SUBJECT : CUP-124 (A-1) , MONTESSORI: AMEND CUP-124 (A-1) TO PERMIT A SIDE YARD REDUCTION FROM 10 FEET TO 5 FEET
TO ALLOW CONSTRUCTION OF THE PREVIOUSLY APPROVED
NEW BUILDING
The applicant, Jeff Crisman, has requested that his conditional
use permit be amended to permit the previously approved new
building addition to be constructed within five feet of the side
property line.
Mr. Jeff Crisman contends an error on the part of the draftsman
has created a situation which mandates the reduction of the side
yard. Mr. Crisman states that during construction it was dis-
covered that the new building, as approved, would encroach five feet into the required side yard. The applicant maintains the
amendment will constitute no increase in square footage from that
specified in the existing CUP.
The zoning ordinance pertaining to conditional use permits makes the following allowances for reduced yards:
The provisions for required front and side yards applicable to the particular zone in which any such
use is proposed to be located shall prevail, unless in the findings and conditions recited in the reso- lution dealing with each such matter, specific
examptions are made with respect thereto. (Ord. 9252 Section 1 (part), 1970: Ord. 9060, Section 1404).
Municipal Zoning Code 21.42.050.
Review of this amendment, by the Planning Commission, is scheduled
for July 11, 1979.
