Dear Mr. Bussey:
As I am sure you are aware, John D. Lusk & Son has filed with the City of
Carlsbad a request for a consideration of the Conditional Use Permit concern-
ing the development our proposed Mobile Home Park on the subject property.
We have taken this action based on the correspondence and discussions that
have taken place between the City of Carlsbad and our company with a deter-
mination having been made that the only way we would bring this matter to a
resolution was to refile a Conditional Use Permit application.
We would like to emphasize that, in taking this action, John D. Lusk & Son has
not changed its position that Conditional Use Permit No. 89, which originally
covered the construction of the mobile home park on Lot 1, Tract 71-2 is still
v alid.
In effect, you could say that we have filed our new request for consideration
of the issuance of the Conditional Use Permit under protest, and as stated above,
on the basis that it is the only apparent way that the matter can be brought to
final resolution.
