HomeMy WebLinkAboutCUP 107; Maldonado David & Olivia; Conditional Use Permit (CUP) (14)DATE : TO : FROM: SUBJECT: MEMORANDUM August 27, 1980 James Hagaman, Planning Director Mike Howes, Assistant Planner REVIEW OF CONDITIONAL USE PERMIT 107 Conditional Use Permit 107 allowed the Maldonado family to construct and operate a greenhouse on a property located on the north side of Basswood Avenue. During the first week of June, Sergio Jlaldonado and Bryan Lee came into this office and were concerned that the conditional use permit would be revoked. They claimed that they had received several letters from the city informing them that their CUP was about to expire. Mr. Lee and Maldonado did not have the letters with them and appeared to be quite confused by the process. Conditional Use Permit 107 was approved by the Planning Commission on March 27, 1975. Condition No. 10 of this CUP stated: This permit shall be reviewed on a five-year increment starting in March, 1980, to determine the following: a) The greenhouse is still compatible with surrounding uses. b) The structure has been maintained in good and safe repair. c) The driveways have been maintained in a dust- free manner. A field check on June 16, 1980, revealed that the following information: 1. The greenhouse appears to be still compatible with surrounding uses. Most of the property sur- rounding the greenhouse is vacant. A few of the surrounding parcels do have single family homes on them, however, it appears that all of these homes have been there since 1975. 2. The greenhouse and the other buildings have been maintained in good and safe repair. 3. The driveway to the property has been paved. 4. The field check also revealed that the greenhouse complied with all other conditions for approval of CUP-107. On June 17, 1980, I sent you a memo recommending that the conditional use permit be renewed for an additional five years. The next day you sent me a memo requesting that I check to see if the applicants were meeting condition #4 of the conditional use permit approval. This condition required that: The applicant shall install a view obscuring wall or hedge on all sides abutting lots with residences in a manner acceptable to the Planning Director. Also, you requested that I check to make sure the applicants were not using the public right-of-way adjacent to their property for storage. A field check shortly thereafter revealed the following: 1. The property to the north of the subject property is vacant. A four foot high wood fence is located on top of a 4'-6' high enbankment on the westerly and southerly sides of the property. A chain link fence has been installed along the easterly side of the property. Trees along the northern part of the easterly property line shield the greenhouses from the nearest residences. There is one part of the easterly property line that does not have any trees in front of it, however, the nearest residences to this side of the property are located approximately 400' from the subject property. 2. The owners of the property were storing an old sports car on the city property adjacent to the greenhouse operation. They also had a trash container partially on the city's property. I informed them that these items would have to be removed or placed on their own property. They informed me that they would do so. Approximately a week ago I received a phone call from Sergio Maldonado to inform me that the car had been removed and the trash container was on their property. A field check on August 4, 1980, confirmed this information. I reconunend that CUP-107 be extended for another five years. This operation is meeting all of the conditions of the CUP -2- and there has been no substantial change in the surrounding land use since the CUP was issued. Although part of the easterly side of the property is not obscured by a hedge or solid fence it is located far enough away from the existing residences that it might as well be fronting on vacant land. Hopefully this matter will not have to be heard by the Planning Commission. If you feel that this matter could be handled administratively, please let me know and I will put a memo in the file and notify Mr. Maldonado and Mr. Lee. MH:ls 8/19/80 -3-
