Lusk, Mobile Home Park In order to clarify the requirement of the subject property to participate in the construction of the A.T.E S.F. Railroad overcrossing at Poinsettia Lane and in accordance with the agree- ment between the City and Occidental Land, Inc. (the previous property owner) dated July 2, 1974, the following condition should be added to the proposed list of conditions of approval: "Prior to the approval of a final map, or prior to the issuance of a grading permit, whichever comes first, $44,512.36 shall be deposited with the City of Carlsbad in accordance with the First Supplement To Agreement For A.T.& S.F. Railroad Overcrossing at Poinsettia Lane between the City of Carlsbad and Occidental Land, Inc. dated July 2, 1974." As an explanation, this agreement requires Occidental or their successors in interest to contribute $742.12 per acre for that land developed within the approved master plan ($742.12 times 59.98 acres = $44,512.36).
