Box 2140, Newport Beach, Calif. 92663 (714) 557-8220 (213) 726-6841 June 18, 1975 City of Carlsbad 1200 Elm Street Carlsbad, California 92008 Attention: Donald Agatep Planning Director Re: Mobile Home Park Conditional Use Permit No. 106 Gentlemen: JUN 20 1975 At the Planning Commission meeting held in your city on May 27, 1975, the subject Conditional Use Permit was continued for a period of thirty (30) days to enable the developer to respond to the staff with an additional site design and to enable the developer to attempt to work out a satisfactory agreement with the Carlsbad Unified School District to meet the city's public facilities policy requirement. Based on this continuance, we have taken the following actions: 1. We have authorized Rick Engineering and Allen M. Voorhees and Associates, Inc. , transportation and planning consultants to review the existing street system to enable our company to adequately respond to the traffic circulation system concern as raised by the staff. 2. We requested the architectural firm of Corbin/Yamafugi and Associates to review the site plan and prepare possible revisions for review by the staff. substantially mitigates the concerns that the staff has raised. Attached please find a revised site plan which we feel 3. We have been in contact with the Carlsbad Unified School District in an effort to finalize an agreement between the District and our company to enable us to meet the city's public facilities policy requirement. City of Carlsbad Page Two June 18, 1975 As you are aware, we forwarded a letter to the School District dated May 23, 1975, advising that we would enter into an agreement with the District under protest. On June 11, 1975, following a phone conversation with the District, we received a response to our May 23 letter and a copy of the District's agreement form. In reviewing the agreement form, we find that there is no mention of the land in lieu of fee agreement which we understood had been reached between the City of Carlsbad, the Carlsbad Unified School District and Occidental Land and Development. It has always been our company's understanding that the "contribution" to be made by the developer to the School District on the Occidental properties was to be based on an agreed-upon reduced fee which would take into account the land which Occidental is providing to the city and the School District for public use. Following receipt of the agreement from the District, I spoke with Mr. Ken Wassman concerning the Occidental agreement and he has advised us that he will meet with the School District in the next few days in order to attempt to resolve the matter. apparently exists concerning the contribution which we must make to the School District in order to have the District provide the city with the necessary information concerning the availability of future school facilities, we have not been able to enter into a mutually satisfactory agreement with the School District. Hopefully, the intercession of Mr. Wassman will enable us to complete this agreement in the immediate future. Because of the confusion which Based on the above, we would respectfully recpest that- the Planning Commission once again continue consideration of Conditional Use Permit No. 106 to its first meeting in July. We recognize that it has been necessary for us to request a number of continuances as we attempt to resolve the problems pertaining to our proposed mobile home park development and this request for an additional delay, we feel, is warranted on the basis that we have advised the District of our willingness to enter into an agreement which is consistent with the previously discussed understanding , but was not the agreement which we received from the District. We will be prepared to provide the Planning Commission with a current report as to the status of the discussions with the School District at their meeting now scheduled for June 24, 1975.
