HomeMy WebLinkAboutCUP 106; Lusk Mobile Home Park; Conditional Use Permit (CUP) (32)MEMORANDUM July 21, 1975 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CUP 106 - Lusk Mobile Home Park The following condition replaces number one under Conditions of Approval : The approval is granted for the land described in the application and any attachments hereto, and as shown on the plot plan submitted labeled Exhibit B, dated 7/18/75, which shall be modified to accommodate the C Engineering staff's Memorandum and attachment dated 7/18/75. The location of all buildings, fences, sign roadways, parking areas, landscaping and other facili or features shall be located substantially as shown o the plot plan labeled Exhibit B, except or unless ind otherwise herein, and including the following modific ity S ties n i ca ted ation: An additional emergency access way to Avenida de Encinas shall be provided at the northern boundary of the project, to be accomplished by deleting one mobile home pad. Guest parking may be provided on the remainder of said pad but shall be designed to avoid blocking emergency access. The following condition should be placed as number 16 under Conditions of Approval : 161 The mature trees situated along Avenida de Encinas shall be retained whenever possible to the satisfaction of the City Engineer and Director of Parks and Recreation. <-- An additional emergency access way to Avenida de Encinas shall be provided at the northern boundary of the project, to be accomplished by deleting one mobile home pad. Guest parking may be provided on the remainder of said pad but shall be designed to avoid blocking emergency access. (2) The construction of the 1st phase of this development shall commence not later than two years after the date City approval is granted. Construction of the 2nd phase shall commence not later than 5 years after the date City approval is granted. Development of both phases must be deligently pursued with4n the above time limitation or the approval will become null and void. (3) All public improvement for both phases shall be provided for or guaranteed prior to issuance of building permits for development of the 1st phase. These improvements shall include but not limited to the following: (a) Right of way shall be dedicated and complete public improvements shall be made to provide a 51-ft. half street section for Poinsettia Lane along the parcel frontage. (b) Right-of-Way shall be dedicated and complete public improvements shall be made to provide a 52-fit half-street section for Avenida de Encinas along the parcel frontage, including a separated bikeway. Btreet improvements shall be made from Poinsettia Lane to 30 ft. beyond the main entry for Phase I and shall be completed prior to occupancy of Phase 11. (c) Prior to building permit issuance, the developer shall enter into an agreement with the City pro- viding for contribution by the developer 1/4 of the cost to provide a traffic signal at the inter- section of Poinsettia Lane and Avenida de Encinas, the total amount to be determined by the City Engineer pursuant to such a traffic signal policy as the City Council may adopt. (4) All requirements of any law, ordinance or regulation of the State of California, City of Carlsbad, and any other governmental entity shall be complied with. adjacent property and streets.
