IIPGAMAN , PLANNING DIRECTOR & .. ~ 1, REQUEST FOR CUP APPLICATION CUP-106 was granted to John D. Lusk & Son for a Mobile Home Park located on the north side of Poinsettia Lane between 1-5 and the AT&SF railroad. This Conditional Use Permit has' a coildition that states: "The construction of the first phase of this development shall commence not later than twd years after the date city approval is granted. Construction of the second phase shall commence not later than 5 years after the date city approval is granted. Dev- elopment of both phases must be diligently pursued within the above time limitation or the approval will become null and void." This CUP was adopted on July 23, 1975, and therefore will expire in July of this y-ear if building permits are not issued. Since approval of the Coastzl Commission and sewer availability is remote, it appears tk3t it is not possible to issue building permits by July 1977. This condition is consistent with City Law and past action a on this case. Originally a CUP was issued for a mobile home park in 1969. CUP expired because construction did not commence within the time limits as stated in Section 21.58.020. This section requires initiation of construction within 18 months of CUP approval or a specific time limit as specified in the CUP. The applicant has had since 1969 to construct this park with full knowledge of time constraints. . that e e re-opened to allow an extension of this time equirement. I recommend that this request for a new application not be considered an exception as contained in City Ordinance 7048, for the followir-g reasons: 1. The original CUP is clear that it was awarded only for The City Attorney determined that this Harry Merrill of Lusk & Son has requested a two year period, and therefore any amendment-to extend' would have to be considered adding to the sewer demand. 2.
