the landscape architect
from dimensions provided by the contractor. Please address in the specifications. Final
as-built plans shall be drafted clearly to the satisfaction of the City, and the original
mylars shall be submitted to the City for their keeping. Please add a note to plans
indicating that the final as-built plans will be required to be reviewed and approved by
the City and final mylars will be required to be approved and signed by the City prior to
release of securities.

Slopes 6:1 or steeper requiring erosion control measures as specified herein shall be
treated with one or more of the following planting standards:
a. Standard 1 -Cover Crop/Reinforced Straw Matting:
Cover crop shall be a seed mix typically made up of quick germinating and fast
covering grasses, clovers, and/or wild flowers. Submit the specific seed mix for
City approval prior to application. The cover crop shall be applied at a rate and
manner sufficient to provide 90% coverage within thirty (30) days.
Type of reinforced straw matting shall be as approved by the city and staked to
the slope as recommended by the manufacturer.
Reinforced straw matting shall be required when planting occurs between August
I5 and April I5. The cover crop and/or reinforced straw mat shall be used the
remainder of the year.
b. Standard #2 -Ground Cover
One hundred (IOO%) percent ofthe area shall be planted with a ground cover
known to have excellent soil binding characteristics (planted from a minimum
size of flatted material and spaced to provide full coverage within one year).
c. Standard #3 -Low Shrubs
Low spreading woody shrubs (planted from a minimum of2-3/4 inch liners) shall
cover a minimum of seventy (70%) percent of the slope face (at mature size).
d. Standard #4-Trees and/or Large Shrubs
Trees and/or large shrubs shall be (planted from a minimum of 1 gallon
containers) at a minimum rate of one ( 1) per two hundred (200) square feet.
Slopes -6: I or steeper and:
a. 3' or less in vertical height and are adjacent to public walks or streets require at
minimum Standard # 1.
b. 3' to 8' in vertical height require Standards # 1, #2 and #3.
c. In excess of8' in vertical height require Standards #1, #2, #3, and #4.
Areas graded flatter than 6: 1 require Standard #I (cover crop) with temporary
irrigation when they have one or more of the following conditions:
a. Sheet graded pads not scheduled for improvements within 6 months of
completion of rough grading.
b. A potential erosion problem as determined by the City.
c. Identified by the City as highly visible areas to the public or have special
conditions that warrant immediate treatment.
I9. Please specify quantities for the hydroseed mulch, binder and fertilizers.
20. Please provide planting details for shrubs and trees on slopes. Please indicate that where
on slopes, the rear of the planting pits shall be graded to a maximum 1: 1 slope. Indicate
that erosion control fabric shall be installed on this slope to control erosion while plants
establish.
21. A minimum of 3" of organic mulch shall be added in non-turf planting areas with slopes
less steep than 3: 1 to cover the soil surface completely. Please revise as appropriate.

22. Due to relocation of utilities after plan approval, please add a note to plans indicating that
the contractor shall contact the landscape architect prior to beginning landscape work so
that the landscape architect can review the project utility locations and revise plans
accordingly to fully screen all utilities from view.
23. Add the following note to the title sheet: Prior to the start of grading, the applicant or
applicant's agent shall obtain city approval of a construction schedule and/or exhibit
outlining the timing of the slope planting and irrigation. The schedule shall show timing
of construction of free-standing, retaining and crib walls immediately after rough grading
as each location is achieved. Irrigation and planting shall take place as grading
progresses.
24. Add the following note to the title sheet: Installation of irrigation as shown on the
approved plans shall commence within 10 days of the time when each slope is brought to
grade as shown on the approved grading plans.
25. Add the following note to the title sheet: Planting and irrigation for the slope areas shall
be completely installed, as shown on the approved plans, within 30 days after the
irrigation installation first commences.
26. Mainlines shall be clearly delineated outside the street right-of-way. Please address on
plans.
27. Please revise notes as required to indicate that pop-ups shall be used in the right-of-way
and wherever within 1 0' of any hardscape, turf or other area where pedestrian traffic may
occur.
28. I do not see these symbols on the plans. Are they used?
29. Please revise to Schedule 80 PVC where below roads.
30. Please provide a copy of civil plans that specifies the irrigation water meter installation
for cross checking. Please indicate the water meter street station number on the irrigation
plans. Separate water service for landscaping including but not limited to connections,
water meters, and backflow preventers shall be provided.
31. Pipe between the meter and backflow preventer shall be "Schedule K hard Copper".
Please specify.
32. Reclaimed systems trenching details shall provide for two layers of warning tape running
continuous along the route of the mainline. One shall be located immediately on top of
the mainline pipe and one 12" above the top of the mainline. Please address.
33. Please note that prior to receiving final approval for completion of the project; each

5. Developer shall cause property owner to execute and submit to the city engineer for
recordation the city's standard form Drainage Hold Harmless Agreement.
6. Developer shall cause property owner to process, execute and submit an executed copy
to the city engineer for recordation a city standard Permanent Stormwater Quality Best
Management Practice Maintenance Agreement for the perpetual maintenance of all
treatment control, applicable site design and source control, post-construction
permanent Best Management Practices prior to the issuance of a grading permit or
building permit, whichever occurs first for this project.
7. Developer shall cause the property owner to process a street vacation to vacate the
excess street dedication of Impala Drive along the project frontage as shown on the site
plan.
Grading
8. Based upon a review of the proposed grading and the grading quantities shown on the
site plan, a grading permit for this project is required. Developer shall prepare and
submit plans and technical studies/reports, for city engineer review, and shall pay all
applicable grading plan review fees per the city's latest fee schedule.
9. Developer shall apply for and obtain a grading permit from the city engineer. Developer
shall pay all applicable grading permit fees per the city's latest fee schedule and shall
post security per City Code requirements.
10. Developer shall comply with the city's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution control practices or devices, erosion control to prevent
silt runoff during construction, general housekeeping practices, pollution prevention
and educational practices, maintenance procedures, and other management practices
or devices to prevent or reduce the discharge of pollutants to stormwater, receiving
water or stormwater conveyance system to the maximum extent practicable. Developer
shall notify prospective owners and tenants of the above requirements.
11. Prior to the issuance of a grading permit, developer shall submit to the city engineer
receipt of a Notice of Intent from the State Water Resources Control Board.
12. Prior to the issuance of grading permit or building permit, whichever occurs first,
developer shall submit for city approval a Tier 3 Storm Water Pollution Prevention Plan
(TIER 3 SWPPP). The TIER 3 SWPPP shall comply with current requirements and
provisions established by the San Diego Regional Water Quality Control Board and City
of Carlsbad Requirements. The TIER 3 SWPPP shall identify and incorporate measures to
reduce storm water pollutant runoff during construction of the project to the maximum

extent practicable. Developer shall pay all applicable SWPPP plan review and inspection
fees per the city's latest fee schedule.
13. This project is subject to 'Priority Development Project' requirements. Developer shall
prepare and process a Storm Water Management Plan (SWMP), subject to city engineer
approval, to demonstrate how this project meets new/current storm water treatment
requirements per the city's Standard Urban Storm Water Management Plan (SUSMP),
latest version. In addition to new treatment control BMP selection criteria in the
SUSMP, the developer shall use low impact development (site design) approaches to
ensure that runoff from impervious areas (roofs, pavement, etc) are drained through
landscaped (pervious) areas prior to discharge. Developer shall pay all applicable SWMP
plan review and inspection fees per the city's latest fee schedule.
· 14. Developer is subject to hydromodification (runoff reduction) requirements.
Hydromodification involves detailed site design and analysis to reduce the amount of
post-development run-off by mimicking the natural hydrologic function of the site,
preserving natural open-spaces and natural drainage channels, minimizing use of new
impervious surfaces, and promoting onsite infiltration and evaporation of run-off.
During final design, developer shall demonstrate compliance with hydromodification
requirements in accordance with the city's Standard Urban Storm Water Management
Plan (SUSMP)to the satisfaction of the city engineer.
15. Developer is responsible to ensure that all final design plans (grading plans,
improvement plans, landscape plans, building plans, etc) incorporate all source control,
site design, treatment control BMP, hydromodification, and Low Impact Design (LID)
facilities.
Dedications/Improvements
16. Developer shall design the private drainage systems, as shown on the site plan to the
satisfaction of the city engineer. All private drainage systems (12" diameter storm drain
and larger) shall be inspected by the city. Developer shall pay the standard
improvement plan check and inspection fees for private drainage systems.
17. Developer shall design all proposed public improvements including but not limited to
(pedestrian ramps, driveways, curb and gutter, sidewalk, water services/meters, curb
drains, etc.) as shown on the site plan. These improvements shall be shown on one of
the following, subject to city engineer approval:
A. Grading plans processed in conjunction with this project; or
B. Construction Revision to an existing record public improvement drawing,
DWG 248-5.

Developer shall pay plan check and inspection fees using improvement valuations in
accordance with the city's current fee schedule. Developer shall apply for and obtain a
right-of-way permit prior to performing work in the city right-of-way.
Utilities
18. Developer shall meet with the fire marshal to determine if fire protection measures (fire
flows, fire hydrant locations, building sprinklers) are required to serve the project. Fire
hydrants, if proposed, shall be considered public improvements and shall be served by
public water mains to the satisfaction of the district engineer.
19. Prior to issuance of building permits, developer shall pay all fees, deposits, and charges
for connection to public facilities.
20. Developer shall install potable water services and meters at locations approved by the
district engineer. The locations of said services shall be reflected on public improvement
plans, grading plans, or construction revision to existing improvement plan DWG 248-5.
21. The developer shall install sewer laterals and clean-outs at locations approved by the
city engineer. The locations of sewer laterals shall be reflected on public improvement
plans, grading plans, or construction revision to existing improvement plan DWG 248-5.

Staff has reviewed the submittal for completeness and has determined that the application and
plans submitted for the project is still incomplete. Staff has identified several items of concern.
Prior to next submittal, the following items should be adequately addressed. Additional items
of concern may be identified upon subsequent review.
Incomplete items:
• The preliminary SWMP report prepared by Ware Malcomb dated January 12, 2011 does
not comply with the City of Carlsbad SUSMP and is not written in the City SWMP format.
As requested in the first review, please submit a preliminary SWMP report in
accordance with the current City SUSMP requirements. City of Carlsbad SUSMP is in the
City Engineering Standards, Volume 4 Chapter 2. It is available in the City web-site at:

Section 3 of Engineering Standards Volume 4, Chapter 2 provides the step by step

As previously mentioned, this project is subject to the current hydromodification

Issues:

• The nomograph used in the hydrology report for determining the time of concentration
is not used in the current San Diego County Hydrology Manual. Please provide Tc
calculations following the procedure provided in section 3.1.4 of San Diego County
Hydrology Manual.
• The hydrology report did not include 100 year storm event analysis. This project
discharges into the existing public street and public storm drain facilities. The City of
Carlsbad engineering standards require public streets and public storm drain facilities to
be designed to handle 100 year storm events. Please provide 100 year storm event pre-
development discharge and post development discharge comparison. Show that there is
no increase in discharge (Q) at the discharge point or show that the existing street and
downstream public storm drain facilities have the capacity to handle the increase in
discharge. You may need to redesign the proposed detention systems to handle 100-
year storm event to avoid potential impacts to downstream public facilities.
• Clarify which BMP facilities (bioswales and/or detention systems) are used for treatment
control, for flow control or for both. Provide required sizing calculations to show that
they are adequate. The hydrology report shows that the proposed detention systems
are designed to detain the increase in the 50 year storm event. Please clarify if they are
also intended to be used as treatment BMP and provide appropriate sizing calculations.
Consider using a bioretention system instead of a detention system. Bioretention
system can be designed as both a flow control and a treatment control BMP facility.
• Some roof drain outlets are very close to the discharge point. In such cases, roof runoff
does not have adequate contact time (5 minutes minimum) in the proposed bioswale
for adequate treatment. Consider adding roof gutters and connect and drain roof run-
off to a bioswale at least 100 feet away from the discharge point. As additional LID
feature, consider adding rain barrels to store rain water to be slowly released later for
irrigation purposes.
• Include in the hydrology report appropriate analysis and sizing calculations for flow
control and treatment BMP facilities to satisfy hydromodification, water quality, and LID
requirements.
• The soils report does not include discussions on the suitability of the proposed
detention systems and bioswales shown on the grading plan as requested in the first
review. Please submit a soils update letter from the soils engineer providing design
recommendations for the proposed detention systems and bioswales.

Dear Ms Hildabrand,
After more than 18 years of operation La Posada de Guadalupe and the City of Carlsbad are on the
threshold of a new chapter in our partnership to shelter homeless men and farm workers. The
construction of a new facility that will not only increase our capacity but create a facility that can be
used for the next twenty years to address the sheltering needs in our community. At each milestone in
the development of La Posada I have appeared before the City Council to either ask support or to thank
them for their faith and support of our work. ·
The Council hearing for the La Posada Conditional Use Permit is scheduled for Tuesday, September
27, 2011. On behalf of Catholic Charities I write to respectfully request that the hearing be delayed until
October 25, 2011. I make this request because I will be out of town on September 2th. As the primary
spokesperson for Catholic Charities and La Posada I would not only like to be there to share in the joy
of this moment but to share with the Council some of the specific challenges we now face related to
construction and city fees.

ISSUES OF CONCERN
Planning:
Per our meeting on April 5, 2011, it was brought to staffs attention that phasing the
project may not be the applicant's desire, but instead to install a temporary structure and
to construct the project at one time. To do this staff needs information about the type of
temporary structure proposed, where it will be placed on the site, and when it will be
taken down. Plus, as mentioned in the meeting, the applicant may want to place the
temporary structure within the SDG&E easement area. To do this, please provide a letter
from SDG&E agreeing to the temporary structure in this easement area and for the
duration of time needed. All this information needs to be included and approved with
your CUP application. If this plan has changed since that meeting and the phasing of the
project is to move forward please inform staff as soon as possible.
Per our phone conversation on April 21, 2011, it was mentioned that the dining hall may
be changing size and include additional square footage. Staff has not had any additional
plans submitted with the many changes that have occurred since last submittal on
January 28. Please submit four (4) sets of complete plans with all added building
changes, all engineering changes, and any other changes that may have occurred since
the last submittal. This includes new landscaping plans to reflect all changes and the
previous comments from the complete letter on March 3rd.
Planning Systems Property Analysis Record (PAR) Comments:
Previous Comments (in italics and "quotes'). New comments listed below on latest PMP/PAR
for Catholic Charities La Posada de Guadalupe de Carlsbad:
3. "Need more justification or info re: statement about no T & E species on site; if none, no
focused survey needed."
Sections 1.0 and 2.1 have been expanded to include information on survey techniques
used and species identified. No focused surveys should be necessary.
4. "Don't need annual bio surveys (fauna) or veg surveys-only every 3-5 years after initial
mapping."
Text of PMP states that bio surveys would be conducted every 3-5 years after initial
mapping but the PAR is unclear how this is budgeted. The PAR line item is labeled,
"Annual surveys" and two hours per year are dedicated to the effort (previous PAR had
four hours per year for plant biologist). It would be helpful to note the survey frequency
in the PAR.
5. "Patrol shouldn't be big expense since access controlled on 2 sides & too steep to camp
or traverse."
The revised PMP contains the same language regarding patrolling being conducted
however the only line item for Access Control in the PAR is for "Outreach Services."
These differences should be reconciled.
6. "After mapping of veg very likely indicate very few invasives. More important for La
Posada to control what they plant."

The PMP notes very few invasives on site -are the hours for invasive species control in
the PAR (18 hours/year for removal and reveg) too much? I would think most of the
weeding would be in the fire suppression zone, which is not included in the PMP. Also,
Section 4.0 of the PMP should also include a discussion of the outreach (and
coordination?) with La Posada regarding the avoidance of invasive species in their
planting and within their fire suppression zone.
7. "Given above, the quarterly progress reporting, detailed annual monitoring & reporting is
not needed-still must submit summary annual report."
PMP and PAR were modified to eliminate quarterly report and detailed annual
monitoring.
New PAR comments:
8. Section 5.1, page 7 -the estimated annual costs in Table 3 should match text in
paragraph below table.
9. The PMP states that a Conservation Easement will be placed on the open space area.
Conservation Easements have reporting requirement above and beyond those of the
HMP and are subject to changes in State law. A customized Open Space Easement to
the City or a Restrictive Covenant in lieu of a Conservation Easement would suffice in
this situation.
10. The PMP states that the endowment will be held by the open space management entity.
Since the property is not proposed to be part of the HMP preserve, there is no restriction
on who holds the endowment. There will need to be provisions in the Open Space
Easement on the property that require the endowment to be tied to the open space area
in perpetuity, regardless of who manages it. It would be more secure for Catholic
Charities to hold the endowment since they are responsible for the open space being
managed effectively.
11. Both the previous and current PMPs propose the habitat area being split off as a
separate parcel and owned by an open space management entity. Once again, since
the property is not proposed to be part of the HMP preserve, there is no restriction on
who owns the land. Having the open space as a separate parcel may negatively impact
the selection of open space management entities willing to manage the land.
:fhe Catholic Charities lot is not in an HMP "Hardline" area or "Standards" area as
defined by the City of Carlsbad Habitat Management Plan. The slope at the rear of the
property does have habitat and therefore has the option of: A) Paying just for the take of
habitat for the fire buffer and then preserving the rest in a conservation agreement; or B)
Paying for the entire slope and then placing an Open Space Easement across the slope
and the remaining habitat. Please identify which option is best for Catholic Charities. If it
is option A then proceed with the comments 3-11; if option B then disregard comment 3-/f

RE: Catholic Charities of San Diego-La Posada Shelter Parking Requirements
Dear Mr. Halverson,
This letter is a summary of the current and future parking needs of the La Posada Shelter and farm worker
housing project on Impala Drive. The scope of the project is to replace the existing facilities located at 2476
Impala Dr, Carlsbad. Because we have operated La Posada at this location for the past 18 years, we have
very accurate data on the parking needs at the facility. We know the number of staff employed and their
auto usage as well as all other auto traffic that comes to the facility.
Currently La Posada houses 50 men and we employ a total staff of 6 which covers 7 days a week, 24 hours
per day. The parking needed to accommodate staff and visitors is 4 parking stalls. All of these spaces are
used by employees since the men housed at La Posada do not own cars. Once complete, the facility will
house 100 men and employ 9. The parking needed to accommodate the increase in staff will be a total of 5
parking stalls. Our site will provide 4 on-site parking spaces and there will also be 5-6 street parking spaces
for a new total of 10-11 parking stalls for visitors and staff.
The La Posada Shelter is not the only homeless shelter we operate. Catholic Charities operates Rachel's
Women's Center in Downtown San Diego. The staff size is similar with target populations being homeless
women. The anticipated parking needs listed above are consistent with the needs we experience at Rachel's
Women's Center. Based on our current experience at La Posada and Rachel's Women's Center we arc
confident that parking needs for this location once the improvements are complete are more than adequate.

Dear Sir or Madame:
I write this letter on behalf of the Board of Directors of Caring Residents of
Carlsbad, Inc. in full support of the application by Catholic Charities of San
Diego for a Conditional Use Permit and Habitat Management Plan Permit to
allow for the demolition and reconstruction of the La Posada de Guadalupe
Homeless Men's Shelter.
Caring Residents of Carlsbad, a non profit public benefit corporation dedicated
to serving our community's homeless, has worked for almost 20 years now to
create community awareness of the needs of the homeless here in Carlsbad and
coastal North San Diego County. Our organization has worked with Catholic
Charities and the staff at La Posada de Guadalupe since its inception in 1992.
All of our Board members have firsthand knowledge of the positive impact the
La Posada shelter has made in our community. We have met many of the men
who have benefited from their stay at this well-run facility. Over the years we
have found the shelter staff at La Posada to be both professional and
compassionate in addressing the particular needs of each of the shelter
residents. The shelter has earned the respect of the greater Carlsbad
community. Former Mayor Bud Lewis often said that "At La Posada the men
receive a hand up, not a handout".

During it most recent fiscal year La Posada provided 18,000 shelter nights and
43,000 meals to 440 homeless men, including veterans, seniors and persons
with physical disabilities. Since opening its doors in 1992, La Posada has
provided shelter to over 8,200 men. For the past several years, Catholic
Charities has been able to produce these outstanding results despite the fact that
the shelter operates out of cramped and aging modular buildings. As City staff
has pointed out in their report, the rebuilding of La Posada as contemplated by
this application is consistent with the City's General Plan, and, in fact, the
project is specifically identified in the Housing Element section of that General
Plan.
In closing, the Board of Caring Residents of Carlsbad fully endorses approval
of the new Conditional Use Permit for La Posada de Guadalupe so that Catholic
Charities can continue their fine work in bettering the lives of the homeless men
in our community.

1. Are they going to pay for the habitat or are they setting up the PAR for the conservation? [adzulynsky] Catholic Charities
would like to pay for the habitat & maintain it themselves, however, we need to exact cost so that a check can be drawn up
along with an invoice.
2. How many beds are being proposed? 109 is the number of beds if no bunk beds, if all bunk beds 218 would be the number.
Please give the best approximation ... high season and low season also?[adzulynsky] During low season, there would be 50
beds in the Farmworkers Dorm #1 and 50 beds in the Farmworkers Dorm #2. During high season, there would be 70 beds
in the Farmworkers Dorm #1 and 50 beds in the Farmworkers Dorm #2.
3. The number of employees is estimated at 9. Is that total or is that at one time. What is the most number of employees at
one time? We do have to look at parking for employees and Management (now reading my staff report) is becoming
uncomfortable with the 4 spaces. They are looking at the possibility of 9 employees and only 4 spaces. [adzulynsky] The
total number of employees is 9 which runs the facility. The minimum number of employees per shift is 2 and the maximum
number of employees per shift is 4.
4. We are still taking this forward as a phased project. Has that changed at all? I know some questions were bounced around
about another site. That would take a CUP also and we can wrap it into this one but that would probably pull you from the
Aug. 3'd agenda. If you get approval of the shelter and have to wait until a separate CUP is taken through the process, it may
not be worth the time and money. Let me know. [adzulynsky] We are proceeding with the project as a phased

construction project-Phase I and Phase II. However, if a miracle should occur and another parcel of land is quickly
identified/approved by city staff for the temporary housing, then we would then proceed in that manner and need to
address this change with you at that time. Obtaining this alternate parcel would save immense construction costs as well as
logistics-we are hopeful, but cannot await for this to occur.
5. I have some corrections on the plans that need to be taken care of before you bring in the eleven (11) sets for Planning
Commission and City Council. Plus Engineering had minor corrections that were already given to you. Call me and we can
discuss those when you have time. [adzulynsky] As discussed during our phone conversation, engineering corrections are
in process and anticipating resubmittal end of next week. Other minor revisions from landscaping was to revise wording-
please let me know exactly what needs to be changed so that I can forward to my landscape architect.

ISSUES OF CONCERN
Planning:
1. Please correct "Site Cross Section A" on page C-1 to show a diagonal plane which
demonstrates compliance with the required slope edge setbacks standard pursuant to CMC
Section 21.95.120(1)(1) for the north edge of Farmworker Dorm #1. The section shall show
that the building does not intrude into a . 7 foot horizontal to one (1) foot vertical imaginary
diagonal plane that is measured from the top of slope.
Engineering:
1. The preliminary SWMP report prepared by Ware Malcomb dated January 12, 2011 does not
comply with the City of Carlsbad SUSMP and is not written in the City SWMP format. As
requested in the first review, please submit a preliminary SWMP report in accordance with
the current City SUSMP requirements. City of Carlsbad SUSMP is in the City Engineering
Standards, Volume 4 Chapter 2. It is available in the City web-site at:
http://www.carlsbadca.gov/business/building/Documents/EngStandsw-stds-vol4-ch2.pdf.
Section 3 of Engineering Standards Volume 4, Chapter 2 provides the step by step
procedure on how to prepare a SWMP. The SWMP must also include a completed Storm
Water Standards Questionnaire (SWSQ) form (see attached form and see Section 1 of
Engineering Standard Volume 4, Chapter 2).
As previously mentioned, this project is subject to the current hydromodification requirements
(see Section 2 of Engineering Standard Volume 4, Chapter 2). Please include appropriate
analysis and sizing calculations for flow control and treatment control BMP facilities to satisfy
hydromodification, water quality, and LID requirements. Include a full size BMP map showing
all proposed BMPs.
2. The nomograph used in the hydrology report for determining the time of concentration is not
used in the current San Diego County Hydrology Manual. Please provide Tc calculations
following the procedure provided in section 3.1.4 of San Diego County Hydrology Manual.
3. The hydrology report did not include 100 year storm event analysis. This project discharges
into the existing public street and public storm drain facilities. The City of Carlsbad
engineering standards require public streets and public storm drain facilities to be designed
to handle 100 year storm events. Please provide 100 year storm event pre-development
discharge and post development discharge comparison. Show that there is no increase in
discharge (Q) at the discharge point or show that the existing street and downstream public
storm drain facilities have the capacity to handle the increase in discharge. You may need to
redesign the proposed detention systems to handle 1 00-year storm event to avoid potential
impacts to downstream public facilities.
4. Clarify which BMP facilities (bioswales and/or detention systems) are used for treatment
control, for flow control or for both. Provide required sizing calculations to show that they are
adequate. The hydrology report shows that the proposed detention systems are designed to
detain the increase in the 50 year storm event. Please clarify if they are also intended to be
used as treatment BMP and provide appropriate sizing calculations. Consider using a
bioretention system instead of a detention system. Bioretention system can be designed as
both a flow control and a treatment control BMP facility.
5. Some roof drain outlets are very close to the discharge point. In such cases, roof runoff does
not have adequate contact time (5 minutes minimum) in the proposed bioswale for adequate
treatment. Consider adding roof gutters and connect and drain roof run-off to a bioswale at

least 100 feet away from the discharge _point. As additional LID feature, consider adding rain
barrels to store rain water to be slowly released later for irrigation purposes.
6. Include in the hydrology report appropriate analysis and sizing calculations for flow control
and treatment BMP facilities to satisfy hydromodification, water quality, and LID
requirements.
7. The soils report does not include discussions on the suitability of the proposed detention
systems and bioswales shown on the grading plan as requested in the first review. Please
submit a soils update letter from the soils engineer providing design recommendations for
the proposed detention systems and bioswales.
8. Eliminate the proposed bioswale adjacent to and east of the driveway at 14.76% grade. The
preferred grade for bioswale is 2% and the standard maximum grade is 5% to allow
adequate treatment.
9. Please comply with all comments shown on the red-lined site plan, hydrology report, SWMP
report, and soil's report. Please return all redlined plans and reports with the project re-
submittal to facilitate continued staff review.
10. Please submit the following in the next submittal: revised site plan, revised hydrology report,
revised SWMP report and revised soil's report.

Response: Plans have been revised to show 'No Mow' Fine Fescue in the drainage swales. These
swales are diversion swales only and are not required for filtration.
4. Landscape elements over 30" in height (including planting measured at maturity) are not allowed at
street corners within a triangular zone drawn from two points, 25' outward from the beginning of
curves and end of curves. (See Appendix C.4). The same height limitation applies at driveways 25'
from the edge of the apron outward along the curb then 45-degrees in toward the property. Please
show and label the sight lines on the plans and insure these requirements are met.
Response: The 25' X 25' sight lines have been added adjacent to the driveway, and all landscape
elements within the resulting triangle will be less than 30" in height as indicated on the Conceptual
Landscape Plan, Sheet L-1.
5. All utilities are to be screened. Landscape construction drawings will be required to show and label
all utilities and provide appropriate screening. Please locate all light poles on the concept landscape
plans and insure that there are no conflicts with trees.
Response: A note regarding utility screening has been added at the lower right of the Conceptual
Landscape Plan graphic, Sheet L-1. Light poles are shown on the landscape plans and it has been
verified that there are no conflicts with tree locations.
6. Planting or any combination of planting, mounding, and decorative walls shall be used to provide
screening from adjacent property or streets of the parking area to a height of 3'.

Response: Upright Rosemary has been added along the south edge of the parking bay to screen
cars from the street. Upright Rosemary and Toyon shrubs screen the parking from the adjacent
property to the west.
7. Please provide a colored or hatched plan showing areas of recycled versus potable water use. This
plan will be forwarded to Public Works Maintenance and Operations for review.
Response: A Water Use Area Map, Sheet L-4, colored to show areas of recycled water use, has
been added to the landscape exhibits. There will be no potable water use outside of the buildings.
8. Projects must be designed to utilize recycled water and/or other alternative non-potable water
sources for landscaping to the satisfaction of the City. All regional and local water and health code
requirements in force at the time of final landscape approval shall apply including, but not limited to,
installation of colored irrigation pipe to denote reclaimed water use.
Response: A note indicating the use of recycled water for landscaping has been added to the Water
Conservation Plan, Sheet L-3.
9. Please add the following notes to the plans and insure all requirements are met:
Slopes 6:1 or steeper requiring erosion control measures as specified herein shall be treated with one
or more of the following planting standards:
a. Standard #1 -Cover Crop/Reinforced Straw Matting:
Cover crop shall be a seed mix typically made up of quick germinating and fast covering grasses,
clovers, and/or wild flowers. Submit the specific seed mix for City approval prior to application.
The cover crop shall be applied at a rate and manner sufficient to provide 90% coverage within
thirty (30} days.
Type of reinforced straw matting shall be as approved by the city and staked to the slope as
recommended by the manufacturer.
Reinforced straw matting shall be required when planting occurs between August 15 and April 15.
The cover crop and/or reinforced straw mat shall be used the remainder of the year.
b. Standard #2 -Ground Cover
One hundred (100%} percent of the area shall be planted with a ground cover known to have
excellent soil binding characteristics (planted from a minimum size of flatted material and spaced
to provide full coverage within one year}.
c. Standard #3 -Low Shrubs
Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners} shall cover a
minimum of seventy (70%} percent of the slope face (at mature size}.
d. Standard #4-Trees and/or Large Shrubs
Trees and/or large shrubs shall be (planted from a minimum of 1 gallon containers} at a minimum
rate of one {1) per two hundred {200) square feet.
Slopes 6:1 or steeper and:
a. 3' or less in vertical height and are adjacent to public walks or streets require at minimum
Standard #1.
b. 3' to 8' in vertical height require Standards #1, #2 and #3.
c. In excess of 8' in vertical height require Standards #1, #2, #3, and #4.
Areas graded flatter that 6:1 require Standard #1 (cover crop} with temporary irrigation when they
have one or more of the following conditions:
a. Sheet graded pads not scheduled for improvements within 6 months of completion of rough
grading.
b. A potential erosion problem as determined by the City.

Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning Division has
reviewed your Conditional Use Permit, application no. CUP 10-08, as to its completeness for
processing.
The application is incomplete, as submitted. Attached are two lists. The first list is information which
must be submitted to complete your application. The second list is project issues of concern to staff.l
In order to expedite the processing of your application, the "incomplete" items and your response to
the project issues of concern to Staff must be submitted directly to your staff planner; therefore,
please contact your staff planner directly to schedule a re-submittal appointment. As part of your re-
submittal package, please prepare and include with your re-submittal: (1) a copy of these lists, (2) a
detailed letter summarizing how all identified incomplete items and/or project issues have been ·

1. Please submit a preliminary SWMP report in accordance with the current City SUSMP

ISSUES OF CONCERN
Planning:
· The City's Zoning Ordinance does not currently include a parking requirement for a
homeless/farm worker shelter. The existing 50 bed temporary homeless shelter currently
has three (3) formal parking spaces in addition to an undeveloped pad where staff and
resident parking currently can be accommodated. The increase in occupancy from 50
beds to 100+ beds will necessitate that additional parking be provided. Please submit a
parking study to identify the parking demands for this size of homeless/farm worker
shelter and revise the site plan to provide parking spaces to address the anticipated
parking demand.

Please provide a letter clarifying the centers proposed daily operations. Your proposal is
increasing the number of beds (50 to 100+) and is including another structure designed
as a kitchen/dining/meeting area. Clarify the uses that will occur in all buildings. Provide
the occupancy of all the structures and the operational uses (i.e. criteria for staying in the
shelter, how long people are allowed to stay, criteria on who can stay, etc ... )
Habitat Management Plan -Per the "Catholic Charities Habitat Conservation Report",
dated January 8, 2010 and written by Planning Systems some revisions are required:
a) Please provide more documentation that no "threatened or endangered" (T&E)
species exist on site. If none exist then, no focused surveys are required in the
preserve management plan.
b) Annual biological surveys are not required. Biological surveys are only needed
every 3-5 years after initial mapping is done.
c) Habitat patrol shouldn't be a big expense since access is controlled on two sides
of the site (La Posada & County Land) and is too steep to camp on or traverse.
d) After the initial mapping of vegetation, it is likely that there will be very few
invasive species that will be identified. It is more important that the applicant
controls the La Posada site to ensure no invasive plants encroach from the
developed area.
e) Given the above determinations, it is likely that quarterly progress reporting,
detailed annual monitoring, and reporting may not be needed. The
applicant/owner will still need to submit a summary annual report.
Please provide larger color exhibits of the "Habitat Conservation Area Plan" provided in
the "Catholic Charities Habitat Conservation Report", Figure 2 dated December 6 2010.
The cross hatching on "Figure 2" of the report is not readable. The report should clearly
define the "Southern Mixed Chaparral" and where the .32 acres of non-native grassland
and Southern Mixed Chaparral is being removed. Also, please provide the same exhibit
with the proposed buildings plotted and the 60 foot fire buffer, including the three zones.
Please provide a detail of the trash enclosure including elevations drawn to scale. The
enclosure should be architecturally integrated with the proposed buildings.
Engineering:
1. Include a Drainage Management Area (DMA) map delineating the drainage areas
(including the roofs) draining into each of the three proposed detention systems shown
on the grading plan. Make sure that the proposed detention systems are adequately
sized and meet the SUSMP sizing criteria for Treatment Control BMP. Provide cross-
sections and details.
Suggestion only: Maximize the capacity of the proposed north and south bioswales by
directing majority of the roof run-off into the proposed bioswales. In addition, revise
proposed grades to direct some of the run-off from the central paved area into the north
bioswale. In addition, consider using pervious pavement in the courtyard.
2. Eliminate the proposed bioswale adjacent and east of the driveway at 17% grade. The
preferred grade for bioswale is 2% and the standard maximum grade is 5% to allow
adequate treatment.
3. Add erosion control measures (riprap, erosion control mat, etc.) at the storm drain and
bioswale outlets.

4. Please revise driveway grade to have a maximum of 15% grade as required by
Engineering Standard Chapter 4.G.1.
5. Clearly delineate existing and proposed structures.
6. Provide legend for all symbols used on the plan.
7. On the grading plan, show additional contours, about 50 feet beyond the existing top of
slope to the north.
8. Show all existing easements shown in Schedule B of the title report.
9. On the grading plan, show existing sewer and water services to serve this project.
Provide EDU and GPM.
10. Show traffic generation in ADT.
11. Meet with the fire department to determine if the fire protection and exiting of the existing
building is adequate or identify necessary additional fire protection measures.

Landscaping Comments:
Please make the following corrections to the plans so that they will meet the requirements of the
City of Carlsbad's Landscape Manual. Numbers below are referenced on the red line plans
where appropriate for ease in locating the area of the comment concern.
1. Please show and label all property lines.
2. Please indicate the percent of the landscaped area (as defined in Appendix G) of each
planting zone as described in Section A. 5-3 and Appendix A
3. Civil plans call for turf or approved alternative in the bio-swales. Landscape plans show
cobble. Please coordinate plans. If cobble is to be used, please provide documentation
from the civil engineer that this material will meet state requirements for the bio-swales.
4. Landscape elements over 30" in height (including planting measured at maturity) are not
allowed at street corners within a triangular zone drawn from two points, 25' outward
from the beginning of curves and end of curves. (See Appendix C.4). The same height
limitation applies at driveways 25' from the edge of the apron outward along the curb
then 45-degrees in toward the property. Please show and label the sight lines on the
plans and insure these requirements are met.

5. All utilities are to be screened. Landscape construction drawings will be required to
show and label all utilities and provide appropriate screening. Please locate all light
poles on the concept landscape plans and insure that there are no conflicts with trees.
6. Planting or any combination of planting, mounding, and decorative walls shall be used to
provide screening from adjacent property or streets of the parking area to a height of 3'.
7. Please provide a colored or hatched plan showing areas of recycled versus potable
water use. This plan will be forwarded to Public Works Maintenance and Operations for
review.
8. Projects must be designed to utilize recycled water and/or other alternative non-potable
water sources for landscaping to the satisfaction of the City. All regional and local water
and health code requirements in force at the time of final landscape approval shall apply
including, but not limited to, installation of labeled or colored irrigation pipe to denote
reclaimed water use.
9. Please add the following notes to the plans and insure all requirements are met:
Slopes 6:1 or steeper requiring erosion control measures as specified herein shall be
treated with one or more of the following planting standards:
a. Standard 1 -Cover Crop/Reinforced Straw Matting:
Cover crop shall be a seed mix typically made up of quick germinating and
fast covering grasses, clovers, and/or wild flowers. Submit the specific seed
mix for City approval prior to application. The cover crop shall be applied at a
rate and manner sufficient to provide 90% coverage within thirty (30) days.
Type of reinforced straw matting shall be as approved by the city and staked
to the slope as recommended by the manufacturer.
Reinforced straw matting shall be required when planting occurs between
August 15 and April 15. The cover crop and/or reinforced straw mat shall be
used the remainder of the year.
b. Standard #2 -Ground Cover
One hundred (1 00%) percent of the area shall be planted with a ground cover
known to have excellent soil binding characteristics (planted from a minimum
size of flatted material and spaced to provide full coverage within one year).
c. Standard #3 -Low Shrubs
Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners)
shall cover a minimum of seventy (70%) percent of the slope face (at mature·
size).
d. Standard #4-Trees and/or Large Shrubs
Trees and/or large shrubs shall be (planted from a mm1mum of 1 gallon
containers) at a minimum rate of one (1) per two hundred (200) square feet.
Slopes -6:1 or steeper and:
a. 3' or less in vertical height and are adjacent to public walks or streets require
at minimum Standard #1.
b. 3' to 8' in vertical height require Standards #1, #2 and #3.
c. In excess of 8' in vertical height require Standards #1, #2, #3, and #4.
